Welcome to Perpetual Guardian’s EstatePlusService

By signing up to EstatePlus, Perpetual Guardian[1] is agreeing to provide you its EstatePlus service as set out below. The EstatePlus service is subject to the EstatePlus standard terms,Perpetual Guardian’sstandard terms of engagement and privacy policy.

1)EstatePlus Service

Upon your death, Perpetual Guardian will provide the following estate administration services (“EstatePlus Service”), without charging your estate for those services:

a)locate and liaise with your family following notification of your passing;

b)obtain a grant of administration including probate, if applicable, from the High Court (a legal authority to act in yourestate);

c)compile a list of assets and liabilities for the beneficiaries;

d)deal with the assets of your estate once Perpetual Guardian has a grant of administration. For example, closing bank accounts, redeeming investments, co-ordinating the sale of property and collecting proceeds of insurance policies;

e)pay debts out of your estate’s assets. For example, funeral costs and credit card balances;

f)finalise your taxation affairs including filing personal tax returns to date of death and dealing with any required estate tax returns from date of death to final distribution;

g)prepare financial statements for the estate and providing copies to the beneficiaries;

h)distribute the assets to your beneficiaries;and

i)transmission by survival of jointly owned New Zealand assets. These assets do not form part of the estate and will pass to the surviving owner(s);

Perpetual Guardian services and other costs that are not covered by the EstatePlus Service are set out in EstatePlus standard terms (over page).

2)Fees and Payment

a)The EstatePlus fee is $60 per annum (including GST) (“EstatePlus Fee”).

b)EstatePlus Fee is payable annually in advance by direct debit (see the accompanying direct debit form).

c)The EstatePlus Fee is subject to change in accordance with EstatePlus standard terms and conditions.

EstatePlus Standard Terms

1)EstatePlus Service Exclusions

The EstatePlus Service excludes:

a)costs and disbursements incurred by Perpetual Guardian in undertaking the EstatePlus Service including but not limited to court fees, bank charges and third party professional advisers fees (including but not limited to legal, tax, accounting whether these are provided by third parties or by Perpetual Guardian);

b)administering assets outside New Zealand;

c)defending legal claim(s) against your estateor instigating legal claim(s) in the name of your estate;

d)managing a dispute in respect of your estate;

e)the cost of managing a continuing estate (being an estate that establishes a testamentary trust) acknowledging that the executorship functions remain free of fees other than those in clause 1a) above; and

f)any other services performed by Perpetual Guardian not specifically referred to in the EstatePlus Service.

2)Executor

Where Perpetual Guardian is not named as executor in your will, Perpetual Guardian will assist and support your executor in providing the EstatePlus Service, as requested by your executor.

3)Fees and Payment

a)Perpetual Guardian reserves the right to vary the EstatePlus Fee from time to time, upon written notification to you.

b)We will inform you when your subscription is due for renewal including any change to the EstatePlus Fee.

4)Cancellation

a)Should you wish to cancel your subscription to EstatePlus Service, you may do so at any time by notifying us in writing. You may email us at . Upon cancellation, you will not be issued any refund.

b)If your subscription is cancelled or not current at the date of your death you will be charged in accordance with Perpetual Guardian’s standard terms, unless otherwise agreed in writing.

c)Perpetual Guardian reserves the right to cancel its EstatePlus Service in its entirety and/or renounce its executorship of your estate. If Perpetual Guardian exercises this right, you will not be issued any refund.

5)Variation

Perpetual Guardian’s EstatePlus standard terms are subject to change from time to time.

6)Other Services

In addition to the EstatePlus Services, by signing up to EstatePlus Service you will receive:

a)An annual update of your Will, if required;

b)Secure physical storage of your Will;

c)Access to MyDigitalVault, subject to WillPlus terms and conditions; and.

d)Bereavement Help service.
