Thank you for your recent request received 14 April 2014. Your request was actioned under the Freedom of Information Act 2000 in which you requested the following

  1. Please supply me with an email copy of your internal information/guidance on resident payment of Adult Care Home Costs (ACHC) relating to Means Testing and Deprivation of Assets (DoA) and recovery of Deprived Assets.
  1. In last 5 years how many individuals/cases have you investigated for Deprivation of Assets (DoA) with regards ACHC.
  1. How much monetary value was recovered?
  1. How many DoA court cases did you instigate?

Response:

Liverpool City Council holds the information requested and can confirm the following:

  1. We do not have any separate internal policy on Depravation of Assets for care home costs. Liverpool City Council Financial Assessments would apply the national guidance charging for Residential Accommodation, (CRAG), which sets out in section 6 of the guidance, depravation of assets (DoA).

  1. Investigations revealed that clients had intentionally deprived themselves of assets – so they were treated as self-funders – no income was lost by the City Council

The City Council will consider appeals, referrals or complaints in respect of your Freedom of Information Act 2000 and you must submit these in writing to within 28 days of receiving your response.

The matter will be dealt with by an officer who was not previously involved with the response and we will look to provide a response within 28 working days.

If you remain dissatisfied you may also apply to the Information Commissioner for a decision about whether the request for information has been dealt with in accordance with the Freedom of Information Act 2000.
