Residential Rental Agreement
SouthwestBehavioralHealthCenter through it’s Housing Manager, rents to
(Client Name)1)Rental Payment.The first month’s rent shall be paid at the commencement of residency. If commencement of residency is other than the 1st day of the month, in the month following commencement of this rental agreement, resident shall pay pro rated, the rent to the end of the month in advance. Rent pro-ration will be established in the rent and board formula (currently $12.00/day).
2)$360will be paid on or before the fifth day of each month, for the upcoming month. If not paid within the first five days after due date, the rent will be increased $10.00. Rental payments are to be made to SouthwestBehavioralHealthCenter; for your protection,payments should be paid by check or money order. If a check is returned from the bank for non-sufficient funds, or other reasons of non-payment, there will be a $20.00 charge. If checks are returned unpaid, tenants may be required to pay in either in a cashier’s check or money order.
3)Utilities.Residents residing in the St. George Duplex are required to pay the following utilities: $20.00 monthly for phone and cable. For those residents residing in the Cedar City Duplex, utilities are included in rent. Utilities at Mountain View House are included in $12.00 dollar per day rent.
4)Pets. No pets may be brought onto any part of the housing community at any time, except on express written consent of management.
5)Auto Parking. No personal vehicles are to be kept at Mountain View House.
6)Termination. Either management or resident may terminate this Resident Rental Agreement at any time by giving two (2) weeks notice in writing to the other, or as provided by the State statues. Rent shall be paid up to and including date of termination of occupancy.
7)Alterations and Improvements.Residents shall make no alterations of or improvements to the premises without obtaining management’s written consent in advance, including shelving and flooring, the installation of additional locks, or changing of the existing locks. All alterations, additions or improvements made in and to said premises shall be the property of the apartment community and shall remain upon and be surrendered with the premises.
8)Noise etc.Loud and boisterous noise or any other objectionable behavior by resident(s) or their guests is not permitted; resident agrees to use good judgment and thoughtfulness for others in the use of his/her room. Resident further agrees not to commit, suffer, or permit any waste or nuisance in, on, or about the premises, or in any way annoy, molest, or interfere with other resident; or to use in a wasteful or unreasonable or hazardous manner, any of the property or utilities furnished by the management.
9)Injuries or Damage. Neither management not the owner of the Supported Living Facility shall be liable to resident for any loss or damage to resident’s effects. It is agreed it is resident’s responsibility to insure their property and safeguard against personal loss. Resident agrees to save and hold management harmless from any claims for any damages arising as the result of resident’s negligence.
10)Abandonment. Resident’s absence from the premises for five (5) consecutive days while all or any portion of the rent is unpaid shall be deemed abandonment of said premises and this residency at management’s option may immediately terminate without further notice. Resident’s belongings will be inventoried and stored and the room re-rented without any liability of management to resident whatsoever.
11)Cost of Collection. In the event the use of an attorney or lawsuit is necessary to enforce any of the provisions herein contained, or to recover possessions, resident agrees to pay any further rent, reasonable attorney’s fees and court fees, and delinquent amounts and damages.
12)Other Covenants. Resident’s application to rent and community policies are agreed to be a part of the Resident Rental Agreement, and the terms, conditions, and representations shall be binding upon the resident.
13)Right of Entry. Management reserves the right to inspect all rooms at reasonable times to ensure cleanliness and resident safety. Management reserves the right to complete room searches for the purpose of safety. When a search is performed, a Room Searchform will be completed.Items confiscated that are deemed a danger will be secured for safety and properly disposed of—this may include turning weapons that are found over to law enforcement.
14)Living Arrangements. Resident agrees that no other persons other than those who have signed this Resident Rental Agreement, or any amendment to this ResidentRental Agreement, shall reside in said apartment. Failure to comply with this clause shall be deemed a breach of the Agreement and the Agreement shall immediately terminate at the option of Management.
15)Re-negotiation of Rent Agreement. This Resident Rental Agreement shall be negotiated on or before January 1st of each year to determine if conditions of occupancy are being met and to decide if an increase or decrease in rent is due, based on the State of Utah’s HOME Program Rents Indicators for Washington County, Utah. If any adjustments need to be made, the Housing Manager will make the appropriate changes on a newResident Rental Agreement.
