RULES OF CHOBHAM CRICKET CLUB
GENERAL
1.The Club shall be called “Chobham Cricket Club”.
- The objects of the Club shall be:-
(a) To promote the amateur sport of cricket in Chobham and community participation in the same.
(b) To provide, manage and maintain all things incidental to the playing of cricket, the social intercourse of Members and the provision for them of facilities for meeting one another and entertaining their friends.
(c) To ensure a duty of care to allMembers of the Club by adopting and implementing the English Cricket Board (ECB) "Safe Hands - Welfare of Young People in Cricket" policy and any future versions of the policy.
(d) To ensure a duty of care to all members of the club by adopting and implementing the ECB Cricket Equity Policy and any future versions of the Policy
(e) To do all such lawful things as are in the opinion of the Committee incidental or conducive to the attainment of all or any objects hereinbefore mentioned.
3.The Club Colours shall be light and dark blue.
RULES
- The rules of the Club shall be alterable only by a resolution of a General Meeting of the Club passed by a majority consisting of at least three quarters of the Members present in person at such General Meeting of the Club duly convened in accordance with Rule 41 hereof at which there shall be present in person a quorum in accordance with Rule 42 hereof and the Members shall at all times be bound by the Rules contained in this document (or any document amending or replacing the same which has been authorised by the Committee).
- Rules 5 and 57 hereof shall be unalterable.
- The Committee may from time to time make, repeal and amend any such Regulations (not inconsistent with these Rules) as it shall think expedient for the management and well being of the Club, of any premises owned or occupied by the Club and of the facilities of the Club. All Regulations made by the Committee under this Rule shall be binding upon the Members until repealed by the Committee or set aside by a resolution of a General Meeting of the Club.
- The Committee shall be the sole authority for the interpretation for these Rules and of the Regulations made from time to time by the Committee and the decision of the Committee upon any question of interpretation or upon any matter affecting the Club and not provided for by these Rules or by the Regulations shall be final and binding on the Members.
MEMBERSHIP OF THE CLUB
Membership of the Club shall be open to anyone interested in the sport on application regardless of sex, age, disability, ethnicity, nationality, sexual orientation, religion or other beliefs. However, limitation of membership according to available facilities is allowable on a non-discriminatory basis. The Club may have different classes of Membership on a non-discriminatory and fair basis.
The Members of the Club shall comprise:-
a) Life Members
b) Life Vice Presidents
c) Vice Presidents
d) Non-Playing Members
e) Playing Members aged 18 years or over at midnight on 31st of August in the year preceding the current season
f) Junior Playing Members aged under 18 years at Midnight on 31st of August in the year preceding the current season
g) Family Members
h) Student Playing Members – People actively in full time education
i) Unemployed Playing Members
j) Social Membership (Non voting)
Social membership is available to persons wishing to use the club bar and be informed of any club social functions –
it does not have any voting rights.
- Life Members and Life Vice Presidents shall be such persons as shall be elected at a General Meeting of the Club upon nomination by the Committee.
- Vice Presidents shall be such persons who have rendered assistance to the Club or otherwise supported or interested themselves in its activities as shall be elected at a Meeting of the Committee after nomination by the President or other member of the Committee.
- The Non-Playing and Playing Members shall be such persons whose applications shall in manner hereinafter provided be accepted by the Committee upon such evidence as the Committee may deem satisfactory to establish in all respects their suitability to be Members of the Club.
12.Family Members shall comprise the spouse and non-playing children under the age of 18 years of any Member who shall in addition to payment of his subscription as a Non-Playing or Playing Member pays the Family Membership subscription.
13.Every application for Membership, which shall be made in writing signed by the applicant, shall include the name, address and occupation of the applicant and shall be displayed in the Pavilion for a period of not less than fourteen days. Every such application shall be in such form as the Committee shall from time to time prescribe. The Committee shall consider each such application at the Meeting of the Committee next following the expiry of such period of fourteen days.
14.Each application for Membership shall be balloted for by the Committee and a simple majority in favour of the applicant shall suffice for admission to Membership.
- Upon the Committee’s acceptance of such an application for Membership the Honorary Secretary shall cause a copy of the Rules to be issued to the applicant who shall upon payment of his subscription become a Member of the Club whereupon the Honorary Secretary shall cause the applicant’s name and address to be entered in the Record of Members. The applicant shall thereby be deemed to have subscribed to the Rules.
- Any Member may resign his membership upon giving notice of his intention to resign in writing addressed to the Honorary Secretary at the official address of the Club and he shall thereupon cease to be a Member. Any Member failing to give such notice before the 1st June in any year shall be liable for that Season’s subscription in full.
- The Committee may only refuse the application for membership or revoke or cancel the membership of any person for good cause such as the conduct or character of such person being likely to bring into disrepute or to be injurious to the interests of the Club or the Sport of Cricket. Any decision of the Committee to refuse, revoke or cancel membership shall have immediate effect. The Committee may only exercise the powers conferred upon it bythis Rule at a duly convened Committee Meeting at which there shall be present in person a quorum of not less than four Members of theCommittee.
- Any person upon ceasing to be a Member of the Club pursuant to Rules 16, 17, or 22 hereof shall forfeit all right to and claim upon the Club, its property and funds and shall have no right to demand the return in whole or in part of any subscription previously paid by him but shall remain liable to pay all arrears of subscriptions and other moneys which shall be due from him to the Club at the date of his so ceasing to be a Member and the Honorary Secretary shall forthwith cause his name to be removed from the Record of Members.
- The Record of Members which shall include the names and addresses of all Members shall be kept at all times in the Pavilion and shall be available for inspection by any Member upon giving reasonable prior notice to the Honorary Secretary. In the case of Family Members, it shall merely be recorded on the Record of Members that a Member shall have paid the Family Membership subscription.
- All annual subscription shall be payable not later than 1st June in each year or upon election in the case of applicants whose election takes place after that date.
- The rates of subscription for the next following season shall be determined each year by resolution at the Annual General Meeting in respect of each of the following categories of Membership:
a) Non-playing
b) Playing (aged 18 years or over at midnight on 31st of August in the year preceding the current season)
c) Junior Playing (aged under 18 years at Midnight on 31st of August in the year preceding the current season)
d) Family
e) Student
f) Unemployed
g) Non voting social
and the rates of subscription so determined may provide for discounted or reduced rates of subscription for payments made on or before 1st June in any season or in the case of applicants whose election taking place after 1st June. In default of the passing of any such resolution the rates of subscription for the previous season shall continue to apply.
The Club will keep subscriptions at levels that will not pose a significant obstacle to people participating.
- Any member whose subscription remains unpaid for two months or an applicant whose subscription remains unpaid for one month after the date for payment of the same shall be deemed to have forfeited his right to membership but such forfeiture may be waived by the Committee upon payment by such Member or applicant of all arrears or upon such other conditions as the Committee may determine. Any Playing Member whose subscription remains unpaid after 1st June shall not be eligible for selection in precedence to any Playing Member whose subscription has been paid by that date and who is available for selection.
- All subscriptions payable by Members and applicants hereunder shall be inclusive of Value Added Tax.
- Except as otherwise provided by these Rules, no subscription paid by any Member hereunder shall in any circumstances be repaid to such Member in whole or in part.
OFFICERS AND COMMITTEE
25.The Officers shall comprise the President, The Chairman of Committee, the Honorary Secretary, the Honorary Treasurer, the Ground and Equipment Manager, the Cricket Manager and the Youth Development Officer.With the exception of the latter two posts, who will be appointed by the Committee, the other named officers will be elected annually by the Annual General Meeting.
26.The Executive Committee shall comprise of the Officers named in rule 25 elected annually as aforesaid.
- All Captains and Vice Captains of the Saturday and Sunday XIs shall be elected annually at the Annual General Meeting.
- In the event of a casual vacancy or vacancies arising, the Committee shall have power to elect to its own number such person or persons (being Members, other than Family Members) as it considers fit to fill such vacancy or vacancies until the next Annual General Meeting but shall not be under any obligation so to do.
- All the real and personal property of the Club (other than cash which shall be under the control of the Honorary Treasurer) shall be vested in the Trustees and shall be held by them in trust for the Members for the time being of the Club (other than Family Members) and shall be dealt with by them as the Committee shall from time to time direct by resolution (or which an entry in the Minute Book shall be conclusive evidence) provided always that the Trustees shall not without an affirmative resolution of a General Meeting of the Club duly convened in accordance with Rule 41 hereof at which there shall be present in person a quorum in accordance with Rule 42 hereof sell, mortgage, lease for any period or periods exceeding one year or otherwise dispose of any of the real property of the Club.
- The Trustees shall be not more than three and not less than two in number and shall be appointed by a General Meeting of the Club and shall hold office until death or resignation or cessation of Membership unless removed from office by a resolution of a General Meeting of the Club duly convened in accordance with Rule 41 hereof at which there shall be present in person a quorum in accordance with Rule 42 hereof. Any vacancy in the office of Trustee shall be filled at the same or the next General Meeting of the Club. For the purpose of giving effect to any such appointment, the President of the Club for the time being is hereby nominated as the person to appoint new Trustees of the Club within the meaning of Section 36 of the Trustee Act 1925 and he shall by Deed duly appoint the person so appointed as the new Trustee of the Club and the provisions of the Trustee Act 1925 shall apply to any such appointment.
COMMITTEE MEETINGS
- The Committee shall meet at such times, as it shall from time to time determine to examine the accounts and arrange the affairs of the Club. At least seven days notice of such meeting shall be given to every Member of the Committee whenever possible. Any three Members of the Committee may request the Honorary Secretary to call a special meeting of the Committee at any time on at least three days notice.
- Any four Members of the Committee present in person shall form a quorum.
- In the absence of the Chairman, the Committee shall appoint any other of its number to take the Chair. The Chairman shall have where necessary a second or casting vote in addition to his own.
- The Honorary Secretary shall cause to be taken minutes of all proceedings of the Committee and they shall at all times be open to the inspection of any Member of the Committee for the time being upon application to the Honorary Secretary.
- Except as otherwise provided in the Rules, the Committee shall have the absolute power to make such regulations as it sees fit for the conduct of its meetings.
POWERS OF COMMITTEE
- Except as otherwise provided by these Rules, the control of the Club and the management and administration of its property, funds and affairs generally shall be vested in the Committee, which shall have full power to arrange and transact the affairs of the Club. The Committee shall have power to fix and vary the amount of any match toll payable by each player in home and away fixtures to cover the cost of tea, travel, insurance and other incidental expenses of the match.
- Without restricting in any way the generality of the powers hereinbefore conferred, the Committee may, subject to the provisions of Rule 29 hereof, from time to time at its absolute discretion raise or borrow money for any of the purposes of the Club or for the carrying out of any works resolved to be carried out by the Committee or by a General Meeting of the Club in such manner, upon such security (if any) and upon such terms and conditions in all respects as it may think fit provided always that the total amount of moneys so borrowed shall not exceed the amount authorised by the Members in General Meeting from time to time.
- The Committee may from time to time appoint such Sub-Committee as it may deem necessary or expedient and may depute or refer to them such of the powers and duties of the Committee as the Committee may in its absolute discretion determine provided always that in the case of any Sub-Committee so appointed to deal with the purchase for or with the supply by the Club of intoxicating liquor all of its Members must also be Members of the Committee elected annually by the Members of the Club and who on ceasing to be Members of the Committee shall automatically cease to be a Member of such Sub-Committee. In matters other than the purchase or supply of intoxicating liquor, each sub-committee shall comprise at least one member of the Committee elected annually by members of the Club. The Chairman of Committee, the Honorary Secretary and the Honorary Treasurer shall ex officio be members of all sub-committees so appointed. All such sub-committees shall periodically report their proceedings to the Committee and shall conduct their business in accordance with the directions of the Committee.
- The Committee shall have power to co-opt Members to the Committee or any Sub-Committee for the purposes of filling any vacancies which may arise or otherwise. The Committee shall appoint a Club Welfare Officer and notify the County Welfare Officer.
- An Annual General Meeting of the Club shall be held once in every calendar year between 1st November and 31st January of the following year on a date and at a time and venue to be determined by the Committee.
- Notice of the Annual General Meeting or of any other General Meeting of the Club shall be posted to all Members entitled to vote thereat not less than 7 days prior thereto and such notice shall state the general nature of the business to be transacted thereat and shall include a copy of all resolutions put forward under Rules 4, 21, 29 and 30 hereof to be proposed at such General Meeting. In the case of the Annual General Meeting such notice shall be accompanied by a copy of the Accounts of the Club to the 30th September immediately prior thereto (or such other date determined in accordance with Rule 48 hereof) audited in accordance with Rule 50 hereof.
- For the purposes of an Annual General Meeting of the Club ten members entitled to vote thereat and present in person shall form a Quorum. For the purposes of any other General Meeting twenty Members entitled to vote thereat and present in person shall form a Quorum.
- The Chairman of the Committee shall take the chair at all General Meetings of the Club and in his absence the General Meeting shall elect any other Member present to take the chair.
- At a General Meeting of the Club every Member over the age of 18 years (other than family Members) including the Chairman shall have one vote upon every resolution.
Except as otherwise provided for in these Rules, a resolution shall be deemed to have been passed at such a meeting if passed by a simple majority of the Members present at such meeting and entitled to vote thereat.
