Use this form if you are a party to a proceeding and wish the case to be included in the Short Cases List. A copy of this request must be forwarded to all parties.

Cases will be typically included in the Short Cases List where:
- there are limited parties;
- the application, the grounds of appeal or grounds of refusal suggest that the issues are limited in number and extent;
- the case is capable of being heard and decided in less than two hours;
- a site inspection is unlikely to be required.

PART B – HEARING ALREADY LISTED
Complete this part if you are requesting inclusion in the Short Cases List and the proceeding has already been listed for a mediation or final hearing.
A request to include a proceeding in the Short Cases List that has already been listed for a hearing or mediation will normally only be granted in the following circumstances:
- the case is suitable for inclusion in the Short Cases List;
- all parties consent.
The onus is on the party making the request to obtain the consent of all other parties. If another party refuses to consent or will not provide a response, the party making the request must provide details of the circumstances and reasons why the lack of consent or response should be disregarded.
The Tribunal will take into consideration the reasons and the consent or non-consent of parties when deciding whether to include a case in the Short Cases List. The Tribunal will decide whether to include a case in the Short Cases List based onthis written request and any supporting documents. It may choose to hear from the parties at its discretion.
