Workshop by Veronique Buehrlen QC, Lucy Garrett, Calum Lamont and Matthew Finn of Keating Chambers

Keating Chambers presents a workshop session concerning a main contractor involved in a module construction project which has gone wrong, leading to the need to issue injunctive relief against the owner in relation to the available HLV up the line, and proceedings down the line in relation to the subcontractor who is holding onto a further module, and insisting that it is unlawful to levy liquidated damages. To add insult to injury, there are maintenance issues with regard to a related module offshore, giving rise to all sorts of claims for consequential loss and that old favourite, loss of use.

Veronique Buehrlen QC has a wide ranging commercial litigation, international arbitration andadvisory practice with special emphasis on complex energy disputes, construction, engineeringand civil fraud.She has conducted several major commercial hearings as lead counsel including a four week Commercial Court trial for Borealis AB, in respect of severe damage sustained at its integrated olefin plant following the delivery of contaminated LPG, and a six week ICC arbitration for an internationally renowned global integratedenergy company in a dispute arising out of the construction and installation of a subsea pipeline.

Lucy Garrett has an impressive specialist practice in construction, engineering, energy and shipbuilding. She is always in demand for her forceful advocacy, practical and commercial approach and stellar intellectual ability, which has led to instructions in a series of high profile, high value disputes. She has extensive experience in the TCC and Commercial Court and international arbitration, increasingly frequently in relation to energy work. She particularly enjoys disputes involving complex technical issues. Lucy won Construction Junior of the Year in the Chambers & Partners Bar Awards 2013 and was nominated again in 2015.

Calum Lamontspecialises in construction, engineering, shipbuilding and energy disputes, together with related insurance and professional negligence matters. He has particular expertise in infrastructure and offshore matters in international arbitration (predominantly Gulf and Far East) as well as the TCC and Commercial Court. He has a busy offshore practice with extensive experience in delayed delivery claims, as well as disputes arising out of defective construction and operation of drilling vessels and rigs. He was nominated Construction Junior of the Year in the Chambers & Partners Bar Awards 2014.

Matthew Finnhas specialist expertise in the resolution of commercial disputes, with a particular focus upon disputes arising in the construction, engineering and energy industries. His practice includes work in the High Court (TCC and Commercial Court), domestic and international arbitration, and adjudication. Matthew is presently Secretary to the Tribunal in a $2bn ICC international arbitration, as well as a contributor to the most recent edition of Keating on Construction Contracts and Keating on JCT. Matthew has completed the Keble Advanced International Advocacy Course at Oxford University and is a winner of the Jonathan Brock Memorial Essay Prize, run by the London Common Law and Commercial Bar Association.
