MINUTES OF MEETING OF HEMINGBROUGH PARISH COUNCIL HELD AT HEMINGBROUGH METHODIST CHAPEL ON THURSDAY 17TH AUGUST 2017

Prior to the Public Forum the Chairman reminded those present that there should be no recording or filming during the public forum.

17/131 PUBLIC FORUM:-

A member of the public read out a statement on behalf of another member of the public.

A member of the public raised concern that benches had been thrown into the pond and dyke at Oldways. The Chairman advised that the benches had subsequently been put back by community minded members of the public and it was agreed to write a letter of thanks for their assistance.

It was also noted that motorbikes have been riding in the Oldways which has been reported to the police and that the noticeboard at the Landing Lane end of Oldways has been damaged.

Mrs Susan Sellers thanked the Parish Council for repairing the St Mary’s Church Clock.

A member of the public expressed her concerns regarding the planning application for residential development at land off School Road (2017/0772/OUTM).

17/132 POLICE REPORT:-

A report listing the recent Ringmaster notifications received by the clerk was distributed.

17/133 LISTEN TO REPORTS FROM COUNTY AND DISTRICT COUNCILLORS:-

District Councillor J Deans gave an update on PLAN Selby and spoke about the deliverability of sites.

Councillor Deans also advised that Selby District Council have completed their Annual Land Supply Review and that the district now has a 5.4 year deliverable supply of housing.

It was noted that a service of celebration for volunteers including a visit from the Archbishop of York will be held on Friday 6th October at St Mary’s Church and that volunteers are welcome.

17/135 DECLARATION OF INTEREST/DISPENSATION REQUESTS:-

a) Councillor J Strelczenie declared an Other Interest in Item (17/139c) Oldways - Agree to tree work required to three trees backing onto Spire View and (17/140a) Update on Transfer of Ownership of Memorial Garden due to being a member of the Parish of Hemingbrough Historical/Heritage Society.

b) Councillor L Stebbings also declared an Other Interest in Items (17/139c) and (17/140a) due to being a member of the Parish of Hemingbrough Historical/Heritage Society.

17/136 CHAIRMAN’S OPENING REMARKS:-

The Chairman reported that the clerk had not received a response from the internal auditor regarding a request to provide her contact details.

The Chairman also spoke about the disruption that occurred at the July Parish Council meeting.

17/137 CLERKS REPORT:-

Correspondence not listed on the agenda:-

Letter received from the Parochial Church Council asking the Parish Council to inform them when the grass cutting contract is to be discussed and contract awarded so their representative Mrs Susan Sellers may be present at the appropriate meetings.

Selby District Council

The clerk advised that new anti-dog fouling window stickers are being offered to Parish and Town Councils across the district in the latest Don’t be a Waster – Reduce, Reuse & Respect initiative.

The stickers which are visible in the dark have been produced for use in homes next to footpaths where dog fouling is an issue to encourage owners to clear up after their dog and it was agreed to order the stickers for use in the community.

Selby Area Committee

The clerk advised that the Parish Council was invited to vote in a ballot to identify two Parish/Town Councillors for appointment to represent Parish/Town Councils in the Selby District area on the Selby Area Committee.

The clerk read out the names of the four candidates (two for Selby North and two for Selby South) but the Parish Council declined to vote on the appointments.

Proposed Traffic Order on Main Street and School Road

The clerk read out an email received from Victoria Day (Highways Project Engineer) advising that Highways have received a number of objections to both traffic orders therefore they have determined that the best way forward would be for the Parish Council to decide whether they would still like to go ahead with the proposed traffic order.

It was noted that NYCC would be writing to all objectors asking them to contact the Parish Council to put their views across and it was agreed that this would be discussed further at the September meeting.

Main Street Resurfacing

The clerk reported that Mark Lumby (Highways) had recently inspected the roads in this area and that Victoria Day (Highways Project Engineer) would report back on his findings as soon as possible.

Councillor F Davidson requested a site meeting with Mark Lumby to look at the work required for Main Street.

17/138 CONFIRMATION OF MINUTES:-

The Minutes of the Meeting held on Thursday 20th July 2017 were proposed by Councillor L Stebbings, seconded by Councillor F Davidson and agreed with a show of hands. RESOLVED

17/139 TO RECEIVE INFORMATION ON THE FOLLOWING ON-GOING ISSUES AND DECIDE FURTHER ACTION WHERE NECESSARY:-

a) Registration and License Update/Village Greens

The clerk advised that she had signed further paperwork as required and that the registration was being dealt with by Land Registry.

b) Water Lane Pond

Tree Management

The Chairman advised that when the pond was excavated the trees were not removed from the island due to aesthetics but that the falling leaves were now spoiling the look of the pond.

The Parish Council discussed the options and it was agreed that the trees should be thinned out and quotes would be obtained to carry out the work required.

c) Oldways

Agree to tree work required to three trees backing onto Spire View

The Chairman advised that he had met with Fountains who wished to cut down three trees in the Oldways that are within two metres of the electricity power lines.

It was noted that the Chairman had spoken to the resident of Spire View who had raised concern regarding the trees being cut down so the Chairman had been liaising with Fountains with regards to the possibility of saving the trees but reducing them by a third to clear the power lines and appease the resident.

It was proposed by Councillor F Davidson, seconded by Councillor K Terry and agreed with one abstention that the trees be cut down by a third. Chairman to advise Fountains of the Parish Council’s decision.

d) Speeding on School Road/Update on 20’s Plenty Campaign

The Chairman reported that the campaign is gathering momentum with more Parish and Town Councils becoming involved.

e) Land on St Marys Avenue registered to the Parish Council

Councillor F Davidson reported that five fruit trees are to be ordered as agreed at the July Parish Council meeting and that Henleys Nurseries have recommended that the trees are planted in October.

Councillor L Stebbings reported a problem with overhanging branches from Nursery Close. Councillor Stebbings to provide clerk with a list of properties that require a letter asking the resident to cut back their hedges.

a) UPDATE ON TRANSFER OF OWNERSHIP OF MEMORIAL GARDEN: -

No further update

b) HEMINGBROUGH PARISH COUNCIL RISK ASSESSMENT FOR THE MEMORIAL GARDEN:-

Councillor R Chilvers proposed that as per their previous letter the Parish of Hemingbrough Historical Heritage Society be allowed to fill the tanks and the Parish Council carry out an independent risk assessment before they consider the transfer of ownership to the Parish Council and this was seconded by Councillor K Terry.

The Chairman circulated the file search received from North Yorkshire County Council concerning the Hearthstone Garage.

A named vote was requested by Councillor Chilvers and the votes were recorded as follows:-

In favour of the proposal:- Councillors R Chilvers, F Davidson and K Terry

Against the proposal:- Councillors L Stebbings, J Sedman and J Strelczenie

Councillor M Allitt abstained from the vote due to being a new member of the Parish Council.

As the vote was tied the Chairman used his casting vote against the proposal and spoke about the safety of the tanks under the site.

Following advice receive from the clerk the Chairman subsequently rescinded the vote later in the meeting and advised that the item will be revisited at the September Parish Council meeting.

17/141 HAGG LANE DYKE AND DETERIORATION OF THE HIGHWAY:-

It was noted that the road has been resurfaced to Frog Hall Cottage but that no work has been carried out on the dyke.

Councillor K Terry advised that he has raised this twice with the Ouse and Derwent Drainage Board and that he has also been told by Highways that they were going to culvert the dyke.

It was also noted that the signage has still not been put up, clerk to chase this up with Vicky Day (Highways Project Engineer).

17/142 PLANNING:-

a) Applications Received ex Selby District Council:

1. (2017/0806/TPO) Proposed crown reduction by 2 metres on the house side to 1 No Beech (T1) and crown reduction to give a 2 metre clearance to 1 No Beech (T2) covered by TPO 18/1987 at Fagus View School Road, Hemingbrough. Object

1) Due to the mature beech trees a full tree surgeons report should be required prior to any work being carried out.

2. (2017/0772/OUTM) Outline application including access (all other matters reserved) for residential development at Land off School Road, School Road, Hemingbrough.

Due to time constraints Councillor M Allitt proposed that the Parish Council hold a separate meeting to discuss the planning application in full, this was seconded by Councillor L Stebbings and unanimously agreed.

It was agreed that an extraordinary meeting (open to the public and press) would be held on Thursday 24th August commencing at 7pm.

District Councillor J Deans left the meeting.

3. (2017/0752/HPA) Erection of a rear two storey extension and rear single extension following demolition of existing structures at Jasmine Cottage, Main Street, Hemingbrough. Object

1) The site lies in the Conservation Area

2) Intrusion into an ancient garth

3) No off road parking and concern that further development will result in extra vehicles

4. (2017/0713/HPA) Proposed conversion of garage and single storey extension to the front of Peppercorn House, 2 Back Lane, Hemingbrough. No Objections

b) Note planning permission refused for: NIL

c) Note planning permission granted for: NIL

d) Note planning permission withdrawn for: NIL

17/144 HEAR REPORTS FROM COMMITTEE REPRESENTATIVES: -

Councillor F Davidson advised that the HI & PFA were still in the process of arranging a meeting and that he would raise the request to put a Parish Council noticeboard on the scoreboard.

17/146 RECEIVE REPORTS FROM COUNCILLORS REGARDING PARISH ISSUES:-

Councillor F Davidson raised concern that Inner Moor Lane is only maintained for the first 100 yards and the remaining footpath is very overgrown.

Clerk to contact Mike Guerney (NYCC) regarding the maintenance of this public footpath which is well used by dog walkers.
