A Special Meeting of the Marcy Town Board with Anthony Putrelo of Putrelo Construction regarding the new municipal building took place on 10/07/2004 beginning at 6:40 PM, 9455 Toby Road, Marcy, New York.

A Regular Town Board meeting was held following the Special Meeting beginning at 7:16 PM.

TOWN BOARD MEMBERS PRESENT: Supervisor Brian N. Scala; Council members:

James P. Goodman; Kathleen A. Gregory; Keith P. Schuderer. Absent: Ernest R. Murawski

OTHER TOWN OFFICIALS PRESENT: Town Clerk Francine Broccoli; Town Attorney Randal B. Caldwell; Public Works Administrator George W. Russell; Superintendent of Highways Patrick VanHatten; Zoning Board of Appeals member Carl A. Annese

Mr. Putrelo advised that Mid-State Steel was notified that the crane on the new municipal building property must be moved by Friday. If the crane is not moved, Mr. Putrelo will notify Mid-State Steel that the crane will be repaired and moved. (the motor for the boom is in need of repair) Grading is expected to begin tomorrow. Work will begin on the backside of the building first and then around to the front. The windows were delivered damaged – all is guaranteed through Mr. Putrelo, the broken parts have been ordered, Mr. Putrelo will advise when the parts will be in. Outside and inside work will be done at the same time.

Mr. Putrelo was asked how comfortable he was with the new substantial completion date (December 2004). Mr. Putrelo responded that the exterior work depends on the weather. The granite curbing has to be completed before the paving. The inside work and the outside work will be coordinated. 99% of the roofing is completed. Bracing is needed on the elevator due to the design. Steel prices are going up. Mr. Putrelo commented that 99% of the elevator shafts is masonry and the bracing is support for the vertical rails. The overhead door change order was discussed and Mr. Putrelo does not see anything in the specifications relating to the color. Specialties are bathroom accessories, signages, directories, etc. The folding partition is not delivered as yet; however, contact is made with Mr. Putrelo often (to find out if it could be delivered). Councilman Goodman noted that there is a serious trucking problem and when materials are hauled into this area there is no “back haul”. Mr. Putrelo agreed. It was agreed that the Court bench could be made off site and the Contractor could put it in. Mr. Putrelo suggested that the members of the Town Board should attend some of the job meetings. Mr. Putrelo was thanked for his attendance and wished good luck.

The Regular Town Board meeting next opened at 7:16 PM with the Pledge of Allegiance to the Flag.

Timothy Dunn relating to completion of an Agreement with Contractors. Mr. Dunn further suggested that “on a Primary and Non-contributory Basis” be added to the Town of Marcy’s Contractor’s Application and Permit. Mr. Dunn has provided this information to the Town Attorney to review.

  1. Certificate of Substantial Completion for Sanitary Sewer Contract 24B has been

signed and received.

  1. Information relating to a Minor Three (3) Lot Subdivision for Marcy Town Center

has been received and copied to the Town Board. Any response to same should be directed to Lori A. Rockwell, Secretary to the Planning Board.

  1. The following checks have been received:

---Interstate Batteries: $100.00.

---Marcy Town Court: $ 50.00 – restitution.

---CAP Scrap Metal: $568.15.

  1. The following September Departmental reports have been received:

---Town Clerk: $1,685.45 was remitted to various State/County agencies; $172.50 remitted to Marcy Sewer General; $12.50 remitted to Marcy Water General; $334.55 remitted to Supervisor; Total Disbursements: $2,205.00.

---Justice Court: Judge Buttenschon and Judge Shaw.

---Public Works Administrator: 13 building permits issued; $616.00 in fees collected.

---Sanitation: 231.4 Tons of recyclables were picked up for a total savings of $18,454.15.

  1. Election Work Survey conducted by the Town of New Hartford has been received

and copied to the Town Board.

  1. The 2005 Tentative Budget was received on 09/30/2004 and copied to the Town

Board and various department heads.

  1. Third Quarter report update for SUNY-IT West Campus site has been received from

Mohawk Valley EDGE President Steven J. DiMeo and copied to the Town Council.

  1. The Mohawk Valley Water Authority hosted a Terrorism Seminar which emphasized

the need for vigilance from the general public. This information was included within the water

bills sent out by MVWA. Suspicious activities include: Dumping or discharging material into the reservoir; Anyone climbing or cutting a utility fence; Any unidentified or unmarked vehicle parked on or near water facilities; Suspicious opening or tampering with manhole covers, buildings or equipment; Anyone seen climbing a water tank; Anyone photographing/videotaping utility facilities, water towers or equipment; Strangers loitering at MVWA facilities; Vehicles other than a fire truck hooked up to a fire hydrant.

  1. County Legislator Richard A. Flisnik has provided information relating to County activities.

Said information has been provided to the Town Board. A CD entitled ROME Research Site was also provided. Anyone wishing to view this information should contact the Town Clerk.

PUBLIC COMMENT: Highway Employee Robert Williams inquired if radiant heat had been considered for the new municipal building; and, why an asphalt roofing was used. Supervisor Scala commented that radiant heat was considered but Fuligni-Fragola explained that additional lines would need to be used, the cost of radiant heat, etc. The roofing is based on a 25 to 30 year guarantee. Mr. Williams commented that radiant heat might be more of a cost to put in but better afterwards. It was explained that there are two furnaces plus one boiler in the basement. Any discussion on the metal roof was not brought up. Mr. Williams also mentioned the work completed on the trees, the mulch spread, the buildings painted, etc. within the Toby Road Park.

Zoning Board of Appeals member Carl A. Annese reported upon the last Zoning Board of Appeals meeting.

Councilman Goodman commented that Fuligni-Fragola was not in attendance at tonight’s discussion relating to the new municipal building, that the Town is paying for their service, and the Town Board should advise them to attend. Public Works Administrator Russell commented that he had contacted Mr. Bonacci after the last meeting and then was advised on October 5th that they could not attend tonight’s meeting. It was suggested to contact Mr. Bonacci and Mr. Putrello and request their attendance at a Special Meeting which will be called for next Thursday. Mr. Russell will contact them tomorrow morning. It was the consensus of the Town Board to have a Special Meeting on 10/14/2004 beginning at 7:00 PM with Mr. Bonacci and Mr. Putrelo, at 7:30 PM with members of the Planning Board and the Zoning Board of Appeals, and then to discuss the 2005 Budget afterwards.

Councilman Goodman brought forth that the Town Board needs direction regarding the Court Bench and the counter top for the Town Clerk’s office. It was suggested that the Town Clerk, Public Works Administrator and Mr. Putrelo meet to discuss the counter top. Mr. Russell will contact Mr. Lafferty to request pictures to show the Court. Councilwoman Gregory commented that she is not comfortable with the design of the Bench.

Councilwoman Gregory brought forth that the lease is up on the copier machine in December and the Town Board should consider continuance of leasing or purchasing. Supervisor Scala commented that he will be sending a letter to Upstate Office Equipment. Councilwoman Gregory advised that the life expectancy for a copier is 4 years; a service contract would also be needed. Supervisor Scala commented that specifications should be drawn. Councilwoman Gregory will check into this.

There next was discussion on a faucet dripping in the Pool building and in the outside area. According to Highway Superintendent VanHatten, the Pool has not as yet been winterized and the water outside is rain accumulation.

The Highway Superintendent has contacted the Fishlane resident (culvert issue).

Councilman Schuderer inquired if there is a need for a computer specialist and mentioned hooking up the equipment. (for new municipal building) The Town Clerk will contact Robert’s Interiors and request that Mr. Spaziani attend the October 21st Town Board meeting to update the Board. (Mr. Spaziani will be out of state during that week.)

Zoning Codes Officer Russell will be updating the sewer map.

Town Attorney Caldwell provided a draft of a Local Law regarding residency of Highway employees and requested that the Town Board provide their comments concerning same.

Public Works Administrator Russell advised that he had met with Fox Road property owners Mr. and Mrs. Meyer and they agreed to sell a small piece of land with conditions (pump station site).

Easements are ready to be filed for Church Road. Leitz needs to be contacted.

Mr. Bouchard purchased the Cavanaugh Road Schremmer property. No deed will be given for ninety days. Town Attorney Caldwell advised that the cellar will be filled in and lawn planted

Supervisor Scala inquired why there cannot be an Agreement with the purchasers and the County since the County has a procedure to remove the building. Town Attorney Caldwell will check if the procedure can be accelerated.

Mr. Russell advised that the sewer line will be replaced by New York State at a cost of over one million dollars. (north side of River Road & State Rte. 49 by Harbor Collision)

Councilwoman Gregory inquired what the topics will be when the Town Board meets with the Planning Board and the Zoning Board of Appeals. Supervisor Scala commented that there are communication concerns and Town Attorney Caldwell commented that some applicants come to the office of the Town Attorney and request review of something. Town Attorney Caldwell noted that he represents the Town and the Town Board. Councilwoman Gregory commented that the Town Board is a separate entity from the Zoning Board of Appeals. It was agreed that there would be only discussion.
