RESOLUTION OF THE BOARD OF SUPERVISORS OF

ORANGE COUNTY, CALIFORNIA

July 12, 2016

WHEREAS, on March 10, 2015, this Board adopted Resolution No. 15-017, Item No. 24 that established the OC Public Works Development Services fee schedule for the number of services provided by OC Public Works in processing applications for the utilization and development of property in the County; and

WHEREAS, that OC Public Works Development Services fee schedule states fee waivers may be granted by the County of Orange Board of Supervisors by resolution; and

WHEREAS, the County of Orange and Orange County Flood Control District intend to enter into that certain Cooperative Agreement D15-013 with the City of Santa Ana, City of Newport Beach, City of Costa Mesa, Orange County Water District and the Irvine Ranch Water District for the design, construction, operation and maintenance of a regional watershed project to divert dry-weather urban discharge flows and trash from the Santa Ana-Delhi Diversion Channel, Facility No. F01, (Channel) to satisfy water quality compliance requirements; and

WHEREAS, implementation of the Project pursuant to the terms of the proposed Cooperative Agreement D15-013 will entail issuance of permits from the County of Orange and Orange County Flood Control District for that work on County-land or impacting the Channel; and

WHEREAS, all parties to Cooperative Agreement D15-013 in addition to certain commitments to funding the Project, agree to not charge permit fees or for the utilization of their right-of-way for purposes of the Project in order to reduce Project; and

WHEREAS, the County of Orange and Orange County Flood Control District in compliance with the terms of said Cooperative Agreement D15-013 requests that this Board grant a fee waiver from OC Public Works Development Services fees or other fee schedules for permits processed and issued by the County and/or District related to Project construction work.

NOW, THEREFORE, BE IT RESOLVED that this Board does hereby:

1.  Authorize the OC Public Works Director, or designee, on behalf of the County of Orange and/or the Orange County Flood Control District, to waive fees for permits in furtherance of construction work for the Project which is the subject of Cooperative Agreement D15-013 dated ______; specifically fees identified in the OC Public Works Development Services fee schedule established by Resolution No. 15-017, Item No. 24 adopted March 10, 2015.

2.  Authorize the Director of John Wayne Airport, or designee, on behalf of the County of Orange and/or the Orange County Flood Control District, to waive fees for permits in furtherance of construction work for the Project which is the subject of Cooperative Agreement D15-013 dated ______;

3.  Authorize the Auditor-Controller to allocate expenses and charges as directed by either OC Public Works Director or the Director of John Wayne Airport, or their respective designee, to implement the fee waiver authority adopted by this Resolution and that Cooperative Agreement D15-013 dated ______;
