Southern Teller County Focus Group, CCV Gold Mining Company El Paso Gold Mining Company

For the purpose of this release, Southern Teller County Focus Group (STCFG), Cripple Creek & Victor Gold Mining Company (CCV) and El Paso Gold Mining Company (EPGMC) shall be deemed to include STCFG, CV and EPGMC, its officers, directors, agents, and representatives. The undersigned is hereby granted permission to enter property owned and /or controlled by EPGMC as part of a STCFG sponsored tour, subject to the following terms and conditions:

You agree to release STCFG, CCV & EPGMCfrom and against any and all claims you may have for injuries or death or damage or destruction to you or your personal property that arises out of your presence on STCFG ‘s tour of EPGMC owned property, except for such injuries or death, damage or destruction that arises out of the gross negligence or willful misconduct of STCFG, CCV or EPGMC.

You further agree to indemnify, defend and hold STCFG, CCV & EPGMC harmless from and against any and all costs, losses, causes of action and damages, including, without limitation, environmental damages, cleanup costs, attorney's fees and litigation costs, that arise out of or are related to your presence on third-party’s property and are not the result of the gross negligence or willful misconduct of STCFG, CCV & EPGMC.

You shall follow all of the rules, warnings, and regulations of STCFG, CCVEPGMC with respect to your presence and/or activities on the tour of the third-party owned property.

The permission herein granted to you is personal and is not transferable to any other person or entity.

The permission granted herein may be revoked at any time by STCFG, CCV or EPGMC, in its sole discretion, upon verbal notice to you. Upon such revocation, you shall immediately leave STCFG’s tour and EPGMC-owned property.

There may be other conditions established by STCFG, CCVEPGMC provided to you verbally or in writing that apply to the permission that is granted herein and such other conditions shall be deemed to be a part hereof.

By signing below, I certify that:

  1. I have agreed to participate in the STCFG tour and have paid the required fee for such tour.
  2. I have read and understand the Standard Notice provided above.
  3. I also sign and agree to the above on behalf of any children under the age of 18.
