12.CATALOG:This course introduces the student to the basic skills needed to begin evaluating client needs regarding the use of alternative solutions to resolving conflicts and to explore the changing climate of litigation-oriented practices, including ethical considerations.

Course-Level Outcomes:

Upon completion of the course, the student will be able to:

  1. Recognize the methods and procedures of conflict resolution and be able to apply the methods and procedures to given factual situations.
  1. Distinguish between the different non-adjudicative solutions available in conflict resolution.
  1. Apply and evaluate the factors used to determine appropriate conflict resolution methods and analyze and diagnose the basis of conflict in a given factual situation.
  1. Develop the ability to participate or mediate and prepare a mediation or arbitration brief based on specific facts.

This course is a legal specialty course developed in accordance with the standards and guidelines required by the American Bar Association, Standing Committee on Paralegals which body has approved the Paralegal Studies Program at CoastlineCommunity College. Section G-302 I. of said Guidelines, as approved September 1, 2003, states as follows:

“The following requirements apply to legal specialty courses: 1. A legal specialty course is a course that (1) covers substantive law or legal procedures or process, (2) has been developed for paralegals, and (3) emphasizes practical paralegal skills.”

In the classroom the instructor may use traditional methods of lecture/discussion; role-playing; student presentations; and multimedia presentations or other films, videotapes, DVD, or CD-ROM presentations. In designing the course, the instructor may also use guest lecturers, field trips, and cooperative learning group activities. In addition to text reading and written or oral assignments, students may be given written projects using the Internet, CD-ROM, or online factual or legal research.
