Wax sealed/Tape Sealed tenders are invited by GMTD Gaya on behalf of Bharat Sanchar Nigam Limited from experienced contractors/Firms for the following work in Gaya SSA:

Eligibility of bidders:
1. Experience of having successfully completed transportation work in BSNL/other PSUs/Govt organization/reputed Pvt firms for minimum of Rs.200000/- during last three years ending as on date of NIT.
- Registered partnership deed in case of partnership firm or affidavit of the sole proprietorship of the firm on Rs. 100/- non-judicial stamp paper.
- Certificate of Service Tax Registration.
- PAN card of individual in case of sole proprietor and in the name of firm in the case of partnership.
- Valid character certificate issued by DM of concerned District till date of opening of tender.
Complete tender documents along with EMD and supporting documents in sealed cover superscribed with Tender number and name of work and name and address of the contractor addressed to DE (Plg) O/o GMTD Gaya should be dropped in the tender box kept in chamber of DE (Plg) O/o GMTD Gaya on or before last date and time of receipt of tender as given above. No tender will be accepted after deadline. Tender documents will not be issued and accepted after last date and time. Detailed terms and conditions are given in tender documents. The tenderers who comply all the terms and conditions given in the tender documents are only eligible. Tender will be opened by tender opening committee in presence of bidders or their authorised representatives at prescribed date & time.
GMTD Gaya reserve the right to cancel any or all tenders without assigning any reason and is not bound to accept the lowest bid.

SECTION-III
INSTRUCTION AND GUIDANCE TO THE BIDDERS
1 The contractor must carefully read all the terms and conditions & specifications,before filling up the tender schedule and its quotation.
2. SCOPE OF WORK: -
Work comprises of transportation of stores from Divisional store to various exchanges,offices, or other sites inGaya-SSA (Gaya, Aurangabad, Jehanabad, Arwal & Nawada) and vice-versa. Transportation of stores fromCTSD Patna or from any other place may also have to be carried out.
3. IMPORTANT CONSIDERATION
Any clarification on the details of the work can be obtained from the DE (Plg) O/oGMTD Gaya up to one day prior to the date, which is specified for opening of tender.
3.1 The prospective bidders are advised to make a detailed survey of the sites and familiarizethemselves with terrain so that the rates quoted take all factors into consideration.
3.2 Contractors who are confident of executing the work in time by employing the requiredresources and men may only participate in this tender offer.
4.0 WORK OUTPUT
Transportation has to be taken up within 24hrs of getting a telephone call from concernedSDE in charge and has to be completed as per time given in the work order.
5.0 TRANSPORTATION EQUIPMENTS
The contractor shall arrange at his own expense all vehicles and manpower required for transportation of store.
6. SUBMISSION OF TENDERS
6.1 Tenders can be submitted personally and also by speed post/registered post/by hand in theprescribed forms placed in sealed covers super scribed “Tenders for
TRANSPORTATION OF STORES” including tender no and addressee.
6.2 Tender received in covers not sealed will not be opened or considered.
6.3 Technical bid and financial bid should be kept in separate envelope and both should besealed properly by WAX/Tape. Both the bids shall finally be kept in big envelope and WAXsealed/Tape Sealed. Technical bid envelope should be superscribed as “Technical Bid” with name andaddress of the contractor in the corner of envelope. Similarly financial bid shall alsocontain superscribed “Financial bid” along with name and address of the contractor in thecorner of envelope.
6.3 Closing the cover by gum will not be treated as sealed cover. The cover should bear theseal of the tenderer over sealed wax properly fixed on the cover.
6.4 If tenders are sent in double covers, both the inner and outer covers are to be sealed asmentioned above.
6.5 The contractor should certify and affix his signature on each and every page of the tenderdocument, and return it along with his tender offer, as a token of his acceptance of each ofthe condition specified on each page of the Tender document.
6.6 Any attempt for negotiation direct or indirect on the part of a tenderer with the authority towhom he has submitted the tender or the authority who is competent finally to accept itafter he has submitted his tender or endeavours to secure interest for actual or prospectivetenderer or to influence by any means the acceptance of the particular tender will render thetender liable to be excluded from consideration.
6.7 The tenderer will be bound by all terms, conditions and specifications as detailed in this tender document.

6.8 Any tender with condition other than those specified in the tender document is liable to thesummarily rejected. No modification by the contractor of any of the conditions will bepermitted after tender is opened.
6.9 No communication from the contractor in form of any clarification orinformation/document lost sight of in the original tender, etc. will be given anyconsideration, unless any such clarification has been sought for by the DE (Plg) O/o GMTD Gaya.
6.10 No tender without the prescribed E.M.D., accompanying it will be considered foracceptance.
6.11 Late Tender, Tenders received either by post or courier service or in person after thespecified time will not be opened or considered.
6.12 No tender will be received in person by the DE (Plg) O/o GMTD Gayaor any other staffsubordinate to him. Any tenderer wanting to deliver the tender in person should deposit thetender in tender box kept in the office of DE (Plg) O/o GMTD Gaya. The slit of tender box will besealed immediately after the specified time for receipt of tender. Any tender presented inperson by any contractor/his representative after the tender box is sealed will not bereceived either by DE (Plg) O/o GMTD Gayaor by any of his subordinates.
6.13 Tender sent by post, if delivered by the postmen after the expiry of specified time wouldonly be recorded and not opened or considered. Such tenders will be opened only when therequest is made by the tenderer that any demand draft/bank guarantee/pay order enclosed asE.M.D. may be returned in original. The other document will only be recorded and notreturned.
6.14 Incomplete tender form will be summarily rejected without giving any cause. However, the GMTD Gaya reserves the right to consider incomplete tender also if he thinks that it isbeneficial to the BSNL.
7.0 DOCUMENT TO BE SUBMITTED WITH TENDER
(i) One copy of the complete set of tender documents duly filled in and signed on each pageand also at every correction/over writing by the Tenderer or otherwise as prescribed in thedifferent clauses of the tender document/in respect of any matter or documents.
(ii) Authorized copy of PAN Card.
(iii) E.M.D. amount as per details in section I in the manner specified in the document.
(iv) Original “Power of Attorney” in case person other than the Tenderer himself has signed thetender.
(v) Authenticated copy of Partnership Deed, in case of Partnership firm. In case of soleproprietorship however an affidavit to that effect will suffice.
(vi) The full name and address of the tenderer should be written on the bottom left hand sidecorner of the sealed cover.
8.0 EARNEST MONEY
8.1 Earnest Money may be paid separately in the following form: By Cash, Crossed/AccountPayee Demand Draft/Bank Guarantee valid for 150 days on any branch of any NationalizedBank situated at Gaya drawn in favour of the A.O., BSNL O/O GMTD Gaya.
8.2 No interest shall be allowed on the Earnest Money deposited by the tenderer. The EarnestMoney of unsuccessful Bidders will be refunded within a reasonable time after finaldecision of the tender, normally with in three months from the date of opening of tenders.The Earnest Money Deposit of successful Bidders shall be adjusted towards SecurityDeposit for the due fulfillment of the contract but shall be forfeited if the tenderer fails todeposit the initial security deposit and /or fails to execute the agreement within a periodspecified and on his being called upon to do so, after acceptance of the tender or fails tostart the work as stipulated in the letter of intent/acceptance.

9. PERFORMANCE SECURITY
The EMD will be converted to security deposit and remaining SD at the rate 7.5% of the tender value, will be taken in the form ofcash or demand draft or B/G issued by a Schedule Bank in favour of A.O.(Cash) BSNL o/o GMTD Gaya(BG is issued by a Scheduled Bank valid for 18 months) from thesuccessful tenderer or the successful tenderer can give his consent to deduct SD @ 7.5% from the bills submitted by him. If he fails to deposit security deposit within seven days from the dateof call, EMD of the tenderer will be forfeited and tender will be rejected.
10. REFUND OF SECURITY
10.1 The security deposit shall be paid back to the contractor after a satisfactory completion oftender period. Subject to final acceptance of GMTD Gaya. The contractors shallremain liable to the GMTD Gayain respect of any shortfall or discharge liabilitiesnot with standing return of security deposit.
11. TENDER SCHEDULE
The Schedule is schedule of items of work and rates.
11.1 The tender schedule is to be read in conjunction with instructions and guidelines toBidders, conditions of contract and other tender documents and the tenderer and contractorshall be deemed to have carefully examined all these documents.
12. QUOTATION OF RATES FOR SCHEDULE: -
All items of work included in the schedule should be quoted.
12.1 The tenderer will quote the rates in English both in figures as well as in words. The ratequoted in words will be the correct basis and not the rates shown in figure.
12.2 In the case of illiterate contractor, the rates tendered should be attested by awitness.
12.3 All corrections, additions and alternations in the entries and tender papers will be signed inby the tenderer with date. No errors or over-writing shall be permissible unless attestedunder the signature of the tenderer with date.
13. REJECTION OF TENDERS
The GMTD Gayareserves the right to accept or reject any or all tenders withoutassigning any reason whatsoever and will not be bound to accept the lowest tender.
14. VALIDITY
Tenders submitted by the bidders will remain valid for acceptance for a period of 180 daysfrom the date of opening of the tender. The bidders shall not be entitled during this periodwithout the consent in writing of GMTD Gayato revoke or cancel his tender or to varythe tender submitted or in terms thereof. The tenders awarded shall remain valid for aperiod of ONE year. However, it can be extended by further one year or part thereof withthe consent of contractor if work is found satisfactory on same rate & terms conditionssubject to acceptance by BSNL.
15. ACCEPTANCE OF TENDER & AWARD OF WORK
The GMTD Gayashall reserve the right at its/his absolute discretion to accept thetender of any or more than one tenderer either wholly or in parts with out assigning anyreason whatsoever, and it shall be binding on concerned tenderer to execute the work soawarded. The whole work may be split up and accepted parts and not entirely if concededexpedient by the GMTD Gayaat his absolute discretion.
15.1 The GMTD Gaya reserves the right to give another 25% of work, at the same rates, with sameterms and conditions.
15.2 On refusal to do the work or if the successful bidder delays in signing the agreementbeyond the stipulated period, then the GMTD Gayareserves the right to award the samework to other Contractor/Contractors, in full or in part, either at the same rates or at thehigher rates/negotiated

rates of other/next contractor, without any liability to the losssuffered/likely to be suffered by the bidders in the said contract, including forfeiture of theearnest money deposited.
16. SIGNING OF THE CONTRACT AGREEMENT
The successful tenderer after depositing SD shall be required to execute an agreement on anon-judicial stamp paper of Rs. One Thousand only and water mark paper at his own costand in the form annexed here to. In the event of failure of the tenderer to sign theagreement within 15(fifteen) days of being called upon to do so after the acceptance of thetender, or in the event of his failure to start the work as stipulated, the amount of Earnestmoney and/or initial security deposit shall stand forfeited to the BSNL and the acceptanceof the tender shall be considered as revoked.
17. The instruction contained in the tender document shall be deemed to form part of theagreement/contract for the work.

SECTION-IV
CONDITION OF CONTRACT
1. DEFINITIONS
a. The contract means the documents forming the tender and acceptance there of and theformal agreement executed between BSNL and the contractor with documents referred totherein including the conditions of contract, the specifications, and instructions issued fromtime to time by the BSNL and all these documents taken together shall be deemed to formone contract and shall be complimentary to one another.
b. In the contract, the following expressions shall unless where the context otherwise requiredhave the meaning here by respectively assigned to them.
c. The expressions “works” or “work” shall unless and otherwise defined in section-II but itwill also include original, altered, substituted or additional work.
d. The “SITE” shall mean the Offices and Telephone Exchanges, Store Depot., which maybe allotted or used for the purpose of carrying out the CONTRACT.
e. “SITE ENGINEER” shall mean a Sub Divisional Engineer of the BSNL who may beplaced by the GMTD Gaya as in-charge of the work at site at any particular period of time.
f. The contractor shall mean the individual or firm or company whether incorporated or notundertaking the works and shall include the legal personal representative or such individualor persons composing such firm or company or successors of such firm or company and thepermitted assignees or such individual or firm or company.
g. The “ENGINEER-IN-CHARGE” means the DE (Plg) O/o GMTD Gaya who shall supervise andshall be in-charge of the works at any time or who shall sign the CONTRACT on behalf ofthe BSNL.
h. The “BSNL” will mean Bharat Sanchar Nigam Limited.

B. In various clauses shall be taken to mean: -
i.- BSNL as an undertaking under the Ministry of Communication, BSNL of India.
ii.- The Officers in their respective Grades/Groups employed in the office of DE (PLG) by whatever designations are assigned to them from time to time and whomay be in-charge of direction, execution supervision, testing, acceptancemaintenance of accounts and disposal of claims, from time to time and includestheir successors in office. Words imparting the singular number include the pluralnumber and vice-versa.
2. PERIOD OF VALIDITY
Tenders submitted by the bidders will remain valid for acceptance for a period of threemonths from the date of opening of the tender. The bidders shall not be entitled during thisperiod of three months without the consent in writing of GMTD Gayato revoke orcancel his tender or to vary the tender submitted or in terms thereof. The tenders awardedshall remain valid for a period of ONE year. Tender may be extended for further period of 1(one) year on same terms & conditions and rate if tender value remains.

3.0 LABOUR/VEHICLE SUPPLIES
3.1. The contractor shall be responsible for the transportation, storage and safe custody of allmaterials supplied to him by the BSNL. The contractor shall satisfy himself regularly thequality and the quantity of the materials supplied to him and he will be responsible for anysubsequent deterioration and discrepancy in the quality/quantity of the materials.
