CRITERIA FOR REQUESTS TO FILL POSITIONS
Policy: All hiring is restricted to those positions deemed essential to state government’s business affecting the health, welfare, and safety of the public. All agencies must document each exception, noting the position(s) filled and the exception criteria used. Our agency will document for later review all hires and will provide the necessary information to the Legislature as required.
Purpose: The ODE managed hiring process will apply to all positions, including positions that are financed in full or in part with General Fund and/or Lottery Fund dollars, positions that are financed indirectly by General Fund and/or Lottery Fund dollars, positions financed by Federal Fund dollars, and positions financed by Other Fund dollars, including temporary and contract temporary employees. All current vacant positions, as well as all positions that become vacant, will revert to a central office. Funding associated with the position will not be affected enabling the funding associated with that position to remain.
Process: The State exception criteria for filling positions are as follows:
The position directly affects people’s health, welfare, and safety.
The position provides direct medical or physical care, supervision, or security of clients, patients, or inmates.
The position has a direct impact on the ability of a state agency to assure accountability and economy in the expenditure of funds or the execution of programs.
The position is filled through the transfer or rotation of existing staff within the same agency (or between agencies for high-priority functions) and results in no increase in overall FTE and has no impact, or negligible impact, on the General Fund.
Leaving a position vacant would result in a significant negative impact on funding, such as collection of revenue, or would result in a net loss of federal funds to an agency program.
Leaving a position vacant would adversely and directly impact an agency’s required compliance with statute, court orders, or federal mandates.
ODE exception criteria for filling positions include:
Position authority availability.
Requesting office has sufficient budget resources.
Internal candidates or reassignment of current staff will be first. Requests must be consistent with agency priorities.
Appeals: Requests for reconsideration will be presented to the Executive Team.
