Complaint form:

You are limited to 45 minutes before the form resets, so do your composing off-line in a word processor and copy and paste into the on-line form. You are also limited to 4,000CHARACTERS, not words, so be sure you do not go over.

File a separate complaint for each Smart Meter affecting you: for example, if there is a water, electric, and/or gas Smart Meter, each one requires a separate complaint. (I have water meters installed by the city and electric meters installed by the electric company, so I had to file two complaints.) File even if you have opted out, but are being sickened by your neighbors’ meters.

Be sure to mention any effect on people who live with you, such as they are stressed due to your illness, they have to take care of you because the RF makes you incapable, etc.

If you have a letter from your doctor, be sure to state that in the complaint.

HUD will contact you to ask for supporting documents: physician’s letter of accommodation, letters you sent to the utility, letters you received from the utility, etc. Be sure you have scanned copies you can send via email.

U.S. CONSUMER PRODUCT SAFETY COMMISSION

Complaint form:

Download and print out the form. Where it says: “I am reporting:” be sure to check both “A hazardous incident” and “A safety concern.” Write in the box that you’re attaching a letter, your doctor’s letter and supporting documents. I sent Section 24 of the BioInitiative Report, the two AAEM position papers, an article about a neurosurgeon’s deep concern over the leaking BBB, Norbert Hankin’s letter and Dr. De-Kun Li’s letter.

When asked about the product, state you’re filing about ALL Smart Meters, and that there are a number of manufacturers, such as G.E., Landis + Gyr, Itron, etc. Clearly state that ALL of them need to be removed from the market. Where it asks about number of victims, you can write off to the side that there are thousands and thousands of victims all over the country.

Complaint Form:

File one complaint for each electric, water and/or gas Smart Meter. You must file on-line. Be sure to save a copy for your records.

Explain the harm done to you and to the environment, if you’ve noticed changes. Where I am the honey bees are gone now, bird species and numbers have steeply declined, all the snakes are gone, etc.

This notice will be the only response you will receive regarding your submission. Due to the sensitive manner in which enforcement information must be managed by EPA, we can not provide status reports or updates regarding any submission we receive through the Report an Environmental Violation form.

PLEASE NOTE: An individual is considered to have a "disability" if s/he has a physical or mental impairment that substantially limits one or more major life activities, has a record of such an impairment, or is regarded as having such an impairment.

The ADA applies to persons who have impairments and that these must substantially limit major life activities such as seeing, hearing, speaking, walking, breathing, performing manual tasks, learning, caring for oneself, and working. An individual with epilepsy, paralysis, HIV infection, AIDS, a substantial hearing or visual impairment, mental retardation, or a specific learning disability is covered, but an individual with a minor, nonchronic condition of short duration, such as a sprain, broken limb, or the flu, generally would not be covered.

Applicable Law for Investor-Owned Utilities Attempting to Charge Opt-Out Fees:

§ 36.301 Eligibility criteria.

(c) Charges

A public accommodation may not impose a surcharge on a particular individual with

a disability or any group of individuals with disabilities to cover the costs of measures, such as the provision of auxiliary aids, barrier removal, alternatives to barrier removal, and reasonable modifications in policies, practices, or procedures, that are required to provide that individual or group with the nondiscriminatory treatment required by the Act or this part.

§ 36.302 Modifications in policies, practices, or procedures.

(a) General.

A public accommodation shall make reasonable modifications in policies, practices, or

procedures, when the modifications are necessary to afford goods, services, facilities, privileges, advantages, or accommodations to individuals with disabilities, unless the public accommodation can demonstrate that making the modifications would fundamentally alter the nature of the goods, services, facilities, privileges, advantages, or accommodations.

*** Note: You can file a complaint even if you have not yet been charged an opt-out fee, so long as the utility has stated they are going to charge one.***

Complaint Procedure:

You can also file separate complaints against entities, such as the utility itself, for refusal to remove surrounding Smart Meters when your physician’s letter required a zone of safety around your home and the utility has refused to accommodate you.

Applicable Law for Government-Owned Utilities Attempting to Charge Opt-Out Fees:

§ 35.130 General prohibitions against discrimination

(f) A public entity may not place a surcharge on a particular individual with a disability or any group of individuals with disabilities to cover the costs of measures, such as the provision of auxiliary aids or program accessibility, that are required to provide that individual or group with the nondiscriminatory treatment required by the Act or this part.

Complaint Form:

Print the form out, fill it out, include copies any relevant documents, such as your physician’s letter of accommodation, letters you wrote to the utility, letters they wrote to you, etc. and mail them all to the address at the bottom of the complaint form.

GENERAL INFO CONCERNING USDOJ COMPLAINTS

PLEASE NOTE: You do NOT have to wait until the fee shows up on your bill to file an opt-out fee complaint, so long as the entity has stated that they will be charging a fee.

You may also use these same forms to file complaints concerning denial of accommodation.
