On motion of Mr. , seconded by Mr. , the following resolution was offered:
RESOLUTION NO.
A resolution authorizing the Chairman of the Jefferson Parish Council, or in his absence the Vice-Chairman, to execute an agreement with the State of Louisiana, Department of Transportation and Development and with the Regional Planning Commission for the design and construction of Peters Road Bridge & Extension (Phase 2), State Project No. H.008068, Federal Aid Project No. H008068, Public Works Project No. 2003-017-RB. (Council District 1)
WHEREAS, Plaquemines Parish (hereinafter, PLAQUEMINES) in cooperation with Jefferson Parish (hereinafter, JEFFERSON), the Regional Planning Commission for Jefferson, Orleans, Plaquemines, St. Bernard, St. Tammany, and Tangipahoa Parishes (hereinafter, RPC), and the Louisiana Department of Transportation and Development (hereinafter, LA DOTD) are committed to the extension of Peters Road (LA 1261), a Louisiana State Highway, from its current terminus at Engineers Road in Jefferson Parish to Belle Chasse Highway (LA 23) in Plaquemines Parish which will support the industrial growth taking place along Peters Road in Jefferson Parish, will support the expanding oil industry in lower Plaquemines Parish, will improve regional connectivity, and will reduce traffic volumes on heavily congested LA 23 in both Jefferson Parish and Plaquemines Parish; and
WHEREAS, the residents of Jefferson Parish will benefit from the efforts of these agencies working to effectuate effective and efficient regional transportation; and
WHEREAS, under the provisions of Title 23, United States Code, “Highways,” as amended, funds have been appropriated out of the Highway Trust Fund to finance improvement projects under the direct administration of the Louisiana Department of Transportation and Development (DOTD); and
WHEREAS, the Peters Road Bridge & Extension (Phase 2) (hereinafter, the PROJECT) includes the following construction: 1) approach roadways in Jefferson Parish to the Phase 3 elevated crossing over the Intracoastal Waterway, 2) the interchange with Peters Rd and Engineers Rd on the north side of the Intracoastal Waterway, and 3) two low level bridges over the Barataria Canal; and
WHEREAS, the PROJECT is part of a transportation improvements program serving to implement the area-wide transportation plan currently held valid by the metropolitan planning organization, and developed as required by section 134 of Title 23, U.S.C.; and
WHEREAS, JEFFERSON, the RPC, PLAQUEMINES, and the LA DOTD are agreeable to the implementation of the PROJECT in which the cost of acquiring right-of-way for the PROJECT in Jefferson Parish will be a joint participation between JEFFERSON and the Federal Highway Administration (FHWA), with the entity contributing the 20% match of the participating acquisition costs, currently estimated at $2,139,488.00, and the FHWA contributing, through the LA DOTD and the RPC, the remaining 80% at the time of FHWA authorization; and
WHEREAS, the responsibility and associated costs for the Environmental Process, for Pre-construction Engineering, for Permits, for obtaining Utility Clearance/Permits, and for Compensable Utility Relocation shall be borne by PLAQUEMINES; and
WHEREAS, the responsibility and associated costs for Construction Engineering, for Construction Testing, for Construction Inspection, and for Construction will be determined at a later date.
NOW, THEREFORE, BE IT RESOLVED by the Jefferson Parish Council, the governing authority of said Parish:
SECTION 1. That the Jefferson Parish Council does hereby authorize the execution of a Parish/State Agreement with the State of Louisiana, Department of Transportation and Development and with the Regional Planning Commission for Jefferson, Orleans, Plaquemines, St. Bernard, St. Tammany, and Tangipahoa Parishes for Peters Road Bridge & Extension (Phase 2), State Project No. H.008068, Federal Aid Project No. H008068, Public Works Project No. 2003-017-RB.
SECTION 2. That upon FHWA authorization, costs associated with this Parish/State Agreement are to be charged to Account No. 44500-4070-7710(45014.007), with eighty percent (80%) of the participating construction costs (Estimated at $1,711,590.00) to be reimbursed by the FHWA, and the remaining twenty percent (20%) of the participating costs (Estimated at $427,898.00) to be paid by Jefferson Parish.
SECTION 3. That the Chairman of the Jefferson Parish Council, or in his absence the Vice Chairman, be and is authorized to execute any and all documents necessary to give full force and effect to this resolution.
