MINUTES OF THE WARREN TOWNSHIP COMMITTEE

NOVEMBER 19, 2009

REGULAR MEETING

The Township Committee of the Township of Warren, County of Somerset, State of New Jersey, convened in Public Session on Thursday, November 19, 2009 at 7:01 p.m. in the Susie B. Boyce Meeting Room, 44 Mountain Boulevard, Warren, New Jersey.

Mayor Garafola read the following notice:

“In compliance with the Open Public Meetings Act of New Jersey, adequate notice of this meeting was provided on January 5, 2009

by sending written notices to the Echoes Sentinel and Courier News, posting on the Bulletin Board in the Municipal Building and filing with the Township Clerk”.

“This meeting is to be taped for broadcast on the Access Channel and everyone is required to comply with the policies and procedures governing access programming for the Access Channel. No mention of political affiliation or political advertising shall take place at this meeting or it will be deleted from any rebroadcast of the meeting.”

On call of the roll, the following Committee members were present:

Mayor Garafola led all in the Pledge of Allegiance.

Mayor Garafola presented Certificates of Recognition to High School students Joan Chen, Nicole Hawkins, Jayson Lian, Christopher Pang, Victor Qi, Brendan Wu, Dennis Xuan and Annie Lang for outstanding scholastic achievement.

Mr. DiNardo introduced Ordinance No. 09-25 by title for adoption and read the following:

AN ORDINANCE OF THE TOWNSHIP OF WARREN, COUNTY OF SOMERSET, STATE OF NEW JERSEY, revisING CHAPTER XVI “ZONING” SECTION 16-4.2 ENTITLED “DEFINITION OF TERMS” BY AMENDING THE DEFINITION OF A HALF- STORY

Ms. DiRocco stated that this ordinance was referred to the Planning Board. At a meeting held on November 9, 2009, the Board determined that this ordinance is not inconsistent with any provisions of the Master Plan.

Mayor Garafola opened the public hearing on this ordinance.

A motion to carry Ordinance No. 09-25 and to continue the public hearing to the December 17, 2009 meeting at 7:00 p.m. was made by Mr. DiNardo, seconded by Mr. Salvato with a unanimous roll call vote.

On motion of Mr. Salvato, second of Mr. DiNardo, the Regular Session and Executive Session Minutes of October 8, 2009 and October 29, 2009 were approved. The roll call vote was unanimous.

The Comments on Agenda Items portion was opened. No one wished to speak and this portion was closed.

Mr. DiNardo introduced and read Resolution No. 2009-259 for the payment of bills, seconded by Mr. Salvato. The roll call vote was unanimous.

Resolution No. 2009-259 is appended to the official minutes.

Mr. DiNardo introduced Ordinance No. 09-26, by title for first reading and read the following:

BOND ORDINANCE PROVIDING AN APPROPRIATION OF$415,000FOR IMPROVEMENTS TO DOCK WATCH HOLLOW ROAD FOR AND BY THE TOWNSHIP OF WARREN IN THE COUNTY OF SOMERSET, NEW JERSEY AND, AUTHORIZING THE ISSUANCE OF $394,250 BONDS OR NOTES OF THE TOWNSHIP FOR FINANCING PART OF THE APPROPRIATION.

November 19, 2009

Ms. DiRocco stated that the Supplemental Debt Statement for this ordinance was received this date and will be forwarded to the Director of the Division of Local Government Services for endorsement.

On motion of Mr. DiNardo, second of Mr. Salvato, Ordinance No. 09-26 was passed on first reading. The roll call vote was unanimous.

On motion of Mr. Salvato, second of Mr. DiNardo, the following Consent Agenda Resolutions were approved carried by unanimous roll call vote:

2009-260 AUTHORIZING EXECUTION OF YOUTH ATHLETIC AND RECREATION FACILITY GRANT AGREEMENT BETWEEN WARREN TOWNSHIP AND SOMERSET COUNTY

2009-261 EXTENSION OF CONTRACT – PLUMBING SUBCODE THIRD PARTY INSPECTION SERVICES TO SERVICES TO EIC INSPECTION AGENCY CORP.

2009-262 APPROVAL OF THE INSERTION OF A SPECIAL ITEM OF REVENUE IN THE BUDGET RECEIVED FROM NEW JERSEY DEP - OFFICE OF RECYCLING IN THE SUM OF $11,489.17

2009-263 APPROVAL OF THE INSERTION OF A SPECIAL ITEM OF REVENUE IN THE BUDGET RECEIVED FROM SOMERSET COUNTY TO THE YOUTH ATHLETIC AND RECREATION GRANT IN THE SUM OF $15,000.

2009-264 APPROVAL OF THE INSERTION OF A SPECIAL ITEM OF REVENUE IN THE BUDGET RECEIVED FROM THE STATE OF NEW JERSEY TO THE WARREN TOWNSHIP POLICE DEPARTMENT IN THE SUM OF $2,034.90

2009-265 ESTABLISHING CONTRIBUTIONS FOR HEALTH INSURANCE COVERAGE FOR NON-UNION EMPLOYEES

2009-266 AMENDING 2009 CAPITAL BUDGET

2009-267 AUTHORIZING AMENDMENTS TO WARREN TOWNSHIP PERSONNEL POLICY

2009-268 AUTHORIZING CREATION OF A PUBLIC SAFETY RADIO SYSTEM LONG TERM PLANNING COMMITTEE

2009-269 AUTHORIZING STIPULATION OF SETTLEMENT TAX APPEAL –

141 MT. BETHEL REALTY, LLC VS. WARREN TOWNSHIP

2009-270 AUTHORIZING BUDGET TRANSFERS IN THE AMOUNT OF $65,500

Resolutions No. 2009-260 through No. 2009-270 are appended to the official minutes.

Mr. Cruz explained the issue of Wastewater Management Plan guidance on Septic Management issued by the State. The State has mandated that all septic systems will now have to be inspected. The governing body discussed. This could be a major expense to residents, especially senior citizens. A letter will be sent to the State to protest and ask other municipalities to join in a protest. A letter will also be sent to the League of Municipalities to ask for their support.

Mr. Krane spoke about improvements to the Wagner Farm barn. The foundation needs work. The governing body agreed to the hiring of a structural engineer. The barn must be locked at all times for safety.

On motion of Mr. DiNardo, second of Mayor Garafola, Paul Sedlak was appointed to the Recreation Commission as an Alternate #2 for a term to expire on 12/31/09. The roll call was as follows:

Mayor Garafola opened the Privilege of the Floor portion of the meeting.

Mr. Lakatos, Horseshoe Road, referred to an ordinance relating to the removal of animal waste on properties. Mr. Krane informed him that this applies to public property. Mr. Lakatos also commented that the Recreation survey that was mailed to the residents was not specific.

The Privilege of the Floor portion of the meeting was closed.

Mr. DiNardo introduced and read the following resolution, seconded by Mr. Salvato and carried by unanimous voice vote.

WHEREAS, the Open Public Meetings Act, P.L.1975 Chapter 231 permits the exclusion of the public from meeting in certain circumstances; and

WHEREAS, this public body is of the opinion that such circumstances presently exist; and

WHEREAS, the Governing Body wishes to discuss:

Potential property acquisition – Block 60, Lot 6

Litigation – OEM Coordinator Position

Contract Negotiations – Dispatch Services

WHEREAS, when and if the matters discussed become public record, this will be made known to the public at that time;

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Warren, that the public is excluded from this

Meeting;

FURTHER RESOLVED, that formal action may be taken upon reconvening to Public Session.

The meeting convened in Executive Session at 7:56 p.m.

The meeting reconvened to Public Session at 8:10 p.m.

On motion of Mr. DiNardo, second of Mr. Salvato, and unanimous voice vote, the meeting adjourned at 8:55 p.m.
