On Friday, July 28, 2017, the Ministry of Health, Labor and Welfare (MHLW) of the Government of Japan (GOJ) announced revisions to Japan’s Maximum Residue Levels (MRLs) for the following pesticides and veterinary drugs: Cyanazine, Flometoquin, Mandipropamid, Dinotefuran, Gamithromycin, and Tiamulin. The Embassy comment period for these proposals is open until Monday, August 14, 2017. MHLW will also notify these revised MRLs to the World Trade Organization, which will allow for another opportunity for interested parties to comment on these proposed changes.

TheFoodSanitation Actauthorizes theMinistry ofHealth, Labour and Welfare(MHLW)toestablishresiduestandards (maximum residuelimits, “MRLs”) for pesticides, feedadditives, and veterinarydrugs (hereafter referred toas “agricultural andveterinarychemicals”) that mayremain infoods. Anyfood for whichstandardsareestablishedpursuanttotheprovisionsinArticle11, Paragraph 1of theact isnotpermitted tobemarketed inJapanunless it complies withtheestablished standards.

OnMay29,2006,Japanintroduced thePositiveListSystem1 foragriculturalandveterinarychemicalsinfood.AllfoodsdistributedintheJapanesemarketplacearesubject toregulationof thesystem.

TheMHLWisgoingtomodify or newlysetMRLsinsomecommodities for thefollowingsubstances:

Pesticides: Cyanazine, Flometoquin, MandipropamidPesticidesand Veterinarydrugs: DinotefuranVeterinarydrugs: Gamithromycin, Tiamulin

Summary

Cyanazine(pesticide:herbicide):PermittedforuseinJapan.TheMHLWis goingtoestablishMRLsinsomecommoditiesinresponsetoarequestforsettingMRLsbytheMinistryofAgriculture,ForestryandFisheries(MAFF)withtheintentiontoexpanditsusepattern. TheMHLWisalsogoingtomodify MRLsinsomecommoditiesthatwereprovisionallysetattheintroductionofthePositiveListSystem.

Flometoquin(pesticide:insecticide):NotpermittedforuseinJapan.TheMHLWisgoingtoestablishMRLsinsomecommoditiesinresponsetoarequestforsettingMRLsbytheMAFFwiththeintentiontonewlyregisterthissubstanceasapesticide.Thisactionwillnotstrengthenthecurrentregulationforanycommodities.

Mandipropamid(pesticide:fungicide):PermittedforuseinJapan.TheMHLWisgoingtoestablishMRLsinsomecommoditiesinresponsetoarequestforsettingMRLsbytheMAFFwiththeintentiontoexpanditsusepattern.TheMHLWisalsogoingtoestablishMRLsinsomecommoditiesinresponsetoarequestforsettingimporttolerancesbasedontheGuidelineforApplicationforEstablishmentandRevisionofMaximumResidueLimitsforAgriculturalChemicalsUsedoutsideJapan(ShokuanNo.0205001,5February2004).

Dinotefuran(PesticideandVeterinarydrug:insecticide):PermittedforuseinJapan.TheMHLWisgoingtoestablishMRLsinsomecommoditiesinresponsetoa requestforsetting MRLsby theMAFF withtheintentiontoexpanditsusepattern.TheMHLWisalsogoingtoestablishMRLsinsomecommoditiesinresponsetoarequestforsettingimporttolerancesbasedontheGuidelineforApplicationforEstablishmentandRevisionofMaximumResidueLimitsforAgriculturalChemicalsUsedoutsideJapan(ShokuanNo.0205001,5February2004).

Gamithromycin(veterinarydrug:antibiotic):NotpermittedforuseinJapan.TheMAFFaskedtheministerofHealth,LabourandWelfareforcommentsaboutapplicationformanufactureand sales approval asa veterinarydrug,andmodificationoftheapplicationofthissubstance,undertheActonSecuringQuality,EfficacyandSafetyofPharmaceuticals,MedicalDevices,RegenerativeandCellularTherapyProducts,GeneTherapyProducts,andCosmetics.Inresponsetothis,theMHLWisgoingtoestablishMRLsinsomecommodities.Thisactionwillnotstrengthenthecurrent regulationforanycommodities.

Tiamulin(veterinarydrug:antibiotic): Permittedfor usein Japan.TheMHLW isgoingtomodifyMRLsinsomecommoditiesthatwereprovisionallysetattheintroductionofthePositiveListSystem.
