The State Properties Review Board held its regularly scheduled meeting on February 4, 2010 in the State Office Building.

Chairman Greenberg called the meeting to order.
Mr. Josephy moved and Mr. Norman seconded a motion to enter into Open Session. The motion passed unanimously.
OPEN SESSION
ACCEPTANCE OF MINUTES OF JANUARY 29, 2010. Mr. Cramer moved and Mr. Norman seconded a motion to accept the minutes of January 29, 2010. The motion passed unanimously.
COMMUNICATIONS
Reimbursement of Expenses. Mr. Cramer moved and Mr. Norman seconded a motion to approve reimbursement of meeting and mileage fees to Mr. Greenberg for his inspection of property in Norwalk on February 2, 2010 (PRB File #10-021). The motion passed unanimously.

Ms. Goodhouse reported that the Department of Transportation (DOT) acquired and is now releasing 113+/- sq. ft. and 5,296+/- sq. ft. of vacant land, which is the same as originally acquired for intersectional improvements on U.S. Route 5, also called Enfield Street, Enfield. This is a release along a town road to the town for town highway purposes only and there is no monetary consideration. The Quit-Claim deed releases the following:

Ms. Goodhouse recommended Board approval because the conveyance complies with Section 13a-80 of the Statutes governing the release of excess property by the Commissioner of Transportation, and the descriptions in the Quit-Claim Deed to release the real property to the Town of Enfield are consistent with the descriptions in the DOT acquisition deeds.

Ms. Goodhouse stated that the Department of Transportation (DOT) acquired and is now releasing the real property which is the same originally acquired for the replacement of Bridge No. 04709, pursuant to Agreement 04.29-03 (96) between the Town of Killingly and the State. The project is complete and it is now necessary to assign the land acquired to the Town. This is a release along a town road to the town for town highway purposes only and there is no monetary consideration. The Quit-Claim deed releases the following:

Item Purpose: To acquire 1,549+/- sq. ft. of land, in fee, an easement to slope consisting of
457+/- sq. ft., rights to construct driveway and concrete walk; with contributory
value for site improvements.
Mr. Greenberg commented on his inspection of property in Norwalk. The Department of Transportation (DOT) proposes to acquire land and easements for the above-referenced DOT project, including a taking area of 1,549+/- sq. ft. located along the southerly side Connecticut Avenue (Route 1) and the easterly side of Taylor Avenue; also 457+/- sq. ft. for an easement to slope.
Mr. Greenberg said that there is no severance because the takings will not affect the parking or the building, which is a diner style-restaurant of 5,284 sq.ft., built circa 1959.
The subject property is .35624 acres (15,517 square feet) with 141.42 linear feet frontage on Connecticut Avenue, all of which will be affected by the taking. Existing frontage along Taylor Avenue is 115.47 linear feet. The zone is Business (B-1).
In the Before and After appraisal analysis, and concluding a site value of $50.00 per sq. ft., the total compensation for damages is as follows:

The comparable sales presented in the appraisal prepared by DOT indicated a value range from $42.80 per sq. ft. to $55.26 per sq. ft. Mr. Greenberg said this is a heavily traveled area and a visible corner site, and that supports the DOT valuation of $50.00 per sq. ft. He recommended approval of the proposal.
