REGULAR MEETING

MARCH 25, 2014

The City Council for the City of Palm Valley met in Regular Session on the 25th day of March2014 at 5:00 p.m., 1313 N. Stuart Place Road, Palm Valley, Texas. The meeting was attended by the following persons:

1) CALL TO ORDER

Mayor Cutney called the meeting to order at 5:00 p.m.

3) PUBLIC COMMENTS

None

4)PRESENTATION BY JEFF POKORNY, PRESIDENT OF TRI TECHNOLOGIES, REGARDING AN ASPHALT REJUVENATOR/SEALER PRODUCT

Jeff Pokorny presented a power point presentation introducing WD-2000, Asphalt Rejuvenator/Sealer. He explained the oxidation of asphalt and that the effects of the air, sunlight and water increase the destructive process and over time the asphalt begins to fade in color and show cracking. Subsequent repairs are inevitable and costly. He explained that a low-cost method of maintaining asphalt pavement’s flexibility and integrity is with a Rejuvenator/Sealer. His product, WD-2000, penetrates deep into the asphalt binder and restores needed oils to achieve chemical balance, while sealing the surface to prevent future oxidation, thereby, extending the roadway’s life by years.

Mr. Pokorny added that WD-2000 is a state-of-the-art product that penetrates the asphalt binder and restores flexibility and plasticity while bringing back that black ‘new asphalt’ appearance.

He indicated that his product is backed by a Four-Year Performance Warranty and 33 billion yards of pavement have been restored and protected using asphalt rejuvenation across North America, South America, Europe and Asia.

Mr. Pokorny stated that this asphalt rejuvenators/sealer have been tested and proven in the United States by the FAA and independent testing labs for over 40 years. The tests reflect that the product reverses the age of the asphalt by lowering the viscosity of the oil in the pavement and by increasing the flexibility of the pavement for years.

5) DISCUSSION REGARDING A STREET IMPROVEMENT PROJECT IN THE CITY OF PALMVALLEY

Mayor Cutney explained that there was an original estimate from David Flinn to entirely re-do the streets at an approximate cost of $6.2 million in 2012. He stated that to do 7.5 miles of streets in PalmValley would run about $200,000 with the rejuvenator.

Mr. Pokorny explained that cleaning out and traffic control to undertake this project would be done in-house. They would then come in and apply the product, Monday through Friday and the work would be completed in 10 days and, yes, it would come under $200,000 for this size job.

Minor discussion followed on the crack sealing and Mr. Pokorny stated that they would not do the crack sealing for different reasons. He explained that the objective is to put the oils back into the asphalt. From an aesthetics view point, the cracks will not show when the rejuvenator is applied. The product penetrates immediately on asphalt that is 1-2 years old such as on Papaya Circle.

Mr. Pokorny added that there would be about a $30,000 savings by using in-house staff for certain aspects of this project.

6)MINUTES OF NOVEMBER 13, 2013 AND FEBRUARY 18, 2014 APPROVED

Both sets were approved without any corrections upon a motion made by Councilman Jones and a second by Councilman Widger.

Mayor Cutney took the votes and the motion carried unanimously by those present.

7)CITY SECRETARY’S CERTIFICATION OF UNOPPOSED CANDIDATES FOR THE CITY GENERAL ELECTION ORIGINALLY ORDERED FOR MAY 10, 2014 ACCEPTED

The City Secretary explained that before the election can be cancelled the City Secretary must present a certification that there were no unopposed candidates to those who filed for a place on the ballot.

Councilman Werley made a motion to accept the City Secretary’s certification.

Councilwoman Martin seconded the motion.

Mayor Cutney took the votes and the motion carried unanimously by those present.

8)ORDINANCE ADOPTED CANCELLING THE CITY GENERAL ELECTION FOR MAY 10, 2014 AND DECLARING EACH UNOPPOSED CANDIDATE ELECTED TO OFFICE

The City Secretary explained that there were no opponents to the two candidates who filed for office, thus, the City is in a position to cancel the election originally scheduled for May 10, 2014.

She noted that the two incumbents who filed for office were:

John Widger

Deborah Owens Wright

These two candidates will be sworn into office according to the election calendar in May.

Councilwoman Martin made a motion to adopt the ordinance cancelling the election.

Councilman Jones seconded the motion.

Mayor Cutney took the votes and the motion carried unanimously by those present.

9)PROPOSAL FOR ENVIRONMENTAL SERVICES SUBMITTED BY PROFESSIONAL SERVICE INDUSTRIES, INC. (PSI) APPROVED

Mayor Cutney explained this is an annual contract. The cost ($4,130) for this contract is a budgeted item in the Water Department.

Councilman Jones made a motion to approve the contract.

Councilman Widger seconded the motion.

Mayor Cutney took the votes and the motion carried unanimously by those present.

10) CONSENT AGENDA

Councilman Werley made a motion to approve the consent agenda.

Councilman Jones seconded the motion.

Mayor Cutney took the votes and the motion carried unanimously by those present.

11) INVESTMENT OPTIONS FOR CERTIFICATE OF DEPOSIT NO. 3612114

Mayor Cutney explained the situation that occurred with this CD at Compass Bank and explained that the bank had originally offered 1.25% interest rate on this CD but then backed out when they realized it was a municipal CD and not a personal consumer CD. This CD has been renewed on a month to month basis to allow staff to shop around for better interest rates. Currently, CDs are not offering very high rates.

Councilman Werley commented that the city could invest in a money market savings account and when interest rates go up, they are automatic and there are no penalties for withdrawals.

Councilman Werley made a motion to authorize staff to investigate investing this CD in a money market savings account, backed by FDIC that would be easily accessible without any penalties.

Councilman Jones seconded the motion.

Mayor Cutney took the votes and the motion carried unanimously by those present.

12) ADJOURN

There being no further business the meeting adjourned at 6:01 p.m. upon a motion by Councilman Jones and a second by Councilwoman Martin.
