The Parliament of Victoriaenacts:

Part 3—Repeal of amending Act

Racing Amendment (Modernisation) Act2018
No. 10 of 2018

Part 1—Preliminary

1Purpose

The purpose of this Act is to amend the Racing Act 1958to make further provision for Racing Victoria and to deal with other minor and related matters.

2Commencement

This Act comes into operation on the day after the day on which this Act receives the Royal Assent.

Part 2—Amendment of the Racing Act 1958

3Principal Act

In this Part, the Racing Act 1958 is called the Principal Act.

4Definition

In section 3(1) of the Principal Act, in thedefinition of Racing Victoria, after "RacingVictoria" insert ", by a certification published in the Government Gazette on 19December 2001".

5Certification of Racing Victoria

In section 3A(2)(b) of the Principal Act, after "Schedule 1" (where twice occurring)insert "(asin force before its repeal)".

6New sections inserted after section 3B

After section 3B of the Principal Act insert—

"3C Functions powers and duties of Ministerunder the constitution of Racing Victoria

For the purposes of this Act, the Minister may perform any functions, exercise any powers and carry out any duties conferred onthe Minister by the constitution of Racing Victoria for or with respect to the selection, appointment, resignation and removal of Directors of the Board of Racing Victoria.

3D Racing Victoria not to represent the Crown

Racing Victoria does not represent the Crown.

3ERacing Victoria not a public entity or public body

(1)Racing Victoria is not a public entity within the meaning of the Public Administration Act 2004.

(2)Racing Victoria is not a public body within the meaning of the Financial Management Act 1994.".

7Saving of Racing Victoria

After section 100 of the Principal Act insert—

"100A Saving provision—Racing Amendment (Modernisation) Act 2018

The repeal of Schedule 1 by section 8 of theRacingAmendment (Modernisation)Act 2018 does not affect the certification of Racing Victoriamade by the Minister under section 3A and published in the Government Gazette on 19December 2001 and, on the commencement of section 7 of that Act, Racing Victoria is taken to continue to be certified under that certification.".

8Repeal of Schedule 1

Schedule 1 to the Principal Act is repealed.

Part 3—Repeal of amending Act

9Repeal of amending Act

This Act is repealed on 1 September 2018.

Note

The repeal of this Act does not affect the continuing
operation of the amendments made by it (see section 15(1)
of the Interpretation of Legislation Act 1984).
