ATTENTION ALL UNDERGROUND STORAGE TANK (UST) OWNER’S/OPERATOR”S
All owner’s/operator’s of any regulated underground storage tank (UST) with a capacity of over 2,000 gallons used to store heating oil for onsite consumption in a non residential building. If your regulated facility has received and is currently operating under a conditional 5-year extension to the December 22, 1998 UST upgrade requirements granted in accordance with P.L. 1998, c.59 please be advised as follows:
Regardless of the date your facility’s tank and piping tightness testing was conducted between January 1, 1998 and August 31, 1999, if the tank system(s) are currently in use they MUST be re-tested once every 36 months thereafter, beginning 36 months from the date of the initial test(s).
If the results of said testing indicate a suspected release (failed or indeterminate results) a 7-day suspected release investigation must be conducted in accordance with N.J.A.D. 7:14B-7 in order to confirm or disprove a release. If the results of the tank and piping tightness testing or the 7-day investigation confirmed a release the NJDEP Environmental Hotline at (609) 292-7172 must be immediately contacted and an incident number assigned by the Department.
If the results of the 7-day investigation are inconclusive, a Site Investigation (SI) must be conducted in accordance with N.J.A.C. 7:26E-3.3 and submitted to the Department within 60 days. Within 120 days of reporting a confirmed release a Remedial Investigation Report must be submitted to the Department.
A NJDEP Underground Storage Tank (UST) and Piping Tightness Testing Results Certification (available for downloading on the Department’s web site or by calling 609/ 633-0716) must be completed and signed by the UST Owner/Operator and the Certified Tank Testing Contractor performing the underground storage tank testing. The actual tank and piping test results must be attached to the certification. Also, please remember to enclose the report of the required 7-day investigation for any failed or indeterminate UST and Piping Tightness Test Results.
The NJDEP Underground Storage Tank (UST) and Piping Tightness Testing Results Certification, the actual testing results, and the report from any 7-day investigation for any failed or indeterminate underground storage tank and piping tightness testing results shall be submitted to the NJDEP at the address noted below:

Not later than December 22, 2003, all regulated facilities operating under a heating oil extension must upgrade their existing substandard UST system(s) to meet current standards for the construction, installation, and operation of new and existing underground storage tanks, including monitoring, release detection, corrosion protection spill prevention and overfill protection. Alternately, a facility must close its existing substandard system(s) and replace it/them with a new system or systems that meet standards, or permanently close all substandard systems.
