SURCHARGE
STATE TAX ADJUSTMENT SURCHARGE
In addition to the charges provided in this tariff, a surcharge of 0.051960% will apply to all charges for service rendered on or after the effective date of this tariff.
The above surcharge will be recomputed, using the same elements prescribed by the Commission.
a. Whenever any of the tax rates used in the calculation of the surcharge are changed.
b. Whenever the utility makes effective any increased or decreased rates; and
c. On March 31, 1999, and each year thereafter.
The above recalculation will be submitted to the Commission within 10 days after the occurrence of the event or date which occasions such recomputation; and, if the recomputed surcharge is less than the one then in effect, the Company will, and if the recomputed surcharge is more than the one in effect, the Company may, submit with such recomputation a tariff or supplement to reflect such recomputed surcharge, the effective date of which shall be 10 days after filing.

PART II: RULES AND REGULATIONS
Application for Service
1. Upon written application by the owner or tenant or his properly authorized agent, on forms furnished by the Water Company, for the immediate and continuous supply of water to premises abutting a public highway or a street or other location where a main of the distribution system of the Water Company is located, the Water Company will, subject to the provisions of this tariff, install the service connection and meter to such premises. The cost of the labor and materials for the installation of said service connection and meter shall be borne by the Water Company.
Service connection is hereby understood to include the corporation cock, the pipe from the corporation cock to the curb stop cock, the curb stop cock, and the curb box. The meter is understood to include, in addition to the meter, a combination shut-off and drain valve to be located immediately on the supply side of the meter.
The Water Company shall determine the size of all service connections and the size and type of meter based on the initial pressure available at the main, length of service line, and the anticipated needs of the applicant. The Water Company will repair, maintain and replace the service connection, meter, combination shut-off and drain valve as defined above, all of which are owned by the Company.
Discontinuance of Service, Allowance for Vacancy,
And Inter Period Billings
2. Any consumer may terminate his service contract with the
Water Company and have his water service discontinued, upon giving written notice thereof to the Water Company. Within a reasonable time thereafter, the Water Company will take final meter readings, shut-off the water at the curb cock, and prepare a water bill based on the water used, or a minimum bill, which ever is applicable.
No allowance for vacancy or for non-use of water will be made unless the consumer has given the Water Company written notice to discontinue service.
In case of a change of ownership or occupancy of a property, the new owner or occupant must make written application for water service as outlined under Rule I.
3. Applications may be cancelled or water service may be
discontinued by the Water Company upon giving to the applicant or consumer ten (10) days written notice thereof, for violation by applicant or consumer of any of the rules of the Water Company, or any amendment that may be thereto, or for other proper cause, and especially for any one or more of the following reasons:
A. For failure to pay water bills when due.
B. For failure to promptly repair or replace service lines or portions thereof which are the responsibility of the property owners, as defined in other parts of these rules.
C. For any tampering with any meter or seal thereof, or with any service pipe or curb cock or box, or permitting such tampering by others.
D. In the case of any metered sprinkler system connections, for the failure to promptly repair leaks in any portion of the underground or overhead systems, or for unwarranted consumption of water through a sprinkler system connection.
E. Charge for turn-on of service following the turn-off for nonpayment will be the actual cost of rendering the service.
Multiple Meters for One Premise
4. It is generally advantageous for both the Water Company and the consumer to have but one service line and meter to a premises or industry. However, in special instances, particularly large industrial consumers or apartment houses, multiple meters and even multiple service lines will be permitted. Each case must be given special consideration by the Water Company. However, each property owner or consumer shall understand that every consumer is considered as a separate account and will be subject to the schedule of rates as contained in the tariff, and that the average cost per unit of water consumed will be greater than if it were all consumed through one meter.
Multiple Premises for One Service Line or Meter
5. In general, it is desirable and will be required, that each premise have a separate service line and meter. New installations of two or more premises on one service line or meter will not be permitted except upon written approval of the Water Company made after thorough investigation of the conditions.
When two or more premises are supplied through a single service, any violation of the rules of the Water Company with reference to either or any of the consumers, shall be deemed a violation as to all and the Water Company may enforce compliance with these rules by shutting off the entire service; except that such action shall not be taken until the innocent consumer, who is not in violation of the Water Company’s rules, has been given a reasonable notice and opportunity to attach his pipes to a separately controlled curb cock.
In instances where one or more premises, served by one service line or meter, which have in the past, been under one ownership, are sold so that they are owned individually, the Water company may at its discretion, require individual service lines and meters.
Quantity Recorded on Meter
6. The quantity recorded by the meter shall be conclusive and
binding on both the consumer and the Water Company, except where the meter has been found to have ceased to register correctly; in which case the quantity used during a previous corresponding period or average of periods may be used as a basis for settlement at the discretion of the Water Company.
Minimum Charge for Water Service
7. Each quarterly minimum charge shall entitle the consumer to receive during the then current three month period, the amount of water which the minimum charge would pay at the schedule of meter rates herein set forth, or which may hereafter be adopted, but to no more, and all water taken in excess of such an amount shall be paid for at the schedule of meter rates. The minimum charge shall be paid whether such amounts of water is taken or not.
Bills Sent to Consumer’s Address
8. Bills and notices relating to the Water Company or its business will be mailed or delivered to the consumer’s last address, as shown on the books of the Water Company, and the Water Company shall not otherwise be responsible for delivery. The Water Company will mail all such notices and bills to the address given on the application for water supply until further notice of change of address in writing has been filed with the Water Company by the consumer. The Water Company holds the consumer responsible for all indebtedness to the Water Company, and will send all bills to his latest address, as indicated above. If the consumer makes a separate agreement regarding payment of water bills such separate agreement will not be binding in any way on the Water Company.
Payment
9. Bills for all domestic, commercial and industrial service
will be rendered monthly or quarterly at the option of the Company, except that residential customers may request a monthly bill. All bills are payable upon presentation at the office of the company during its regular office hours or to any of its authorized collecting agents.
10. A late payment charge of one and one-quarter (1 ¼) per cent
per month will be added to bills unpaid for twenty (20) days
after the due date.
Collection Procedure
11. The regular water bill will be sent to the consumer on the
first day of the month following the period for which the
charge applies.
Consumers who have not paid said bill on or before the due
date will have service discontinued only after compliance
with presently effective P.U.C. Rules and Regulations.
In the case of any account which has not been paid within
five (5) days following the due date, the consumer will be
given ten days written notice the account is past due.
Service will be shut off only in accordance with the rules
and regulations of the P.U.C. presently governing the same.
Meter Testing Upon a Consumer’s Request
12. In case of a disputed account involving the accuracy of a
meter, such meter shall be tested upon the request of the
consumer in accordance with the procedure outlined by the Pennsylvania Public Utility Commission. In the event that the meter so tested is found to have an error in registration of 4 percent or more, the current bills will be increased or decreased accordingly. Each request for the test of a meter for accuracy shall be accompanied by a deposit as permitted under presently effective P.U.C. rules and regulations.
If the meter so tested shall be found to have an error of less than 4 percent, the deposit shall be retained by the Water Company. If the error in registration is found to be 4 percent or more, or if for other reasons the disputed account is corrected substantially in favor of the consumer, the cost of the test shall be borne by the Water Company and the amount of the deposit shall be returned to the consumer.
13. All meters shall be furnished by and remain the property of the Water Company. The size and type of all meters is to be determined by the Water Company. All meters shall at all reasonable times be accessible to the Water Company and subject to its control. The meter shall be conveniently located within the building supplied, at a point approved by the Water Company, so as to control the entire supply; and a proper place and protection thereof shall be provided by the consumer. In any case where it is not convenient to place the meter within the building, the Water Company may, at the property owner’s expense, place it outside the building in a suitable meter vault.
Maintenance and Replacement of Service Lines and Meters
14. The routine testing maintenance, repair and replacement
of meters, combination shut-off and drain valve at the meter, curb cock, curb box, corporation cock on the street main, and the service line between the corporation cock and the curb cock, due to normal wear and action of the water and the elements will be made by the Water Company at its own expense.
In case of damage to the meter by reason of any act or shall pay to the Water Company, the cost of its repair and replacement upon presentation of bill therefore. omission by others (such as damage occasioned by fire, frost, hot water, excavation, or misuse) the consumer
shall pay to the Water Company, the cost of its repair and replacement upon presentation of bill therefore.
In setting or removing, or exchanging meters, the Water Company employees will use diligence and care not to damage adjoining piping, but in case the adjoining piping has deteriorated to a point where the meter cannot properly be set, it shall be the duty and the liability of the consumer to correct such piping as necessary.
