CRC[1] Guest Researcher Fees Agreement

Preamble
The Contractor is an invited guest researcher at the CRC .
During his or her stay in Bielefeld, he or she, as a researcher being independent from the Principal, shall contribute his or her scientific/humanistic skills to the work of the CRC. For creation of the required legal conditions thereof, the parties agree as follows:
§ 1
The stay of the Contractor at the CRC is planned for the period from to . During this period, the Contractor will work independently in CRC-relevant or CRC-associated areas and issues in coordination with the representative of the CRC, and will actively participate in the scientific/humanistic business of the CRC.
§ 2
The Contractor shall receive a renumeration due after the performance owed (by the contractor) has been rendered. The amount of the renumeration depends in consideration of the scientific/humanistic skills of the contractor. This fee shall cover all expenses incurred by the Contractor in connection with the stay. The renumeration amounts toEUR .

§ 3
Taxation of the fee is incumbent on the Contractor. The Contractor is aware that the Principal is obliged to notify the financial authorities of payments pursuant to the conditions of the Federal Government’s statutory instrument (Verordnung) of 23December 2003.
Regarding his or her status as an independent guest researcher, the Contractor shall be responsible administering his or her own interest regarding insurance matters and shall indemnify the Principal from liability for the Contractor’s conduct. In view of the currently unclear legal status regarding the law on “corrections in social insurance” (Gesetz zu den Korrekturen in der Sozialversicherung), the parties agree that the Contractor shall be obliged to pay his or her own share, if the Agreement is or should be come subject to social insurance contributions.
§ 4
The Contractor is subject to the Principal’s regulatory and safety provisions. He or she is obliged to treat the Principal’s processes and documents becoming known to him or her within the context of this Agreement with confidentially.
§ 5
It is confirmed that:
1. the Contractor is not an employee of the University of Bielefeld:yes no
2. the conclusion of the Agreement is not effected subsequent to a fixed-term employment: yes no
3. the Agreement does not constitute or continue a social relationship of dependence:yes no
If any one of the point cannot be answered with “yes”, no binding agreement for the University of Bielefeld can be effected. In this case, payment of the fee from budget funds, i.e. also from third party funds is inadmissible; the project management is exposed to the risk of being liable itself.
§ 6
The Agreement shall take effect upon signing and is limited for the intended period of the stay. The Agreement can only be terminated for good cause and with two week’s notice taking effect at the end of the month. Amendments and supplements to this Agreement shall be made in writing in order to be effective.

The Principal bears responsibility that the service ordered within the scope of the fees agreement will properly and completely be rendered.
