TERMS AND CONDITIONS OF CASUAL RESIDENCE 2016
LICENSE AGREEMENT
IMPORTANT
This agreement contains the terms and obligations of your residency. It sets out the promises made by the Licensor to the Licensee and by the Licensee to the Licensor. These promises will be legally binding once the Agreement has been signed by both parties and then dated. You should read it carefully to ensure it contains everything you want and nothing that you are not prepared to agree to. Whilst every attempt has been made to compose this agreement using plain and intelligible language, it inevitably contains some legal terms or references.
Note for Licensee’s
This License agreement is a legal and binding contract whereby the Licensee is responsible for payment of the rent for the entire agreed term. There is no provision within this agreement to terminate the tenancy early.
If either party does not understand this agreement, or anything in it, it is strongly suggested you ask for an explanation before signing it. You might consider consulting a Solicitor, Citizens Advice Bureau or Housing Advice Centre.
CASUAL RESIDENCE LICENSE FOR OCCUPATION
This Licence is granted on the date first before written by the Licensor to the Licensee on the terms set out in the Casual Residence Particulars and below.
WHEREAS the Licensee wishes to take a short term licence of the Room (as below defined) for the period mentioned in the Casual Residence Particulars.
1.Definitions
"The Building" Means Storthes Hall Student Village or Ashenhurst Student Houses, Huddersfield.
"Common Parts" means the entrance foyer, stairs, lifts, corridors, laundry, courtyard, common room and any other areas within the Building provided for the benefit of all Licensees generally;
"Contents" means the furnishings and effects to be found in the Room, the Apartment or the Common Parts and as listed in the Inventory to be provided to the Licensee on moving-in to the Room;
"Apartment" means the apartment of which the Room forms part;
"The Room" includes the fixtures and fittings therein, the carpets, doors and internal glass that excludes service media within the Room;
"Service Media" means central heating and hot water systems; electrical services for power and lighting; drainage and water services; and any data or phone services provided;
"Casual Residence Particulars" means the particulars set out on the first page of this licence;
“Inventory” means the list of contents of the Room and the Apartment provided to the Licensee on the Start Date of the Casual Residency period of occupation.
Any reference to either one gender includes the other and any reference in the singular shall include the plural, if appropriate.
2.Declaration
This agreement is not intended to confer exclusive possession of the Room upon the Licensee nor to create the relationship of landlord and tenant between the parties and the Licensee shall not be entitled to an assured tenancy or a statutory periodic tenancy under the Housing Act 1988 or to any other statutory security of tenure now or upon the determination of the licence.
3.Agreement
3.1The Licensee is permitted to occupy the Room for the period specified in the Casual Residence notification as temporary residential accommodation and the Room shall not become the only or principal home of the Licensee. Only the Licensee shall be permitted to occupy the Room.
3.2The Room is not to be used for any business or trade purpose, nor for any illegal or immoral activities and no sale by auction or otherwise is to be carried on in the Room.
3.3 Throughout the Licensee's occupation of the Room or any other room to which the Licensee may be relocated by the Licensor, he shall maintain the Room and the Contents in the Room in at least as good repair and decorative order and clean condition as the Room and the Contents in the Room are in on the Start Date of the period of Casual Residence by the Licensee, except for fair wear and tear (and the Inventory provided to the Licensee on moving in to the Room and the Apartment shall be evidence of the Room and the Contents of the Room existing condition, and any defect shall be noted in such inventory) in accordance with Clause 3.6.
3.3.1Failure to do maintain the Room and the Contents of the Room will render the Licensee liable to pay a fair and reasonable proportion determined by the Licensor of the costs incurred by the Licensor in making good damage to the Apartment and/or the Room.
3.4The Licensee will promptly notify the Licensor of any damage or defect in the Room and/or the contents and/or the Apartment and/or the Building.
3.5The Licensee will operate in accordance with the manufacturer’s instructions and not change damage, alter or interfere in any way with the service media and electrical appliances within the Apartment.
3.6The Licensee shall accept the Room, the Apartment, the Common Parts and the Building as being in good repair and condition as at the Casual Residence Start Date unless the Licensee informs the Licensor in writing of any defects in the condition and repair within 48 hours of the Start Date.
3.6.1 The Licensee shall accept that all the Contents are present in the Room or the Apartment unless the Licensee informs the Licensor in writing that items are missing from the Inventory within 48 hours of the Casual Residence Start Date.
3.7The Licensee will pay a fair and reasonable proportion determined by the Licensor of the costs incurred by the Licensor in making good damage to the Apartment/Room and/or in replacing any fixtures or fittings damaged therein
For the purpose of this clause:
3.7.1damage to the Room shall be deemed to have been caused by the Licensee of the Room
3.7.2damage to the shared facilities in the Apartment shall be deemed to have been caused by all the Licensees for the time being of the Apartment
3.7.3damage to the Common Parts shall be deemed to have been caused by all those Licensees for the time being who generally use the Common Parts in question
3.7.4In the absence of any evidence to the contrary, the cost of remedying any such damage shall be apportioned accordingly.
3.8The Licensee will reimburse the Licensor any taxes charges duties outgoings or assessments which are now or may at any time in the future be payable in respect of the Room by reason of the Licensee’s activities (including but not limited to television licence fees).
3.9The Licensee will abide by the Licensor's regulations, which are set out in the Schedule hereto.
3.10On the last day of occupation of the Room the Licensee must vacate the Room by 12pm unless he has previously arranged with the Licensor to leave at a later time. An additional fee may be payable by the Licensee for late departure. All keys must be returned to the Licensor at the time of departure or the cost of replacing locks will be payable by the Licensee.
3.11 If the Licensee fails to remove any of his belongings from the Room at the end of his period of occupation the Licensor shall be under no duty of care towards the same and may dispose of or destroy them without any liability whatsoever to the Licensee. Any storage charges incurred by the Licensor in respect of such goods will be due to the Licensor as a debt from the Licensee.
3.12The Licensor shall not be liable to the Licensee for any failure in or interruption of service media to the Room.
3.13The Licensor accepts no liability for loss or damage to the Licensee's personal property or to articles of value save where this arises as a result of the Licensor's negligence. The Licensee is advised to ensure that his own policy covers loss or damage to personal property during his stay.
Licensor’s Regulations Schedule
- The Licensee is not to use the Room or the Apartment or permit any guest or visitor of the Licensee in the Room or Apartment for any improper, immoral or illegal purpose nor in any way which may, in the reasonable opinion of the Licensor, be a nuisance, damage or annoyance to the Licensor or to the other Licensees/ Licensors of the Building or any adjoining premises and in particular, each Licensee will:
1.1not cause any noise which, if made within the Room, can be heard outside the Room or, if made within the Common Parts of the Apartment, can be heard outside those Common Parts;
1.2not keep or use drugs, the possession or use of which is prohibited by statute (including but not limited to the Misuse of Drugs Act 1971);
1.3not harass, threaten or assault any other Licensees of the Building or their guests or any personnel of the Licensor or any other person;
1.4not to prop, wedge, block or fix in place any Fire Door of the Apartment, Room, Common Parts and Building.
1.5not keep, store or use in the Building any gas or oil heater or other fuel burning appliance, including candles, incense sticks or deep fat fryers
1.6not bring shopping trolleys, road signs, or any other article into the Building which is not needed for normal residential occupation;
1.7not to use or smoke, or allow others to use or smoke, cigarettes or any other form of tobacco in the Apartment or the Common Parts; and
1.8not allow any guest or visitor of the Licensee to be in the Room, the Apartment or the Building without being accompanied by the Licensee at all times
2Not damage or leave in a dirty or untidy state any parts of the Building
2.1Not alter, modify, decorate, add to or in any way interfere with the structure of the Room, the Apartment, the Contents, the Common Parts or the Building.
2.2Not block, or put damaging substances into, the sinks, baths, lavatories, cisterns or pipes in the Room, the Apartment, or the Common Parts.
2.3Not change any of the locks of the Room, Apartment or Common Parts
2.4Not park any vehicle on any Common Parts, approaches or private roads belonging to the Building, unless arranged with the Licensor.
3Not carry on any profession, trade or business whatsoever in the Room or the Apartment
3.1The address of the Room is not to be used for the issue of circulars or business announcements or business purposes of any type nor to disturb or invade the privacy of other occupiers at the Building.
4The Licensee agrees not to use or play any electrical or musical instrument of any kind or practise any singing in the Room such as to cause annoyance to nearby Licensees or occupiers or to be audible outside the Room between the hours of 10pm and 9am.
5Not to hang, suspend or dry clothes or fabrics out of the windows or doors or on or directly in front of the panel heaters of the Apartment, the Room, the Common Parts and Building.
6Ensure that any refuse is deposited in the receptacles provided for that purpose across the site. Under no circumstance is refuse to accumulate within the Apartment, the Room, the Common Parts and the Building.
7The Licensee is not to erect any external wireless or television aerial or satellite dish.
8The Licensee is not to keep any animal, bird, insect or reptile in the Room or the Apartment or Common Parts.
9The Licensee is not to obstruct any means of access within the Building; no bicycles, luggage or other goods or refuse to be left in or upon the corridors, staircases, entrance halls or any other part of the Building.
This License agreement is specific to the rental rates and the periodicity as set out below. The full charge stated below for accommodation entitles you to residency during the length of the License Agreement.
By signing this License Agreement for casual residency; you are agreeing to be bound by its term for a room at Storthes Hall Student Village or Ashenhurst Student Houses, Huddersfield.
This agreement confirms you do have ‘A Room’ reserved at Storthes Hall Student Village or Ashenhurst Student Houses, Huddersfield. You shall not be entitled to terminate this agreement which shall in any event end on the tenancy end date detailed below. You undertake to remain in occupation of the allocated room throughout the said periodicity and make all payments required
