1.3Coverage
ThisAwardappliestonursingemployeesintheprivatesector(non-governmental)employedintheindustryofagedcareincludingAgedCareResidentialFacilitiesincludingNursingHomes,Hostels,RetirementVillagesandagedcarerespitecentresintheStateofQueensland.
1.4ExemptionfromcoverageofAward
EmployeesoftheGovernmentofQueensland,membersofreligiousorders,orthosecoveredbyanyotherAwardareexemptfromtheprovisionsofthisAward.
1.5Dateofoperation
ThisAwardtakeseffectfrom19December2005.
1.6Definitions
1.6.1Classificationofemployees
Thefollowingdefinitionsofclassificationsofnursingemployeesshallapplyforthepurposesofascertainingdutiesandtheappropriatelevelwithinwhichtodetermineratesofpay. ThesedefinitionsaretobereadinconjunctionwithSchedule3,4and6respectively,ofthisAward. ThisAwardcontainsgenericlevelstatementsforeachlevelofnurseoutliningtherangeofresponsibilitieswhichmaybeexpectedatthatlevel.
(a)"AssistantDirectorofNursing" meansaRegisteredNurseLevel4appointedasanAssistantDirectorofNursingwhoisplacedincontrolofasectionofanAgedCareResidentialFacilityand/orwhomayberequiredtoactasorrelieveaDirectorofNursingasdefinedinclause1.6.1.
(b)"AssistantNurse" meansanemployeewhoissolelyrequiredtoassistintheperformanceofnursingdutiesundertheSupervisionofaRegisteredNurseorEnrolledNurse.
(c)"DirectorofNursing" meansaRegisteredNurseLevel5,appointedasaDirectorofNursing,whohaschargeofthenursingstaffandwhomayalsoberequiredtosuperviseotherstaff(includingdomesticstaff).
(d)"EnrolledNurse" meansanemployee:
(i)whoisenrolledundertheNursingAct1992asanEnrolledNurse;and
(ii)whoissubjecttotheregulationsand/orbylawsoftheQueenslandNursingCouncilwhoholdsanannuallicensingcertificateassuch.
(e)"HostelSupervisor" meansaRegisteredNurseLevel3or4appointedasaHostelSupervisorwhohasoperationalresponsibilitiesforaHostelasdefinedinclause1.6.2. TheleveloftheHostelSupervisorshallbedeterminedwithreferencetothegenericlevelstatementsatSchedule5tobeusedinconjunctionwiththeHostelSupervisorgradingtool(whendevelopedinaccordancewiththetimeframesetoutinclause1.7.
(f)"NightSupervisor" meansaRegisteredNurse,appointedasaNightSupervisor,whoisrequiredtosuperviseanAgedCareResidentialFacilityduringaperiodofnightdutyandasaconsequence,ispaidtheappropriateallowance.
(g)"RegisteredNurse" meansanemployeewhois:
(i)registeredundertheNursingAct1992asaRegisteredNurse;and
(ii)whoissubjecttotheregulationsand/orby-lawsoftheQueenslandNursingCouncilandwhoholdsacurrentpracticingcertificate.
(h)"RegisteredNurseLevel2" meansaRegisteredNurse,appointedassuch,andwhoseinputintomorecomplexcareneedsprovidessupportanddirectiontoRegisteredNursesand/orotherpersonnel.
(i)"RegisteredNurseLevel3" meansaRegisteredNurseappointedassuchandwhoseresponsibilitiesaregreaterthanthoseofaRegisteredNurseLevel2. Examplesofareasofresponsibilityincludemanagement,research,education,clinical.
(j)"RegisteredNurseLevel4" seeAssistantDirectorofNursing.
(k)"RegisteredNurseLevel5" seeDirectorofNursing.
1.6.2Placesofemployment
(a)"AgedCareResidentialFacility" meansafacilityforthecareofagedpeopleprovidingresidentialcareasdefinedbytheAgedCareAct1997(Cth).
(b)"NursingHome" meansanestablishmentpursuanttotheHealthAct1937.
(c)"Hostel" meansanagedcarefacilityasdefinedbytheHealthAct1937providedthatsuchfacilityneednotbelicensedunderthatAct.
(d)"RetirementVillage" meansapremisesnotbeingaHostelorNursingHomeaspreviouslydefined,conductedorpromotedassuitablefortheuse(exclusivelyorprimarily)byelderlyorretiredpersonspursuanttotheRetirementVillagesAct1999.
(e)"RespiteCare" meanscarenotbeinganintegralpartofanAgedCareResidentialFacility,RetirementVillageorprivatehospitalwherecareisprovidedonadailyoroccasionalbasisandwhichmayalsoprovidetherapeuticfacilities.
1.6.3General
(a)"Act" meanstheIndustrialRelationsAct1999asamendedorreplacedfromtimetotime.
(b)"AuthorisedRepresentative" meansapersonauthorisedinaccordancewiththerulesoftheQueenslandNurses' UnionofEmployees.
(c)"Award" meanstheNurses' AgedCareAward - State2005.
(d)"CourseofInstruction" meanstheCertificateIIIinResidentialAgedCareandshallincludetheminimumtrainingrequirements. ThetermalsomeansanyotherCourseofInstructionapprovedbytheStateTrainingCouncilthatreplacesCertificateIIIinResidentialAgedCare.
(e)"Commission" meanstheQueenslandIndustrialRelationsCommission.
(f)"Employer" bearsthemeaninggiventothattermintheAct.
(g)"In-serviceTraining" meanstheformaland/orinformalworkrelatedlearningactivitiesrequiredbytheEmployertobeundertakenbyanemployeethroughopportunitiesprovidedbytheEmployer,whichcontributetoanemployee'sprofessionaldevelopmentandefficiencyby:
(i)theacquisitionandupdatingofskillsandknowledgebeneficialtoeffectiveperformancewithinateam,and/or
(ii)reducingthedegreeofdirectSupervisionrequiredoftheemployee,and/or
(iii)enhancingthebreadthand/ordepthofknowledgeandskillsrequiredbyanemployeeinaspecificareaand/orrangeofareasofnursingpractice,asthecasemaybe.
(h)"Supervision" meansdirectandindirectSupervision.
(i)DirectSupervisionoccurswhereanappropriatelyqualifiedpersonobserves,workswithordirectsthetraineeintheiractualwork.
IndirectSupervisionoccurswhenanappropriatelyqualifiedpersoninstructsthetraineeintheiractualworkandevaluatestheoutcomesofthetraineesactualwork.
(i)"Union" meanstheQueenslandNurses' UnionofEmployees.
1.7Leavereserved
1.7.1HostelSupervisors
(a)ThepartiestothisAwardshalldevelopaHostelSupervisorgradingtoolwithin8monthsfromtheoperativedateoftheAward:
Providedthatshouldthepartiesbeunabletodevelopagradingtoolwithinthetimeframespecifiedinclause1.7.1(a),leaveisopentoanypartytorefertheissuebacktotheCommissionpursuanttomatterNo.B1555/96andtheAct.
(b)LeaveisreservedtoanypartytothisAwardtopursuetheissueofHostelSupervisorsbeingclassifiedatRegisteredNurseLevel5.
1.7.2EnrolledNurses
ThepartiestothisAwardshallreviewtheEnrolledNurseclassificationwithin6monthsoftheoperativedateofthisAward.
PART2 - FLEXIBILITY
2.1Enterpriseflexibility
2.1.1Aspartofaprocessofimprovementinproductivityandefficiency,discussionshouldtakeplaceateachenterprisetoprovidemoreflexibleworkingarrangements,improvementinthequalityofworkinglife,enhancementofskills,trainingandjobsatisfactionandtoencourageconsultativemechanismsacrosstheworkplace.
2.1.2Theconsultativeprocessesestablishedinanenterpriseinaccordancewithclause2.1mayprovideanappropriatemechanismforconsiderationofmattersrelevanttoclause2.1.1. Uniondelegatesattheplaceofworkmaybeinvolvedinsuchdiscussions.
2.1.3AnyproposedgenuineagreementreachedbetweenanEmployerandemployee/sinanenterpriseiscontingentupontheagreementbeingsubmittedtotheCommissioninaccordancewithChapter6oftheActandistohavenoforceoreffectuntilapprovalisgiven.
PART3 - COMMUNICATION,CONSULTATIONANDDISPUTERESOLUTION
3.1Grievanceanddisputesettlingprocedure
ThematterstobedealtwithinthisprocedureshallincludeallgrievancesordisputesbetweenanemployeeandanEmployerinrespecttoanyindustrialmatterandallothermattersthatthepartiesagreeonandarespecifiedherein. Suchproceduresshallapplytoasingleemployeeortoanynumberofemployees.
3.1.1Intheeventofanemployeehavingagrievanceordisputetheemployeeshallinthefirstinstanceattempttoresolvethematterwiththeimmediatesupervisor,whoshallrespondtosuchrequestassoonasreasonablypracticableunderthecircumstances. Wherethedisputeconcernsallegedactionsoftheimmediatesupervisortheemployee/smaybypassthislevelintheprocedure.
3.1.2Ifthegrievanceordisputeisnotresolvedunderclause3.1.1,theemployeeortheemployee'srepresentativemayreferthemattertothenexthigherlevelofmanagementfordiscussion. Suchdiscussionshould,ifpossible,takeplacewithin24hoursaftertherequestbytheemployeeortheemployee'srepresentative.
3.1.3Ifthegrievanceinvolvesallegationsofunlawfuldiscriminationbyasupervisortheemployeemaycommencethegrievanceresolutionprocessbyreportingtheallegationstothenextlevelofmanagementbeyondthatofthesupervisorconcerned. Ifthereisnolevelofmanagementbeyondthatinvolvedintheallegationtheemployeemayproceeddirectlytotheprocessoutlinedatclause3.1.5.
3.1.4Ifthegrievanceordisputeisstillunresolvedafterdiscussionsmentionedinclause3.1.2,themattershall,inthecaseofamemberofaUnion,bereportedtotherelevantofficerofthatUnionandtheseniormanagementoftheEmployerortheEmployer'snominatedindustrialrepresentative. AnemployeewhoisnotamemberoftheUnionmayreportthegrievanceordisputetoseniormanagementorthenominatedindustrialrepresentative. Thisshouldoccurassoonasitisevidentthatdiscussionsunderclause3.1.2willnotresultinresolutionofthedispute.
3.1.5If,afterdiscussionbetweentheparties,ortheirnomineesmentionedinclause3.1.4,thedisputeremainsunresolvedafterthepartieshavegenuinelyattemptedtoachieveasettlementthereof,thennotificationoftheexistenceofthedisputeistobegiventotheCommissioninaccordancewiththeprovisionsoftheAct.
3.1.6Whilstalloftheaboveprocedureisbeingfollowed,normalworkshallcontinueexceptinthecaseofagenuinesafetyissue.
3.1.7Thestatusquoexistingbeforetheemergenceofthegrievanceordisputeistocontinuewhilsttheaboveprocedureisbeingfollowed.
3.1.8AllpartiestothedisputeshallgivedueconsiderationtomattersraisedoranysuggestionorrecommendationmadebytheCommissionwithaviewtothepromptsettlementofthedispute.
3.1.9AnyOrderorDecisionoftheCommission(subjecttotheparties' rightofappealundertheAct)willbefinalandbindingonallpartiestothedispute.
3.1.10Discussionsatanystageoftheprocedureshallnotbeunreasonablydelayedbyanyparty,subjecttoacceptancethatsomemattersmaybeofsuchcomplexityorimportancethatitmaytakeareasonableperiodoftimefortheappropriateresponsetobemade. Ifgenuinediscussionsareunreasonablydelayedorhindered,itshallbeopentoanypartytogivenotificationofthedisputeinaccordancewiththeprovisionsoftheAct.
3.2Consultation
3.2.1ThepartiestothisAwardarecommittedtoco-operatingpositivelytoincreasetheefficiency,productivityandcompetitivenessoftheindustriescoveredbythisAwardandtoenhancethecareeropportunitiesandjobsecurityofemployeesinsuchindustries.
3.2.2Ateachworkplace,anEmployer,theemployeesandtheUnioncommitthemselvestoestablishingaconsultativemechanismandproceduresappropriatetothesize,structureandneedsofthatworkplace. MeasuresraisedbytheEmployer,employeesortheUnionforconsiderationconsistentwiththeobjectivesofclause3.2.1shallbeprocessedthroughthatconsultativemechanismandprocedures.
PART4 - EMPLOYERANDEMPLOYEES' DUTIES,EMPLOYMENTRELATIONSHIPANDRELATEDARRANGEMENTS
4.1Employmentcategories
4.1.1Full-timeemployee
Afull-timeemployeemeansanemployeeengagedbytheweek(38hours)inaccordancewiththeprovisionofthisAward.
4.1.2Part-timeemployee
(a)Apart-timeemployeemeansanemployeewhoisengagedassuchandwhoisemployedforlessthan76hoursperfortnightandmorethan16hoursperfortnight.
(b)Apart-timeemployeemustbepaidforaminimumof3hoursonanydaywhereworkisperformed.
(c)Part-timeemployeesshallbepaidatanhourlyrateequalto1/38thoftheweeklyrateprescribedbytheAwardfortheclassificationunderwhichtheyareengaged.
(d)Apart-timeemployeeisentitledtoprorataannualleave,sickleave,longserviceleaveandbereavementleave.
(e)Publicholidaysshallbepaidonthesamebasisasfull-timeemployeesforallpublicholidaysonwhichtheemployeewouldhaveotherwiseworkedonaproportionatebasiscalculatedontheordinaryhours.
(f)Thehoursofdutyforpart-timeemployeesshallbeworkedinaccordancewitharosterwhichmaybeamendedfromtimetotimetosuittheexigenciesoftheAgedCareResidentialFacility.
(g)IntheeventofchangeddependencyofresidentswhichmakesitnecessaryfortheEmployertoreducetheworkinghoursofpart-timeemployees,theEmployermayreducetheworkinghoursofpart-timeemployeesprovidedthatthepropernoticeisgiventotheemployees.
(h)TheEmployermustprovideoneweek'snoticetoanemployeewhohascompletedoneyear'sserviceandafurtherweekforeachsubsequentyearofservice. However,noEmployerisrequiredtogivemorethan4weeks' noticeoftheintendedreductioninworkinghours.
4.1.3Casualemployee
Acasualemployeemeansanemployeewhoisengagedassuchfornotmorethan76hoursperfortnightwithaminimumpaymentasfor2hours' workinrespectofeachengagement.
Therateofpaymenttocasualemployeesshallbe1/76thofthefortnightlywagefortheclassificationinwhichtheyareengagedplusanadditional23%perhourandtheproratapaymentofanyallowanceapplicablepursuanttoclause5.4baseduponthenumberofhoursworkedinrelationtoa38hourweek.
ThecasualloadingshallnotbecompoundedbypenaltiescontainedwithinthisAward. Penaltiesshallbecalculatedonthebaserateofpay,excludingthecasualloading,withthecasualloadingcomponentthenaddedontothepenaltyrateofpay.
4.1.4Contractattimeofemployment
Allfull-timeandpart-timeemployees,atthetimeofengagement,shallbeissuedwithawrittenstatementclearlyindicatingtheirtypeofemploymentcontract.
Inthecaseofpart-timeemployees,thestatementshallincludetheanticipatednumberofhoursperfortnightthattheemployeeisrequiredtowork.
4.2Terminationofemployment
4.2.1Statementofemployment
AnEmployershall,intheeventofterminationofemployment,provideuponrequesttotheemployeewhohasbeenterminatedawrittenstatementspecifyingtheperiodofemploymentandtheclassificationortypeofworkperformedbytheemployee.
4.2.2TerminationbyEmployer
(a)AnEmployermaydismissanemployeeonlyiftheemployeehasbeengiventhefollowingnotice:

(b)Inadditiontothenoticeinclause4.2.2(a),employees45yearsoldoroverandwhohavecompletedatleast2years' continuousservicewiththeEmployershallbeentitledtoanadditionalweek'snotice.
(c)Paymentinlieuofnoticeshallbemadeiftheappropriatenoticeisnotgiven:
Providedthatemploymentmaybeterminatedbypartoftheperiodofnoticespecifiedandpartpaymentinlieuthereof.
(d)IncalculatinganypaymentinlieuofnoticetheminimumcompensationpayabletoanemployeewillbeatleastthetotaloftheamountstheEmployerwouldhavebeenliabletopaytheemployeeiftheemployee'semploymenthadcontinueduntiltheendoftherequirednoticeperiod. Thetotalmustbeworkedoutonthebasisof:
(i)theordinaryworkinghourstobeworkedbytheemployee;and
(ii)theamountspayabletotheemployeeforthehoursincludingforexampleallowances,loadingsandpenalties;and
(iii)anyotheramountspayableundertheemployee'semploymentcontract.
(e)Theperiodofnoticeinclause4.2.2shallnotapplyinthecaseofdismissalformisconductorothergroundsthatjustifyinstantdismissal,orinthecaseofacasualemployee,oranemployeeengagedbythehourorday,oranemployeeengagedforaspecificperiodortasks.
(f)Acasualemployeewillbeentitledtoonehour'snotice.
(g)Annualleaveshallnotbedeemedtoformpartofthenoticeperiodforthepurposeofthisprovision.
4.2.3Noticeofterminationbyemployee
Thenoticeofterminationrequiredtobegivenbyanemployeeshallbeoneweekorforfeitureofwagesinlieuthereofexceptinthecaseofacasualemployeewhensuchnoticeshallbeonehour.
4.2.4Timeoffduringnoticeperiod
DuringtheperiodofnoticeofterminationgivenbytheEmployer,anemployeeshallbealloweduptooneday'stimeoffwithoutlossofpayforthepurposeofseekingotheremployment. ThistimeoffshallbetakenattimesthatareconvenienttotheemployeeafterconsultationwiththeEmployer.
4.3Introductionofchanges
4.3.1Employer'sdutytonotify
(a)WhereanEmployerdecidestointroducechangesinproduction,program,organisation,structureortechnology,thatarelikelytohavesignificanteffectsonemployees,theEmployershallnotifytheemployeeswhomaybeaffectedbytheproposedchangesand,whererelevant,theirUnionorUnions.
(b)"Significanteffects" includesterminationofemployment,majorchangesinthecomposition,operationorsizeoftheEmployer'sworkforceorintheskillsrequired;theeliminationordiminutionofjobopportunitiesorjobtenure;thealterationofhoursofwork;theneedforretrainingortransferofemployeestootherworkorlocationsandtherestructuringofjobs:
ProvidedthatwheretheAwardmakesprovisionforalterationofanyofthemattersreferredtohereinanalterationshallbedeemednottohavesignificanteffect.
4.3.2Employer'sdutytoconsultoverchange
(a)TheEmployershallconsulttheemployeesaffectedand,whererelevant,theirUnionorUnionsabouttheintroductionofthechanges,theeffectsthechangesarelikelytohaveonemployees(includingthenumberandcategoriesofemployeeslikelytobedismissed,andthetimewhen,ortheperiodoverwhich,theEmployerintendstocarryoutthedismissals),andthewaystoavoidorminimisetheeffectsofthechanges(e.g.byfindingalternativeemployment).
(b)Theconsultationmustoccurassoonaspracticableaftermakingthedecisionreferredtoinclause4.3.1.
(c)ForthepurposeofsuchconsultationtheEmployershallprovideinwritingtotheemployeesconcernedand,whererelevant,theirUnionorUnions,allrelevantinformationaboutthechangesincludingthenatureofthechangesproposed,theexpectedeffectsofthechangesonemployees,andanyothermatterslikelytoaffectemployees:
ProvidedthatanEmployershallnotberequiredtodiscloseconfidentialinformation,thedisclosureofwhichwouldbeadversetotheEmployer'sinterests.
4.4Redundancy
4.4.1Consultationbeforeterminations
(a)WhereanEmployerdecidesthattheEmployernolongerwishesthejobtheemployeehasbeendoingtobedonebyanyone,andthisisnotduetotheordinaryandcustomaryturnoveroflabour,andthatdecisionmayleadtoterminationofemployment,theEmployershallconsulttheemployeedirectlyaffectedandwhererelevant,theirUnionorUnions.
(b)TheconsultationshalltakeplaceassoonasitispracticableaftertheEmployerhasmadeadecision,whichwillinvoketheprovisionsofclause4.4.1(a)andshallcoverthereasonsfortheproposedterminations,measurestoavoidorminimisetheterminationsand/ortheiradverseeffectsontheemployeesconcerned.
(c)ForthepurposeoftheconsultationtheEmployershall,assoonaspracticable,provideinwritingtotheemployeesconcernedand,whererelevant,theirUnionorUnions,allrelevantinformationabouttheproposedterminationsincludingthereasonsfortheproposedterminations,thenumberandcategoriesofemployeeslikelytobeaffected,thenumberofworkersnormallyemployedandtheperiodoverwhichtheterminationsarelikelytobecarriedout:
ProvidedthatanEmployershallnotberequiredtodiscloseconfidentialinformation,thedisclosureofwhichwouldbeadversetotheEmployer'sinterests.
4.4.2Transfertolowerpaidduties
(a)Whereanemployeeistransferredtolowerpaiddutiesforreasonssetoutclause4.4.1(a)theemployeeshallbeentitledtothesameperiodofnoticeoftransferastheemployeewouldhavebeenentitledtoiftheemployee'semploymenthadbeenterminatedunderclause4.2.
(b)TheEmployermay,attheEmployer'soption,makepaymentinlieuthereofofanamountequaltothedifferencebetweentheformeramountstheEmployerwouldhavebeenliabletopayandthenewloweramounttheEmployerisliabletopaytheemployeeforthenumberofweeksofnoticestillowing.
(c)Theamountsmustbeworkedoutonthebasisof:
(i)theordinaryworkinghourstobeworkedbytheemployee;and
(ii)theamountspayabletotheemployeeforthehoursincludingforexample,allowances,loadingsandpenalties;and
(iii)anyotheramountspayableundertheemployee'semploymentcontract.
4.4.3Transmissionofbusiness
(a)Whereabusinessis,whetherbeforeorafterthedateofinsertionofthisclauseintheAwardtransmittedfromanEmployer(transmittor)toanotherEmployer(transmittee),andanemployeewhoatthetimeofsuchtransmissionwasanemployeeofthetransmittorofthebusiness,becomesanemployeeofthetransmittee:
(i)thecontinuityoftheemploymentoftheemployeeshallbedeemednottohavebeenbrokenbyreasonofsuchtransmission;and
(ii)theperiodofemploymentwhichtheemployeehashadwiththetransmittororanypriortransmittorshallbedeemedtobeserviceoftheemployeewiththetransmittee.
(b)Inclause4.4.3, "business" includestrade,process,businessoroccupationandincludesapartorsubsidiary(whichmeansacorporationthatwouldbetakentobeasubsidiaryundertheCorporationsLaw,whetherornottheCorporationsLawappliesintheparticularcase)ofanysuchbusinessand "transmission" includestransfer,conveyance,assignmentorsuccessionwhetherbyagreementorbyoperationoflawand 'transmitted' hasacorrespondingmeaning.
4.4.4Timeoffduringnoticeperiod
(a)Whereadecisionhasbeenmadetoterminateanemployeeinthecircumstancesoutlinedinclause4.4.1,theemployeeshallbealloweduptooneday'stimeoffwithoutlossofpayduringeachweekofnoticeforthepurposeofseekingotheremployment.
(b)Iftheemployeehasbeenallowedpaidleaveformorethanonedayduringthenoticeperiodforthepurposeofseekingotheremployment,theemployeeshall,attherequestoftheEmployer,berequiredtoproduceproofofattendanceataninterviewortheemployeeshallnotreceivepaymentforthetimeabsent. Forthispurposeastatutorydeclarationwillbesufficient.
4.4.5NoticetoCentrelink
Whereadecisionhasbeenmadetoterminateemployeesinthecircumstancesoutlinedinclause4.4.1,theEmployershallnotifyCentrelinkassoonaspossiblegivingallrelevantinformationabouttheproposedterminations,includingawrittenstatementofthereasonsfortheterminations,thenumberandcategoriesoftheemployeeslikelytobeaffected,thenumberofworkersnormallyemployedandtheperiodoverwhichtheterminationsareintendedtobecarriedout.
4.4.6Severancepay
(a)Inadditiontotheperiodofnoticeprescribedforordinaryterminationinclause4.2.2,andsubjecttofurtherorderoftheCommission,anemployeewhoseemploymentisterminatedforreasonssetoutinclause4.4.1(a),shallbeentitledtothefollowingamountsofseverancepay:

4.4.7Superannuationbenefits
AnEmployermaymakeanapplicationtotheCommissionforrelieffromtheobligationtomakeseverancepaymentsincircumstanceswhere:
(a)theEmployerhascontributedtoasuperannuationschemewhichprovidesaparticularbenefittoanemployeeinaredundancysituation;and
(b)theparticularbenefittotheemployeeisoverandaboveanybenefittheemployeemightobtainfromanylegislativeschemeprovidingforsuperannuationbenefits(currentlythefederalSuperannuationGuaranteelevy)oranAwardbasedsuperannuationscheme.
4.4.8Employeeleavingduringnotice
Anemployeewhoseemploymentisterminatedforreasonssetoutinclause4.4.1(a),mayterminatesuchemploymentduringtheperiodofnotice,and,ifso,shallbeentitledtothesamebenefitsandpaymentsunderthisclausehadsuchemployeeremainedwiththeEmployeruntiltheexpiryofsuchnotice:
Providedthatinsuchcircumstancestheemployeeshallnotbeentitledtopaymentinlieuofnotice.
4.4.9Alternativeemployment
AnEmployer,inaparticularcase,maymakeapplicationtotheCommissiontohavethegeneralseverancepayprescriptionamendediftheEmployerobtainsacceptablealternativeemploymentforanemployee.
4.4.10Employeeswithlessthanoneyear'sservice
Clause4.4shallnotapplytoemployeeswithlessthanoneyear'scontinuousserviceandthegeneralobligationonEmployersshouldbenomorethantogiverelevantemployeesanindicationoftheimpendingredundancyatthefirstreasonableopportunity,andtotakesuchstepsasmaybereasonabletofacilitatetheobtainingbytheemployeesofsuitablealternativeemployment.
4.4.11Employeesexempted
Clause4.4shallnotapply:
(a)whereemploymentisterminatedasaconsequenceofmisconductonthepartoftheemployee;or
(b)tocasualemployees.
4.4.12Employersexempted
(a)SubjecttoanorderoftheCommission,inaparticularredundancycase,clause4.4shallnotapplytoanEmployerincludingacompanyorcompaniesthatemployemployeesworkingatotaloffewerthan550hoursonaverageperweek,excludingovertime,MondaytoSunday. The550hoursshallbeaveragedovertheprevious12months.
(b)A "company" shallbedefinedas:
(i)acompanyandtheentitiesitcontrols;or
(ii)acompanyanditsrelatedcompanyorrelatedcompanies;or
(iii)acompanywherethecompanyorcompanieshasacommonDirectororcommonDirectorsoracommonshareholderorcommonshareholderswithanothercompanyorcompanies.
4.4.13Exemptionwheretransmissionofbusiness
(a)Theprovisionsofclause4.4.6arenotapplicablewhereabusinessisbeforeorafterthedateoftheinsertionofthisclauseintotheAward,transmittedfromanEmployer(transmittor)toanotherEmployer(transmittee),inanyofthefollowingcircumstances:
(i)wheretheemployeeacceptsemploymentwiththetransmitteewhichrecognisestheperiodofcontinuousservicewhichtheemployeehadwiththetransmittor,andanypriortransmittor,tobecontinuousserviceoftheemployeewiththetransmittee;or
(ii)wheretheemployeerejectsanofferofemploymentwiththetransmittee:
(A)inwhichthetermsandconditionsaresubstantiallysimilarandnolessfavourable,consideredonanoverallbasis,thanthetermsandconditionsapplicabletotheemployeeatthetimeofceasingemploymentwiththetransmittor;and
(B)whichrecognisestheperiodofcontinuousservicewhichtheemployeehadwiththetransmittorandanypriortransmittortobecontinuousserviceoftheemployeewiththetransmittee.
(b)TheCommissionmayamendclause4.4.13(a)(ii)ifitissatisfiedthatitwouldoperateunfairlyinaparticularcase,orintheinstanceofcontrivedarrangements.
4.4.14Incapacitytopay
AnEmployerinaparticularredundancycasemaymakeapplicationtotheCommissiontohavethegeneralseverancepayprescriptionamendedonthebasisoftheEmployer'sincapacitytopay.
4.5Anti-discrimination
4.5.1ItistheintentionofthepartiestothisAwardtopreventandeliminatediscrimination,asdefinedbytheAnti-DiscriminationAct1991andtheIndustrialRelationsAct1999asamendedfromtimetotime,whichincludes:
(a)discriminationonthebasisofsex,maritalstatus,familyresponsibilities,pregnancy,parentalstatus,age,race,impairment,religion,politicalbelieforactivity,tradeunionactivity,lawfulsexualactivityandassociationwith,orrelationto,apersonidentifiedonthebasisofanyoftheaboveattributes;
(b)sexualharassment;and
(c)racialandreligiousvilification.
4.5.2Accordingly,infulfillingtheirobligationsunderthegrievanceanddisputesettlingprocedureinclause3.1,thepartiestotheAwardmustmakeeveryendeavourtoensurethatneithertheAwardprovisionsnortheiroperationaredirectlyorindirectlydiscriminatoryintheireffects.
4.5.3Nothinginclause4.5istobetakentoaffect:
(a)Anydifferenttreatment(ortreatmenthavingdifferenteffects)whichisspecificallyexemptedundertheAnti-DiscriminationAct1991.

4.6Incidentalorperipheraltasks
4.6.1AnEmployermayrequireanemployeetocarryoutsuchdutiesasarewithinthelimitsoftheemployee'sskill,competenceandtrainingconsistentwiththeclassificationstructureofthisAward:
Providedthatsuchdutiesarenotdesignedtopromotedeskilling.
4.6.2AnEmployermayrequireanemployeetocarryoutsuchdutiesandusesuchresourcesandequipmentasmayberequired:
Providedthattheemployeehasbeentrainedintheuseofsuchresourcesandequipment.
4.6.3AnysuchrequirementofanEmployerpursuanttoclauses4.6.1and4.6.2shallbeconsistentwiththeEmployer'sresponsibilitiestoprovideasafeandhealthyworkingenvironmentandshalltakeintoconsiderationtheeffectonworkloadsandinfectioncontrol.

5.2.4Anemployeeworkinglessthan376hoursofserviceperyearmayundertakeanassessment,approvedbytheEmployerandtheUnion,toretaintheemployee'scurrentyearsofserviceclassification.
5.2.5Onterminationofemploymenteachemployeeshallbegivenacertificatesignedanddatedsettingoutthedurationofemploymentatthatfacility,capacityofemployment,detailsofanyadvancement(orreversalofadvancement)inpaypointpursuanttoclause5.1andintheinstanceofpart-timeandcasualemployees,thetotalhoursworked.
5.2.6Apart-timeorcasualemployeeshallberequiredtocompletetheequivalentofafullworkingyear(1976hours)fromthetimeoftheirfirstappointment,enrolmentorregistrationoroftheirlastincrementbeforebeingeligibleforthenextincrementprovidedthatapersonwhohascompleted1976hoursofduty,orhasreceivedpaymentfor1976hours,includingannual,sick,bereavementandotherpaidleave,shallbedeemedtohavecompletedafullyear.
5.2.7Anyemployeeunabletoprovideproofofpreviousexperiencewithin4weeksofengagementwillbepaidattheappropriaterateofpayforthefirstyearofserviceortheyeartowhichproofofexperienceisprovidedfortheclassofemployeesoappointed. WagesshallcontinueatthisrateofpayuntilproofofpreviousexperienceisprovidedtotheEmployeroruntilsuchtimeasservicehasbeenaccumulatedtowarrantpaymentatahigherrate. Whereproofofpreviousexperienceisnotprovidedwithin4weeksofengagement,wageswillcontinuetobepaidatthatrateofpayuntilsuchtimeasfurtherproofofpreviousexperienceisprovidedtotheEmployerandonlythenwillthehigherratebecomepayablefromthedatesupplied. TheEmployershalladvisetheemployeeofthisrequirementatthetimeofengagement.
5.2.8Subjecttoproofofpreviousexperiencebeingprovidedwithin4weeks,theEmployershalladjustpreviouspaymentsbacktothedateofcommencement.
5.2.9Theemployeemayseekco-operationfromtheUniontoassisttheemployeetoobtainorestablishsuchproofofpreviousexperiencestilloutstanding.
5.3Occupationalsuperannuation
5.3.1Inadditiontotheratesofpayprescribedbyclause5.1.2allemployeesshallbeentitledtooccupationalsuperannuationprovisionsasprescribedinclause5.3.
5.3.2Definitions
(a)"TheFund" meanstheHealthEmployeesSuperannuationTrustAustralia(HESTA),aswellasanyotheroccupationalsuperannuationschemeapprovedinaccordancewiththeCommonwealthoperationalstandardsforoccupationalsuperannuationfunds.
(b)"ContributoryWage" means:
(i)theordinaryfortnightlyrateofpayapplicabletoeachemployee'sclassification;or
(ii)thefortnightlyrateofpayprescribedbyclause5.1.2;or
(iii)thehourlyrateofpayforpart-timeemployeesasprescribedbyclause4.1.2;or
(iv)thehourlyrateofpayforcasualemployeesasprescribedbyclause4.1.3.
(c)"EligibleEmployee" meansanyemployeewhohasbeenemployedbytheEmployerduring4consecutiveweeks. Oncompletionoftheabovequalifyingperiod,superannuationcontributionsshallbemaderetrospectivelytothecommencementofthatperiod.
5.3.3Freedomofchoice
EachemployeeshallbegivenequalaccesstoinformationregardingHESTA,aswellassuchotherapprovedoccupationalsuperannuationschemesmadeavailablebytheEmployerfortheemployee'sconsideration,inorderthattheemployeeisabletomakeaninformedchoiceastowhichoccupationalsuperannuationschemetheemployeewishestheEmployertocontributetheamountspecifiedinclause5.3.4.
5.3.4Contributions
(a)Amount - Asfrom1January2005everyEmployershallcontributeonbehalfofeacheligibleemployeeanamountcalculatedat9%oftheemployee'sordinarytimeearningswage,intoanapprovedsuperannuationfund,asdefinedinclause5.3.2. Eachsuchpaymentofcontributionsshallberoundedofftothenearest10cents:
Providedthatwhereanemployeeisabsentandinreceivingbywayofworkers' compensationanamountofmoneynolessthantheAwardrateofpaythecontributionshallbecalculatedat3%:
(b)Providedthatinanyinstancewheretheamountascalculatedaboverepresentslessthan$5.00perfortnightnocontributionwillbepayablebytheEmployer:
(c)Absencesfromwork - Contributionsshallcontinuetobepaidonbehalfofaneligibleemployeeduringanyabsenceonpaidleavesuchasannualleave,longserviceleave,publicholidays,sickleaveandbereavementleave,butnoEmployershallnotberequiredtopaysuperannuationcontributionsonbehalfofanyeligibleemployeeduringanyunpaidabsencesexceptinthecaseofabsenceonworkers' compensation.

5.4.4Afternoonandnightduty - extrapayment(otherthanLevels4and5RegisteredNurse)
(a)Forthepurposeofclause5.4.4anafternoonshiftisashiftotherthananightshiftasdefinedherein,thatcommencesonorafter12midday.
Afternoonshiftworkersshallbepaidanallowanceof12.5%foreachshiftofordinaryhours.
(b)Nightshiftisashiftcommencingatorafter6.00p.m.orbefore7.30a.m.thefollowingday,themajorportionofwhichisworkedbetween6.00p.m.and7.30a.m.
Nightshiftworkersshallbepaidanallowanceof15%foreachshiftofordinaryhours.
(c)Theafternoonandnightshiftallowancesinclauses5.4.4(a)and5.4.4(b)donotapplytoshiftworkperformedonSaturdayorSundaywhenextrapaymentforweekendworkinaccordancewithclause5.4.3applies.
5.4.5Uniformsanduniformallowance
WheretheEmployerrequiresanemployeetowearauniform,theEmployershallsupplyfreeofchargeadesignateduniformofasuitabletypeordesign;orinlieuthereofpayanallowanceof$159perannumpayableonaproratabasiseachpayday.
UniformsshallbelaunderedbytheEmployeroranallowancebepaidof$3.70perfortnightwhichisnotpayableonannualleave.
WhereanEmployersuppliesauniformtoanemployee,subsequentissueshallbeonanasneedsbasis.
5.4.6Nightsupervisorallowance
(a)ARegisteredNursewhoisrequiredtoundertakethedutiesofNightSupervisorshallbepaidanadditionalamountpernightwhilstsoengagedof$7.69pernight.
(b)EmployeeswhopriortothemakingofthisAwardwerereceivingaNightSupervisorallowanceof$8.25pernightwillnothavethatallowancereducedasaconsequenceoftheoperationofclause5.4.6.
5.4.7Sleep-over
(a)WhereanemployeeisrequiredtosleepovernightontheEmployer'spremises,foraperiodnotexceeding8hours,anamountof$6.51shallbepaidinadditiontopaymentattheappropriateovertimerateshouldtheemployee'snightsleepbeinterrupted.
(b)Paymentshallbemadeattherateofaminimumof30minutes,howevershouldtheemployee'sinvolvementintheinterruptionexceed30minutes,thenthepaymentwillbemadeforthedurationoftheinterruption.
(c)Inadditiontothesleep-overallowance,theemployeewillbeprovidedwithaminimumof4hoursworktobecompletedimmediatelypriortoorafterthe8hourssleep-overduration.
5.4.8Part-timeandcasualemployeesprorataallowance
Unlessotherwisespecified,part-timeandcasualemployeesshallbeentitledtoanyallowancesapplicablebasedprorataonthenumberofhoursworkedinrelationto76hoursinanyfortnight.
5.5Paymentofwages
5.5.1(a)WagesshallbepaidfortnightlyunlessotherwisemutuallyagreedbetweentheEmployerandemployee.
(b)Subjecttoclause5.5.1(a),whenthenoticeofterminationofemploymenthasbeengivenbytheemployee,oranemployee'sserviceshavebeenterminatedbytheEmployer,paymentofallwagesandothermoniesdueshallbemadetotheemployeewithin2bankworkingdaysfollowingthetermination.
(c)Allwagesshallbecomepayablenolaterthanattheendofworkonthesecondnormalworkingday(asinaMondaytoFridayweek)followingthecompletionofafortnightlyroster-period. Shouldpublicholiday/soccurduringthe2workingdaysfollowingthecompletionofafortnightlyrosterperiod,paymentofwagesmaybedelayednolongerthantheperiodofsuchpublicholidays.
(d)Thepaymentofwagesmaybebychequeorelectronicfundstransfer,subjecttoagreedguidelines,whichensurereasonablegeographicaccessforstafftotheirwagesonpayday.
5.6Special/higherclassificationofwork
5.6.1Whereanemployeeisinstructedtoperformdutiesorrelieveanotheremployee,forwhichahigherrateofpayisprescribedinthisAward,andthedurationofrelievingworkisoneweek(7days)ormore,therelievingemployeewillbepaidthehigherrateforthedurationoftherelievingduty.
5.6.2AnyRegisteredNursewhoisnotpermanentlyonthestaffofanAgedCareResidentialFacilityandisemployedtorelieveaDirectorofNursing,shallbepaidnotlessthantherateprescribedbythisAwardfortheDirectorofNursingwhomthatemployeeisrelieving.
PART6 - HOURSOFWORK,BREAKS,OVERTIME,SHIFTWORK,WEEKENDWORK
6.1Hoursofwork
6.1.1Ordinaryhours(otherthanLevels4and5RegisteredNurse)
(a)Subjecttoclause6.1.6,andsubjecttotheexceptionshereinafterprovided,theordinaryhoursofworkshallbeanaverageof38hoursperweek,tobeworkedonthefollowingbasis:
152hourswithinaworkcyclenotexceeding28consecutivedays:
Providedthat,iftherearecompellingreasonstodoso,theUnionandtheEmployermayagreetovarythemethodofimplementationofthe38hourweekforindividualemployees,groupsorsectionsofemployeesinthefacilityconcerned.
(b)Theordinaryhoursofworkhereinshallbeworkedcontinuouslywithinadesignatedspreadof12hours,exceptformealbreaks,suchdesignated12hoursbeingbetween6.00a.m.and6.00p.m.
(c)TheordinarystartingandfinishingtimesofanemployeeoremployeesmaybestaggeredprovidedthatthereisagreementbetweentheEmployerandtheemployeesand/oramajorityofemployeesdirectlyaffected.
(d)Theordinaryhoursofworkforthepurposeofthisclauseshallnotexceed10hoursonanyday:
Providedthatwheretheordinaryworkinghoursaretoexceed8onanyday,thearrangementofhoursshallbesubjecttotheagreementoftheEmployerandthemajorityofemployeesconcerned.
6.1.2Roster
(a)Afortnightlyrostersettingouttheemployees' periodsofdutyandthestartingandfinishingtimesofsuchperiodsshallbedisplayedinaplaceconvenientlyaccessibletoemployeesatleast7daysbeforethecommencementofeachfortnight.
(b)Arostermaybealteredatanytimetoenablethenursingserviceofthefacilitytobecarriedonwhereanotheremployeeisabsentfromdutyonaccountofillnessorinanemergency.
(c)UnlesstheEmployerotherwiseagrees,anemployeedesiringtochangerostershallgivetheEmployer7days' noticeofdesiredrosterchangeexceptwheretheemployeeisillorinanemergency.
6.1.3Restday
(a)Employeesworkingthehoursprescribedbyclause6.1shallbeallowed4restdays(rostereddaysoff)duringeach14days. Eachrostereddayoffshallconsistofacontinuousperiodof24hours,whichwherepracticableshallincludefrommidnighttomidnight.
(b)Allfull-timeandpart-timeemployees' rosterswillprovideforanyoneofthefollowingcombinationsofdaysfreefromrosteredworkineachfortnight:
(i)2periodscomprising2dayseach;
(ii)3consecutivedaysandonestand-aloneday;or
(iii)oneperiodof4consecutivedays:
Providedthatanyoneofthesecombinationsmaybeamendedtoenable2singledaysfreefromrosteredworkifrequestedinwritingbytheemployee:
Providedfurtherthatwhereagreementunderclause6.1.5hasbeenreached,employeesshallbeallowedadditionalrestdaysinaccordancewiththerosteredhoursofdutyfortheparticularfortnight.
6.1.4Brokendutyperiods
Wherepracticable,nobrokendutyperiodsshallbeworked. However,whensuchbrokendutyperiodsarenecessary,atotalof8hoursshallonlybeworkedover2dutyperiodsandshallbeworkedwithinaspreadof12hours,of2equaldutyperiodsof4hourseach,oraperiodof5hoursand3hours.
BrokendutyperiodsshallonlybeworkedwherethereismutualagreementbetweentheEmployerandemployee. Wherebrokendutyperiodsarearegularfeatureofstaffrosters,theUnionandEmployerassociationmustbenotified.
6.1.510hourbreaksbetweenduty
(a)Employeesshallbeallowedabreakofnotlessthan10hoursbetweentheterminationofonedutyperiodandthecommencementofanotherdutyperiod:
Providedthatinlieuthereof,suchbreakshallnotbelessthan8hoursinanyofthefollowingcircumstances:
(i)topermitchangesofshiftrosters;
(ii)inanyothercaseagreeduponbytheemployeeandtheEmployer.
(b)WhereagreementhasbeenreachedbetweentheEmployerandtheemployeetoreducethe10hoursbreakbetweendutyperiodstoan8hourcontinuousbreak,dueconsiderationshallbegiventorecognisethatfatiguepreventionmustbe,atalltimes,paramounttoensurethatstandardsofresidentcarearenotreducednoraretheprincipalprioritiesassociatedwithnursingcareaffected.
6.1.6Implementationof38hourweek
Subjecttoclause6.1.7:
(a)The38hourweekshallbeimplementedbygrantingemployeesanaccrueddayoffonthefollowingbasis:
(i)byrosteringemployeesoff-onvariousdaysoftheweekduringaparticularworkcycle,sothateachemployeehasoneworkdayoffduringthatcycle;or
(ii)byfixingoneormoreworkdaysonwhichallemployeeswillbeoffduringaparticularworkcycle.
(b)Whentheordinaryworkcycleprovidesforanaccrueddayoff,theaccrueddayoffshallnotfallonapublicholiday. TheEmployerandemployeeshall,bymutualagreement,arrangeforanalternativeaccrueddayoff.
(c)Wherethearrangementofordinaryhoursofworkprovidesforanaccrueddayoff,theEmployerandeachemployeeineachsection,establishmentorunitconcernedmayagreetoaccumulateuptoamaximumof5daysoff.
(d)ConsenttoaccumulateaccrueddaysoffshallnotbeunreasonablywithheldbyeithertheEmployerortheemployees. Whereagreementisreachedtodeferoraccumulateaccrueddaysoff,paymentforworkonaccrueddaysoffwillbeatordinaryrates.
(e)Whereagreementinclause6.1.6(d)hasbeenreached,theaccumulatedaccrueddaysoffshallbetakenwithin12calendarmonthsfromthedateoftheentitlementtothefirstaccrueddayoff.
(f)Subjectto,andinaccordancewiththe12calendarmonthrequirementinclause6.1.6(e),anemployeemusttakeandexhaustallaccumulatedaccrueddaysoffpriortothetakingofperiodsofannualleave,butsuchaccumulatedaccrueddaysoffmaybetakeninconjunctionwithannualleaveand/orlongserviceleave.
(g)Subjecttoclause6.1.7,andwheretherearecompellingreasonstodoso,differentmethodsofimplementationofthe38hourweekmayapplytoindividualemployees,groupsorsectionsofemployeesinthefacilityconcerned.
6.1.738hourweek - proceduresforworkarealeveldiscussions
(a)TheEmployerandallemployeesconcernedineachsection,establishmentorunitshallconsultoverthemostappropriatemeansofimplementingandworkinga38hourweek.
(b)Theobjectiveofsuchconsultationshallbetoreachagreementonthemethodofimplementingandworkingthe38hourweekinaccordancewithclause6.1.6.
(c)Theoutcomeofsuchconsultationshallberecordedinwriting.
(d)FollowingconsultationwiththeEmployer,ifanemployeeorgroupofemployeesinaparticularfacilitywishtoworkthe38hourweekinamannerotherthanspecifiedinclause6.1.6theEmployershalladvisetheUnionoftheproposedalternatearrangementinwriting. TheUnionshallhavetherighttoconsultwithmembersconcerningtheintroductionoftheproposedalternatearrangement. TheUnionshallnotunreasonablywithholdapprovaloftheproposedalternatearrangementofworkinghoursasprovidedforinclause6.1.
(e)IntheeventthattheUnionwithholdsapprovalofanyalternativearrangementofworkinghours,suchrefusalmaybebroughtbeforetheCommissionasadisputeunderclause3.1withtheCommissiontohavetheabilitytodeterminetheactualmethodofworkinghours,baseduponthesubmissionsputtoit.
(f)Afterimplementationofthe38hourweek,upongivingofaperiodofnoticeequivalenttotherostercyclecurrentlyworked,orsuchshorterperiodasmaybemutuallyagreedupon,themethodofworkingthe38hourweekmaybealtered,fromtimetotime,providedthattheabovementionedstepshavebeencompliedwith.
6.2Mealbreaks
6.2.1Timingandduration
(a)Allemployeeswhoworkatleast6hoursonanyonedayshallbeentitledtoanunpaidmealbreakofnotlessthan30minutesandnotmorethanonehourwhichwillbetakenbetweenthe4thand6thhouraftercommencingwork.
(b)Whereanemployeeisrequiredtoworkduringamealbreakandcontinuouslythereaftertheyshallbepaidattherateofdoubletimeuntilreleasedfromdutyforamealbreak.
6.2.2Mealbreaks - employees(RegisteredNurseLevels1,2and3,EnrolledNurseandAssistantNurse)onduty
(a)Themealbreakfornursesondutyshallbetakenatatimenottoaffectthecontinuityofwork.
(b)Whereanemployeeisrequiredtoremainonthepremisesduringthemealbreakwhilstengagedonduty,theemployeeshallbepaidanallowanceof$7.84pershift. Shouldtheemployee'smealbreakbeinterruptedbyworkorinquiriespertainingtowork,thenthemealbreakshouldbepaidattheappropriateovertimerate.
6.3Restpauses
6.3.1Allemployeeswhoworkatleast4hoursonanydayshallbeentitledtoarestpauseof10minutes' durationintheEmployer'stimeinthefirstandsecondhalfoftheworkingday. Suchrestpausesshallbetakenatsuchtimesaswillnotinterferewiththecontinuityofworkwherecontinuityisnecessary.
6.3.2TheEmployermaysubstituteinlieuoftheforegoing,afterhavingregardtotheemployees' healthandwelfareaswellastakingtoaccountpeakworkloadperiods,onerestpauseof20minutesinthefirstpartoftheworkingday.
6.4Overtime(otherthanLevels4and5RegisteredNurse)
6.4.1Overtimeentitlement
(a)ForallauthorisedovertimeworkedinexcessofrosteredordinaryhoursofworkMondaytoSaturdayinclusive,paymentshallbemadeattherateoftimeanda-halfforthefirst3hoursanddoubletimethereafter.
(b)ForallauthorisedovertimeworkedonaSunday,paymentshallbemadeattherateofdoubletime.
(c)Forallauthorisedovertimeworkedonapublicholiday,paymentshallbemadeattherateofdoubletimeanda-half.
(d)Part-timeemployeesshallbeentitledtoovertimeinaccordancewithclause6.4.1:
Providedthattheordinaryworkinghoursforpart-timeemployeesshallbeasprescribedinclause4.1.2.
6.4.2Timeoffinlieu
(a)SubjecttomutualagreementinwritingbetweentheEmployerandtheemployee,anemployeemaybecompensatedforworkingovertimeinlieuofpaymentforsuchworkbybeingallowedtimeoffworkatthefollowingrate:
(i)thefirst3hoursofovertimeinanyonefortnightmaybetakenastherateoftimeworkedfortimetaken.
(ii)anyperiodinexcessof3hoursovertimeinanyonefortnightmaybetakenoffatarateequivalenttotheprescribedovertimepenalty.
(iii)shouldovertimeinexcessof3hoursbeconsecutivelyworkedonanyoneengagement,suchovertimeinexcessof3hoursshallbetakenatorpaidattherateofdoubletime.
(b)Anemployeeshallberequiredtoclearaccumulatedtimeoffinlieuwithinandnolaterthan3monthsoftheovertimebeingworked. Theemployeeshallbepaidfortheovertimeworkedattheappropriateovertimerateinthefollowinginstances:
(i)wheretheEmployerisunabletoreleasetheemployee;
(ii)atthetimeofterminationbyeitherpartyunderanycircumstances.
6.4.3Bankingarrangements
(a)SubjecttopriorapprovalbytheEmployer,anemployeemaybegrantedtimeoffnotwithstandingthatsuchtimehasnotbeenworkedasovertimeinaccordancewithclause6.4.2.
(b)TheEmployershallpaytheemployee'ssalaryasiftheemployeeworkedordinaryhoursduringsuchtimeoff.
(c)Whereanemployeetakestimeoffinaccordancewithclause6.4.2,theEmployershalloffertheemployeereasonableopportunitiestomakeuptheperiodoftimeoffinaccordancewithclause6.4.3within4weeksofthetimeoffbeingtaken:
Providedthatwheretheemployeehasbeenofferedreasonableopportunitiestomakeuptheperiodoftimeoff,anddoesnotmakeupthetimeoff,theEmployermayreducethepayoftheemployeebytheamountofsuchtimeofftakenafterhavingfirstadvisedtheemployeeinwritingatleast14dayspriortothereduction.
6.4.4Mealsandovertime
AnemployeewhoiscalledupontocontinueworkaftertheusualceasingtimeshallbesuppliedwithareasonablemealattheEmployer'sexpense,orbepaid$9.60inlieuthereof,aftermorethan2hoursoraftermorethanonehourifovertimecontinuesbeyond6.00p.m.inadditiontoovertimepaymentforthetimeworked.
6.4.5Breaksbetweenshiftsafterovertime
(a)Anemployeewhoworkssomuchovertimebetweentheterminationoftheirordinaryworkononedayandthecommencementoftheirordinaryworkonthenextdaythattheyhavenothadatleast10consecutivehoursoffdutybetweenthosetimes,shall,subjecttoclause6.4.5,bereleasedaftercompletionofsuchovertimeuntiltheyhavehad10consecutivehoursoffdutywithoutlossofpayforordinaryworkingtimeoccurringduringsuchabsence. If,ontheinstructionsoftheirEmployer,suchanemployeeresumesorcontinuesworkwithouthavinghad10consecutivehoursoffdutytheyshallbepaiddoubleratesuntiltheyarereleasedfromdutyforsuchperiod,andsuchemployeeshallthenbeentitledtobeabsentuntiltheyhavehad10consecutivehoursoffduty,withoutlossofpayforordinaryworkingtimeoccurringduringsuchabsence.
(b)Theprovisionsofclause6.4.5shallapplyinthecaseofshiftworkerswhorotatefromoneshifttoanotherasif8hoursweresubstitutedfor10hourswhenovertimeisworked:
(i)topermitchangesofshiftrosters;or
(ii)inanyothercaseagreeduponbytheEmployerandthemajorityofemployeesandifrequestedtheUnion.
6.5On-call(otherthanLevels4and5RegisteredNurse)
6.5.1Theprovisionshereunderapplytoemployeeswhoarerosteredtobeon-callattheirprivateresidence,oratanyothermutuallyagreedplace.
6.5.2Anemployeerosteredtobeon-callshallreceiveanadditionalamountasfollows:
(i)$16.54foreach24hourperiodorpartthereofwhentheon-callperiodisbetweenrosteredshiftsofordinaryhoursMondaytoFridayinclusive;
(ii)$26.87foreach24hourperiodorpartthereofwhentheon-callperiodisonaSaturday;Sunday,publicholidayorontheemployee'srostereddayoff.
6.5.3Paymentshallbecalculatedbyreferencetothatallowancespecifiedinclause6.5.2applicabletothecalendardayonwhichthemajorportionoftheon-callperiodfalls.
6.5.4Ifanemployeerosteredtobeon-callisrequiredtowork,suchworkshallberemuneratedattheappropriateovertimerate,inadditiontotheratesprescribedinclause6.5.2. Aminimumpaymentof3hoursattheappropriateovertimerateshallbepaid,providedthat,exceptinthecaseofunforeseencircumstancesarising,theemployeeshallnotberequiredtoworkfor3hoursiftheworkforwhichtheemployeewasrequiredandanyassociateddutyiscompletedwithinashorterperiod. Entitlementtosuchremunerationshallcommencefromthetimetheemployeestartswork.
6.5.5Anemployeewhoisrequiredtoworkshallbeprovidedwithtransporttoandfromtheirhomeorshallberefundedthecostofsuchtransport.
6.5.6Providedthatwhereanemployeeisrequiredtoworkwithin3hoursofcommencingnormaldutyandtheemployeeremainsatwork,theemployeeshallbeprovidedwithtransportfromtheirhometotheagedcarefacility,orshallberefundedthecostofsuchtransport.
6.5.7Anemployeeplacedon-callisrequiredtoremainattheirprivateresidenceoranyothermutuallyagreedplaceaswillenabletheEmployertoreadilycontactthemduringthehoursforwhichtheyhavebeenplacedon-call. Clause6.5.7shouldnotpreventtheprovisionbyEmployersofelectronicorotherdevicesbywhichtheemployeecouldbecontactedasanalternativetobeingstationedatanagreedplace.
6.5.8Anemployeeon-callwhousuallylivesoutandwhoisrequiredtoremainonclosecallwithintheagedcarefacilityprecinctsshallbeprovidedfreeofchargewithboardandlodging,inadditiontoanyallowancepayablepursuanttothissubclause.
6.6Re-call(otherthanLevels4and5RegisteredNurse)
Thefollowingprovisionsshallapplytoemployeeswhoarenotrosteredtobeon-call,butwhoarerecalledtowork:
6.6.1Anemployeewhoisrecalledtoworkshallbepaidattheappropriateovertimerate,withaminimumof3hours,providedthatthetimespenttravellingtoandfromtheplaceofdutyshallbedeemedtobetimeworked:
Providedthatwhereanemployeeisrecalledwithin3hoursofrosteredcommencementtime,andtheemployeeremainsatwork,onlytimespentintravellingtoworkshallbeincludedwithactualtimeworkedforthepurposeofovertimepayment.
6.6.2Exceptinthecaseofunforeseencircumstancesarising,anemployeewhoisrecalledtodutyshallnotbeobligedtoworkfor3hoursiftheworkforwhichtheemployeewasrecalledandanyassociateddutyiscompletedwithinashorterperiod.
6.6.3Ifanemployeeisrecalledtoworktheemployeeshallbeprovidedwithtransporttoandfromtheirhomeorshallberefundedthecostofsuchtransport:
Providedthatwhereanemployeeisrecalledtoworkwithin3hoursofcommencingnormaldutyandtheemployeeremainsatwork,theemployeeshallbeprovidedwithtransportfromtheirhometotheagedcarefacilityorshallberefundedthecostofsuchtransport.
6.6.4Theprovisionsofclause6.4.5shallnotapplywhenanemployeehasactuallyworkedlessthan2hoursononeormorecallouts.
PART7 - LEAVEOFABSENCEANDPUBLICHOLIDAYS
7.1Annualleave
7.1.1Everyfull-timeandpart-timeemployeeshallattheendofeachcalendaryearofemploymentbeentitledtoannualleaveonfullpayasfollows:
(a)Notlessthan6weeksifemployedonshiftworkwhere3shiftsperdayareworkedoveraperiodof7daysperweekandwhereanemployeeworksovermorethan2rosterperiodswhichinvolvesacombinationofday,eveningandnightshifts.
(b)Notlessthan5weeksinanyothercase.
(c)Anemployeewhoseemploymentisterminatedpriortotheexpirationofafullyearofemploymentshallbeentitledtoaprorataequivalentofannualleaveasprovidedforabove.
7.1.2Noticeofannualleave
(a)UnlessotherwiseagreedbetweentheEmployerandemployee,atleast4weeks' noticepriortothetimewhichtheannualleaveistocommencewillbegiven.
(b)Allannualleaveshallbetakenatatimetosuittheadministrationoftheagedcarefacility,butinexercisingitsdiscretiontheadministrationshallgivereasonableconsiderationtothepreferenceoftheemployee.
7.1.3Leavemaybetakeninparts
Annualleave,bymutualagreementbetweentheEmployerandemployee,maybetakeninoneormorepartsofnotlessthanoneweek'sduration.
However,uptooneweekofeachyear'sannualleaveentitlementmaybetakendaily. UnlessotherwiseagreedbetweentheEmployerandemployee,atleast7days' noticeofdailyleaveshallbegiven.
7.1.4Paymentofwageswhenemployeeisproceedingtoannualleave
(a)Whereanemployeeisproceedingtoannualleaveofmorethanoneweek'sdurationaftercompletingworkonaSaturday,Sundayorpublicholiday,theemployee'sentitlementsshallbemadeupto,andinclude,annualleaveentitlementsandpaymentforallworkcompletedonthelastweekdayofduty.

(c)Paymentforanyworkwithheldwillbeavailabletotheemployeenolaterthantheconclusionofthefirstdayofworkafterreturningfromleave. Wheretheemployee'spayismadecustomarilybyelectronictransfer,anyadjustmentthatisnecessarywillbemadeatthenextregularpaytransfer.
7.1.5Lessthan12monthscontinuousshiftworkcompleted
Anemployeewhoisnotacontinuousshiftworkerbuthasworkedasacontinuousshiftworkerforaportionofthe12monthspriortotakingannualleaveorwhohavingworkedasacontinuousshiftworkerresignsbeforethecompletionof12months' service,shallbeentitledtoadditionalannualleaveonaproratabasisonthetermsbelow,inrespectoftheperiodofworkperformedasacontinuousshiftworker:
Providedthatthefollowingminimumnumberofeachofthe3typesofshifthavebeenworked:
(a)uptoandincluding3months' service - noentitlement;
(b)from3monthsanduptobutnotincluding6months' service - 5ofeachshifttobeworked;
(c)from6monthsanduptobutnotincluding9months' service - 10ofeachshifttobeworked;
(d)from9monthsanduptobutnotincluding12months' service - 15ofeachshifttobeworked.
7.1.6Calculationofannualleavepay
Annualleavepayforfull-timeandpart-timeemployeesshallbecalculatedasfollows:
Theemployee'sordinarywagerate,asprescribedinclause5.1,fortheperiodoftheannualleave(excludingshiftpremiumsandweekendpenaltyrates);plus:
(i)Nightsupervisorsallowance,ifapplicable;plus
(ii)uniformallowance.
(b)Togetherwithafurther17.5%oftheamountsreferredtoinclause7.1.6(a). The17.5%additionalpaymentshallrelateto:
(i)5weeksinthecaseofemployeesentitledto6weeks' annualleave,assetoutinclause7.1.1(a);or
(ii)4weeksinthecaseofemployeesentitledto5weeks' annualleaveassetoutinclause7.1.1(b).
(c)Apart-timeemployee'sweeklyhours,forthecalculationofannualleavepayment,shallbeinthesameproportionastheaveragenumberofhoursworkedperweek,duringtheemployee'syearofemployment,equatesto38hoursperweek.
7.1.7Accrualofannualleave
Shouldanemployeehavenottakenannualleaveasitfallsduefromtimetotime,suchannualleave,bymutualarrangement,maybeaccruedforaperiodnotexceeding2years.
7.2Sickleave
7.2.1Entitlement
(a)Inrespectofemploymentonandafter1April1995,everyemployee,otherthanacasualemployee,shallbecomeentitledtonotlessthan76hourssickleaveforeachcompletedyearofemploymentwiththeEmployer:
ProvidedthatinrespectofanycompletedperiodofemploymentoflessthanoneyearwithanEmployerafterthatdate,anemployeeshallbecomeentitledto7.6hourssickleaveforeachonecalendarmonthofsuchperiod.
(b)Nopart-timeemployeeshallbeentitledtopaidsickleavewithineachyearofemploymentexceedingtheproportionof76hourssickpaythattheemployee'saverageweeklyworkinghoursequatedto38hoursperweek.
Apart-timeemployee'sentitlementtopaidsickleaveshallrelatetothenumberofhoursthatemployeewouldotherwisehavebeenrosteredtoworkonthedayordayswhensickleaveistaken.
7.2.2Proofofillness
(a)AnemployeeclaimingpaymentofpaidsickleaveforanabsencethroughillnesswillprovideproofofillnesstothesatisfactionoftheEmployer.
(b)Amedicalcertificatefromadulyqualifiedpractitionershallonlyberequiredwheretheabsencethroughillnessisgreaterthan2days.
7.2.3NoticetoEmployer
(a)EveryemployeeshallprovidereasonablenoticetotheEmployerofanyabsencefromworkthroughillness.
(b)AnEmployermayasaresultofsubstantialconcernovertheconsistentuseofpaidsickleaveandwhichisbasedonthenatureofitsoccurrence,durationandoverallpatternovera12monthsperiod,formallynotifythatemployeeinwritingthatsuchsickleaveusagewillbescrutinisedfromacertaindateforafixedperiodof6months.
(c)Theemployeeshallfirstbeaffordedanopportunitytoexpresswork-relatedcausesconsideredtocontributetothesickleavepatterns.
(d)Wheremisuseofpaidsickleaveovera12monthsperiodissoidentified,anEmployermayrequire,forallabsencesofanyduration,forthatemployeetoprovidemedicalcertificatesorotherproofofillnessofsatisfactiontotheEmployer.
(e)Inrequiringanemployeetoprovideamedicalcertificateorproofofillness,theEmployershallfirstexerciseequityandgoodconscienceinreachingthatdecision:
ProvidedalsothatanemployeewhoisaggrievedbytheEmployer'sdecisionmayseektheadviceandassistanceoftheUnion.
7.2.4Accumulationofsickleave
(a)Sickleaveshallbecumulative,butunlesstheEmployerandemployeeotherwiseagree,noemployeeshallbeentitledtoreceive,andnoEmployershallbeboundtomake,paymentformorethan13weeks' absencefromworkthroughillnessinanyoneyear.
(b)AnyabsencefromworkonleavegrantedbytheEmployershallnotbetakenintoaccountwhencalculatingtheemployee'speriodofemployment;norshallanemployee'saccruedsickleaveentitlements,atterminationordismissal,beforfeitedshouldtheemployeebere-employedbythesameEmployerwithinaperiodof3monthsfromthedateofterminationordismissal.
7.3Familyleave
TheprovisionsoftheFamilyLeaveAward2003applytoandaredeemedtoformpartofthisAward.
7.3.1Itistobenotedthat:
(a)part-timeworkcanbeperformedbyagreementinthecircumstancesspecifiedintheFamilyLeaveAward2003;
(b)acopyoftheFamilyLeaveAward2003isrequiredtobedisplayedinaccordancewithsection697oftheAct.
7.3.2TheFamilyLeaveAward2003alsoprovidesforthetermsandconditionsofleaveassociatedwith:
(a)Maternityleave
(b)Parentalleave
(c)Adoptionleave
(d)Specialresponsibilityleaveforthecareandsupportoftheemployee'simmediatefamilyorhousehold.
7.4Bereavementleave
7.4.1Full-timeandpart-timeemployees
Full-timeandpart-timeemployeesshall,onthedeathofamemberoftheirimmediatefamilyorhouseholdinAustralia,beentitledtopaidbereavementleaveuptoandincludingthedayofthefuneralofsuchperson. Suchleaveshallbewithoutdeductionofpayforaperiodnotexceedingthenumberofhoursworkedbytheemployeein2ordinarydaysofwork. ProofofsuchdeathistobefurnishedbytheemployeetothesatisfactionoftheEmployer.
7.4.2Long-termcasualemployees
(a)Along-termcasualemployeeisentitledtoatleast2daysunpaidbereavementleaveonthedeathofamemberoftheperson'simmediatefamilyorhouseholdinAustralia.
(b)A "long-termcasualemployee" isacasualemployeeengagedbyaparticularEmployer,onaregularandsystematicbasis,forseveralperiodsofemploymentduringaperiodofatleast1yearimmediatelybeforetheemployeeseekstoaccessanentitlementunderclause7.4.2.
7.4.3"Immediatefamily" includes:
(a)Aspouse(includingaformerspouse,adefactospouseandaformerdefactospouse,spouseofthesamesex)oftheemployee;and
(b)Achildoranadultchild(includinganadoptedchild,afosterchild,anex-fosterchild,astepchildoranex-nuptialchild),parent,grandparent,grandchildorsiblingoftheemployeeorspouseoftheemployee.
7.4.4Unpaidleave
AnemployeewiththeconsentoftheEmployer,mayapplyforunpaidleavewhenamemberoftheemployee'simmediatefamilyorhouseholdinAustraliadiesandtheperiodofbereavementleaveentitlementprovidedaboveisinsufficient.
7.5Longserviceleave
AllemployeescoveredbythisAwardshallbeentitledtolongserviceleaveonfullpayunder,subjectto,andinaccordancewiththeprovisionsofChapter2,Part3,sections42-58oftheActasamendedfromtimetotime.
7.6Studyleave
7.6.1Whereafull-timeemployeeiscompletinganapprovedcourseofpost-basicstudyanditisconsideredappropriatebytheEmployer,uptooneweekofhalf-paystudyleavemaybegranted. Half-pay,forthepurposeofclause7.6.1is50%oftheordinaryrateofpaypayabletotheemployeeortheQueenslandMinimumWage,whicheveristhegreater. Proratapaymentmaybegrantedtopart-timeemployees.
7.6.2AdditionalunpaidstudyleavemaybegrantedbytheEmployer.
7.6.3Whereanemployeeisreceivingpaidstudyleave,thereisnoobligationontheEmployertoprovidepaidIn-serviceTrainingoreducationforthatemployee.

(a)Allfull-timeandpart-timeemployeesshallbeentitledtobepaidafullday'swageforLabourDay(thefirstMondayinMayorotherdayappointedundertheHolidaysAct1983,tobekeptinplaceofthatday)irrespectiveofthefactthatnoworkmaybeperformedonthatday. However,shouldanemployeeworkonthatday,inadditiontoafullday'swage,theemployeeshallbepaidforalltimeworkedattherateoftimeanda-half,withaminimumof4hours,exceptinthecaseofnightdutywheretheworkcommencedonLabourDaycontinuesaftermidnight.
(b)ShouldLabourDayoccurduringanemployee'speriodofannualleaveanotherdayonfullpayshallbeaddedtotheemployee'sannualleave.

7.7.6Afull-timeorpart-timeemployeewhoisrosteredtoworkonadayoftheweekonwhichapublicholidayfalls,andwhoisnotrequiredtoworkonthatday,shallbepaidforthehourswhichwouldhaveotherwisehavebeenworkedonthatday.

9.1In-servicetraining

9.1.2In-servicetrainingmayincludeattendanceatworkshops/seminarsdevotedsolelytoskillrelatedcareerpaths,multi-skillingandbroadeningoftaskswhichemployeesmaybeexpectedtoacquireinenhancingflexibilityandtheefficiencyoftheindustry.
9.1.3Theworkshop/seminarsmaybeconductedbytheEmployerAssociations,theUnion,EmployerorotherorganisationsapprovedbytheEmployer.
9.1.4AnEmployergrantinganemployeeleavetoattendsuchworkshop/seminarsisrequiredtopaynomorethantheappropriateordinaryrateofwagesthatemployeewouldhavereceivedotherwiseforeachdayofattendanceattheworkshop/seminar. Wherethedurationoftheworkshop/seminarexceeds4hours,theEmployer'sresponsibilityforpaymentofwagesmaybehalved,asprovidedforinclause9.1.1,asareciprocalperiodoftime.
