SATYANANDA YOGA® AUSTRALASIA
TEACHER ACCREDITATION AGREEMENT
This Agreement is made between Satyananda Yoga Academy Ltd Australasia (referred to as the Academy herewith) and Accredited Satyananda Yoga Teachers (referred to as Accredited Teacher or the Teacher herewith).
The relationship between the Academy and Accredited Teachers is based on a common commitment to the teachings of Satyananda Yoga®.
1. Background
1.1 The Academy’s objectives include the teaching, training, development, promotion and propagation of Satyananda Yoga in Australasia.
1.2 The Academy sets the training and teacher standards that need to be met to become an Accredited Teacher. The Academy also sets standards to guide the Teacher in their teaching of Satyananda Yoga and the associated activities to this teaching.
1.3 The Teacher meets the standards developed by the Academy to be eligible to become an Accredited Teacher of Satyananda Yoga.
1.4 The Academy and the Teacher wish to establish a contractual relationship with respect to the rights, duties and obligations of both parties.
2. Responsibilities
2.1 It is the Academy’s responsibility to set the standards for accreditation.
2.2 It is the Teacher’s responsibility to undertake all activities and responsibilities of being a Satyananda Yoga Teacher including taking the responsibility for all legal requirements as a result of their activities or the activities of teachers and other staff employed by them.
2.3 The Academy in no way undertakes to be responsible for Teachers activities other than to grant or to withdraw a Teacher’s Accreditation in accordance with this agreement.
3. The Accredited Teacher agrees to:
3.1 Only act in ways that demonstrate respect towards Satyananda Yoga and safeguard the authenticity and traditional teachings of Yoga.
3.2 Fulfil the accreditation requirements detailed in Appendix 1, Accreditation Level & Guidelines.
3.3 Maintain skills through attendance at one of the required professional development training programs detailed in Appendix 2, Professional Development.
3.4 Teach within the accreditation level in accordance with the Schedules of Practice for Accredited Teachers detailed in Appendix 3.
3.5 Comply with the Code of Practice as detailed in Appendix 4
3.6 Comply with the Code of Ethics as detailed in Appendix 5.
3.7 Comply with the Recommendations and Legal Requirements as detailed in Appendix 6.
3.8 Use the Trademarks associated with Satyananda Yoga® in accordance with Appendix 7, Trademarks Use by Accredited Teachers.
3.9 Respect the copyright of Satyananda Yoga material in accordance with Appendix 8, Copyright.
3.10 Follow the guidelines for establishing new classes in a new location as detailed in Appendix 9, Teaching Locations.
3.11 Provide the Academy with location of their classes and contact details. This information will be publicised by the Academy unless the Teacher sends written instruction to the contrary.
3.12 Provide information and or reports in respect to the Accredited Teacher’s activities and information that demonstrates that the requirements of this Agreement have been met. This only needs to be provided if requested by the Academy who may request this information in part or whole.
3.13 Not run, without prior written approval from the Academy:
a) Residential courses where the total duration of these residential courses is more than 10 days in any calendar year; and
b) Teacher training courses. This restriction does not apply to short, specialised courses for the further development of Teachers.
4. The Academy agrees to:
4.1 Issue Accredited Teachers with an Accreditation Certificate.
4.2 Authorise Accredited Teachers to receive a 10% discount for courses, residential stays and purchases made from Mangrove Yoga Ashram and Rocklyn Ashram bookshops.
4.3 Make a determination, if required to do so, if conflict arises between a Teacher setting up new classes at a venue with established classes by another Satyananda Yoga teacher. Refer Appendix 9, Teaching Locations.
5. Term
5.1 This Accreditation Agreement will commence on the day that the Accreditation Certificate is issued by the Academy and will continue until terminated by the Academy or the Teacher.
6. Termination
6.1 Accredited Teachers may choose to relinquish their accreditation with written notice to the Academy.
6.2 Accreditation may be terminated by the Academy in the event of:
a) Continuing non-adherence of the Accreditation requirements, or
b) A serious breach of the Accreditation requirements.
6.3 The Academy may terminate this Agreement without notice if the Accredited Teacher:
a) Becomes bankrupt, insolvent, is liquidated or has an administrator or receiver appointed.
b) Is convicted of a serious criminal offence.
c) Dies or is declared mentally incompetent.
d) Does not remedy any breach of the conditions and standards of this Agreement, within one month of the Academy serving notice requesting compliance therewith.
e) Engages in deceptive, misleading, negligent, or otherwise improper use of the Trademarks or engages in unethical or illegal practices and does not stop within one month of the Academy serving notice requesting compliance therewith.
6.4 Provisional Level 1 Accreditation automatically terminates in the event of:
a) Students completing their Yogic Studies 4 (YS4) training at which time their accreditation automatically is upgraded to Level 2 Accreditation.
b) The student withdraws or defers from YS4.
c) The official end date of the YS4 module has passed and the student has not completed all requirements of the module.
7. General
7.1 If a particular provision of this Agreement is terminated or held by a Court of Competent Jurisdiction to be invalid, illegal or unenforceable, the rest of this Agreement shall remain in full force and effect.
8. Variation
8.1 This agreement may be varied by the Academy by giving one month’s notice to the Accredited Teacher in writing.
9. Notices
9.1 A notice may be given to a nominated address of the Academy or the Accredited Teacher by serving it personally, by sending it by post in a prepaid envelope, by facsimile transmission or by email.
10. Governing Law
10.1 This Agreement will be governed and modified according to the laws of New South Wales, Australia.
11. Assignment.
11.1 The Accredited Teacher shall not knowingly or unknowingly assign, sublicense or transfer any of its rights under this Agreement, including but not limited to the right to use the Trademarks. Any attempt by the Accredited Teacher to do so shall be considered void.
12. Non-Waiver.
12.1 Delay or failure by the Academy to exercise any right, power or privilege under this Agreement shall not operate as a waiver nor preclude any other requirement of the Agreement.

Appendix 1 - Accreditation Levels & Guidelines
1. Provisional Level 1 Accreditation:
Students enrolled in Yogic Studies 4 are invited to apply for Provisional Level 1 Accreditation. This level of accreditation allows the student to begin teaching Satyananda Yoga® in a restricted capacity as they complete their studies in accordance with this agreement.
In applying for Provisional Level 1 Accreditation, the applicant agrees to:
· Teach only those practices designated as Beginners and Progressive Beginners in the Schedules of Practice for Accredited Teachers, in Appendix 3.
· Exercise professional discretion at all times in selecting only those practices appropriate to students in any particular teaching situation (Note: please consult the Schedules of Practice for Accredited Teachers, in Appendix 3 on what BYB (Bihar Yoga Bharati) and the Academy consider to be appropriate); and
· Complete a workplace approved first aid certificate every three years. Please enclose a copy of your first aid certificate to the Academy with your application for accreditation.
· Only teach to a special needs group if prior written approval has been received from the Academy.
· Their Provisional Accreditation being valid until the end date of the Yogic Studies 4 (YS4) module the student is enrolled in.
· If a Provisionally Accredited student defers or withdraws from YS4, their provisional accreditation terminates automatically as of the date of withdrawal or deferral.
· Insurance organized by the Academy and paid by you, is contingent upon you being Level 1 accredited. Once accreditation is terminated, insurance cover is also terminated.
2. Level 1 & Level 2 Accreditation:
· Upon successful completion of Yogic Studies 4, those teachers who have been granted Provisional Accreditation will automatically be upgraded to Level 2 Accreditation. There is no need for any further applications for this to occur. A new Level 2 Accreditation Certificate will automatically be sent to you.
· For those teachers who have not been granted provisional accreditation upon successful completion of Yogic Studies 4 (previously Teacher Training 1 (TT1)) and all the Bridging by either the stipulated end of course date or the final closing date for Bridging given in the Student Handbook, you are invited to apply for full Accreditation (Level 2)
· Upon application, one of two levels of Accreditation may be awarded by the Academy i.e. Level 1 or Level 2.
3. Those awarded a Level 1 Accreditation agree to:
· Teach predominantly from those practices designated as Beginners and Progressive Beginners in the Schedules of Practice for Accredited Teachers, in Appendix 3. Beyond that, teach within the level of experience attained through formal training and personal sadhana.
· Exercise professional discretion at all times in only selecting those practices appropriate to students in any particular teaching situation. (Note: please consult the Schedules of Practice for Accredited Teachers in Appendix 3 as a guideline on what BYB and the Academy consider to be appropriate); and
· Complete a workplace approved first aid certificate every three years. Please enclose a copy of your first aid certificate and return it to the Academy with your application for accreditation.
4. Those awarded a Level 2 Accreditation agree to:
· Teach within the level of experience attained through formal training and personal sadhana.
· Exercise professional discretion at all times in only selecting those practices appropriate to students in any particular teaching situation (Note: please consult the Schedules of Practice for Accredited Teachers in Appendix 3 as a guideline on what BYB and the Academy consider to be appropriate); and
· Complete a workplace approved first aid certificate every three years. Please enclose a copy of your first aid certificate and return to the Academy with your application for accreditation.
Teachers currently holding a Level 1 Accreditation may apply for Level 2 Accreditation by enclosing a copy of their previous qualifications and a brief summary of their latest professional development activities. The Academy will advise such applicants of any further studies or professional development activities required to obtain Level 2 Accreditation.
