Thepurposeofthisformistoprovideyouandyourroommate(s)withastartingpointtonegotiatea varietyof issues. Althoughmostroommatesbelievetheywillgetalonggreatanddon’tneeda roommate agreement, experience has shown that even the best of friends can become bitter enemiesafterseveralmonthsofsharinganapartment.Itishighlyrecommendedthatanagreement becompletedafteranhonestdiscussionaboutissuesandpersonalhabits.

Weagreethatifthisagreement conflictswithanyofourrightsandobligationsundertheTenancy Agreement dated ,withrespecttotheabovepremisesorwiththe provisionsofanyProvincialActs,thesaidTenancyAgreementandtheProvincialActwillprevailinall respects.

3)ROOMS–Itisveryunlikelythatalloftheroomswillbeequallydesirable,ie.Thesamesize,same sizeclosets,haveanensuitebath,etc.Asagroupyouwillneedtodecidewhowillgetaparticular roomandhowthatdecisionismade. Youcanhandleitassimplyasflippingacoinorrollingadice. Beforedecidingwhogetsaparticularroomyouwillneedtodecidewhethereveryonepaysthesame amountofrentorisamore“desirable”roomworthmoremoney.

Although individual chores may seem like minor annoyances, during stressful times (mid‐terms, exams,etc),thoseminorannoyancescanleadtomajordisputes. Youcandealwithchoresbysimply having aperson responsible foranindividual chorefortheentireyear,oryoucanrotate chores daily,weekly,monthlyetc. inadditiontoassigningwhoisresponsibleforaparticularchore,make sureyoudecideonthefrequencyandwhenithastobedone. Forexample,youmaydecideeach personisresponsible todothedishesonaparticular dayoftheweekandthedishesneedtobe washedandputawaybeforetheendofthenight.

Inthefirstcase,itisnecessarytodiscusswho willsubletandhowtheincomeisdivided.Doesthesublettorhaveuseoftheentireapartment or just one bedroom and the common area (It is advisable to have a written agreement with the sublettor).Inthesecondcase,thereshouldbesomediscussionastowhetherthesublettorneedsto beapproved byallparties orifthesublettor needs tobeanon‐smoker orthesame sexasthe remainingroommates,etc.
6)HOUSERULES– it isimportanttodiscusshouserulesbeforelivingtogether. Bydiscussingand agreeingtohouserulesinadvanceeveryonehasthesameunderstandingandnoonepersonisthen seenas“whining”or“complaining”.Belowaresometypicalrulesthatneedtobeaddressed:

GUESTS ‐ Can consist of mutual friends, visitors, overnight guests, partners and even parents.
COMMON COMPLAINT ‐Myroommate hastheir partner over every Friday andSaturday nightortheystayforaweekatatime.
PERSONALITEMS‐Couldincludemanythingsatvaryingdegrees.Forexample,bedroomvs commonareaorbathroomitemsvsitemsinthefridge.Note:Itmaybeworthwhiletodoa propertylisttoensurethateverybodyknowswhichitemsbelongtoeachroommateaswell asforinsurancepurposes.
COMMONCOMPLAINT‐Myroommatewentintomybedroomtoborrowmyhairdryerand toldmeacoupleofdayslaterwhenIcouldnotfindit.
SMOKING‐Decideifroommatescansmokeandifso,where.Alsoconsiderguests.

LEAVING MESSAGES ‐ It is always important to have good communication between roommates.Designateanarea(eg.fridgedoor)toleavemessagesforeachother.
COMMONCOMPLAINT‐Myroommateneverwritesdownmessagesandtellsmeafterthe messagebecomesirrelevant!
STUDYING ARRANGEMENTS ‐ There may be times when visitors will not be allowed or
maybetworoommatespreferusingthesameareatostudy.
COMMONCOMPLAINT‐Myroommatelikestostudywithhisfriend,buttheirchattinglate intothenightbothersme.
PETS‐Decideifpetswillbeallowed,evenonatemporarybasis.
COMMON COMPLAINT ‐ My roommate and I agreed to not have a cat or dog, but at
Christmass/hegotagerbilthatrunsonitswheelallnight!
Itisagreedthatthefollowingruleswillapplyfortheperiodofouroccupancyatsaidpremises:
8)OTHER‐ Itisimportanttoknowwhatwillhappenattheendofanagreement.Itshouldbe incorporated intotheagreement thatallpartieshaveadiscussion inearlyFebruary astowhatis going to happen. If one roommate is going to give their notice to vacate then the Roommate Agreement shouldrequireeachindividualtogiveacopyofthenoticetootherroommatessothat theycandecideiftheyaregoingtostayorgivetheirnoticeaswell.
A) It is understood between and amongst the undersigned that each is responsible for his/her portion of the rent as per section “1)” above until the end of the lease period. It is further understoodthatifatenantvacatesbeforetheendoftheagreement,s/hewillberesponsibleforthe accruingrentsto theendoftheTenancyAgreement.ASPERPROVINCIALLEGISLATION,THE REMAININGTENANT(S)WILLBE RESPONSIBLETO THELANDLORDFORANYSHORTFALLIN RENT CAUSEDBYAVACATINGTENANT.(Ifalltenantsareona“joint”lease).
B)Attheendoftheleasetermforsaidpremises,anytenantonthesaidTenancyAgreementhasa righttocontinue livinginthepremises aslongastheyadheretotherentalagreement. However, sometenantsmaywishtoleavewhileothersmaywishtostay.Itisagreedif thatthefollowing provisionswillapplywhendeterminingarrangementsfortenancybeyondthetermof theoriginal TenancyAgreement:
