3.01:ExaminationforPersonalRegistrationLicensureas aPharmacist

Inorder toberegisteredlicensedasapharmacistbyexaminationbytheBoard,anapplicantmustmeetthe requirementssetforthin247 CMR3.01(1)or (2).

(1)GraduatesofACPE-accreditedandBoard-approvedcolleges/schoolsofpharmacy:

(a)A graduateof anACPE-accreditedandBoard-approvedcollege/schoolofpharmacyAnapplicantshallbeeligibleforexaminationforpersonalregistrationlicensureasapharmacistprovided theapplicant:

(a)1.is18 yearsold bythescheduleddateoftheexaminationappliedfor;

(b)2.has earnedaqualifyingdoctor of pharmacydegreeinpharmacyfromacollege/schoolofpharmacyaccreditedbytheACPEorapproved bytheBoard;

(c)3.hascompleted a pharmacy internship in accordance with 247 CMR 8.01(1)acquirednolessthan1500hoursofpracticalexperienceasapharmacyinternunderthesupervisionofaBoard-approvedpharmacistpreceptor,ofwhichatleast1000 hoursmust becompletedinapharmacyorpharmacyrelatedsetting,assetforthin247CMR8.01; and

(d)4.isofgoodmoralcharacter.

(2)A graduate of a non-approved college/school of pharmacy shall be eligible for examination for personal registrationlicensureas a pharmacist provided the applicant:

(a)is18 yearsold bythescheduleddateoftheexaminationappliedfor;

(b)hasreceivedofficialForeignPharmacyGraduateExaminationCommittee(FPGEC) CertificationfromNABP;

(c)hassubmittedanofficialcopyoftheapplicant'sFPGECCertificatetotheBoard andtheBoardhasreceivedofficialnotificationfromtheNABPoftheapplicant'sFPGEC Certification;

(d)has completed a pharmacy internship in accordance with 247 CMR 8.01(1); and

(e)isofgoodmoralcharacter.

(3)(b)AnapplicantshallproperlyapplytotakeNAPLEXandMPJE.Acompletedapplicationforexaminationshall:

(a)1.befullyandcorrectlycompleted bytheapplicant;

(b)2.includearecentpassport-sizephotographoftheapplicantshowingtheapplicant’slikeness;

(d)4.inthecaseofanamechange,includeawrittennotificationtotheBoardortheBoard’sdesigneeofsuchnamechange;and

(e)5.beaccompaniedbyacheckormoney orderintheproperamountmadepayableasdirected ontheexaminationapplicationforminclude payment of all required fees, unless waived in accordance with M.G.L. c. 112, § 1B;

(4)(c)Anapplicant forpersonalregistrationlicensureasapharmacistmustpassbothNAPLEXandMPJE.

(5)(d)Toqualifyforpersonalregistrationlicensure,theapplicantmustachieveaNAPLEXscoreofnotlessthan75%andanMPJEscoreofnotlessthan75%.

(6)(e)AnapplicantwhofailstoachieveapassingscoreoneitherorbothNAPLEXorMPJEmaybere-examinedoneitherorbothexaminationsprovidedthattheapplicantsubmitsanewapplicationforexaminationtotheBoard orBoard-approvedtestingservice,accompaniedbypayment of all required fees, unless waived in accordance with M.G.L. c. 112, § 1Bacheck ormoneyordermadepayable,intheproperamount,tothe Board'sdesigneeasappearsontheexaminationapplicationform.

(7)(f)AnapplicantwhofailseitherNAPLEXorMPJEmustreapplyandtositfortheexaminationwhichtheapplicantfailedwithinoneyearoftheadministrationdate oftheoriginalexaminationinorderforbothexaminationscorestobeconsideredtogether.Iftheapplicantdoesnot passbothNAPLEXandMPJEwithinthisone-yearperiod,theapplicantmustapplytoretakebothNAPLEXandMPJE.

(2)Graduatesofnon-approvedcolleges/schoolsofpharmacy:

(a)Inorderforagraduateofanon-approvedcollege/schoolofpharmacyto beeligibletoapplyforexaminationfor personalregistrationasapharmacist,theapplicantshallmusthavereceivedForeignPharmacyGraduateExaminationCommittee(FPGEC)CertificationfromNABP.

(b)Anapplicantwhohasgraduatedfromanon-approvedcollege/schoolofpharmacyshallbeeligibleforexaminationforpersonalregistrationasapharmacistprovidedthefollowingrequirementsaremet:

1.theapplicantis18 yearsold bythescheduleddateoftheexaminationappliedfor;

2.theapplicanthasreceivedofficialFPGECCertificationfromNABP;

3.theapplicanthassubmittedanofficialcopyoftheapplicant'sFPGECCertificatetotheBoard;

4.theBoardhasreceivedofficialnotificationfromtheNABPoftheapplicant'sFPGEC Certification;

5.theapplicanthasacquirednolessthan1500hoursofpracticalexperienceasapharmacyinternunderthesupervisionofaBoard-approvedpharmacistpreceptor,ofwhichatleast1000 hoursmustbecompletedinapharmacyorpharmacyrelatedsetting,assetforthin247 CMR8.01; and

6.isofgoodmoralcharacter.

(c)Anapplicantwhohasgraduatedfrom anon-approvedcollege/school ofpharmacyshallproperlyapplytotakeNAPLEXandMPJE.Acompletedapplicationforexaminationshall:

1.befullyandcorrectlycompleted bytheapplicant;

2.includearecentpassport-sizephotographoftheapplicantshowingtheapplicant’slikeness;

3.includeacertifiedbirthcertificateor other sufficientproofofplaceanddate ofbirth;

4.inthecaseofanamechange,includeawrittennotificationtotheBoardorBoard’sdesigneeofsuchnamechange;and

5.beaccompanied byrequiredfee(s).

(d)Anapplicantforpersonalregistrationasapharmacistwhohasgraduatedfromanon-approvedcollege/school ofpharmacymustpassNAPLEXandMPJEinaccordancewiththerequirementssetforthin247 CMR3.01(1)(c)through(f).

(8)(3)TheBoardmayrefusetoconsideranyapplicationthat hasnotbeenproperlycompleted.

(9)(4)Allfeessubmitted to the Board in connection with an application for personal registrationlicensureas a pharmacist,reviewedandacteduponbytheBoard,arenonrefundable.

3.02:PersonalRegistrationLicensurebyReciprocity

TheBoardmaygrantpersonalregistrationlicensureasapharmacisttoan applicantwhofurnishesproofsatisfactorytotheBoardthattheapplicanthasbeen registeredlicensedbyexaminationinanotherstateorjurisdictionandthattheapplicantisingoodstandinginallstateswheretheapplicantholdsaregistrationlicense,providedthatsuchotherstateorjurisdictionrequiresadegreeofcompetencyequaltothatrequiredofapplicantsinMassachusetts,andprovidedfurtherthattheBoardrecognizestheotherstate orjurisdictionforpurposes ofpersonalregistrationlicensurebyreciprocity.

AnapplicantwhoseekspersonalregistrationlicensurebyreciprocityfromtheBoardshallsubmitapreliminaryapplicationtoNABPforlicensetransfer.NABP,asagentoftheBoard,willconductthepreliminaryevaluationofanapplicant’squalificationsforpersonalregistrationlicensurebyreciprocity.

(1)GeneralRequirements:

(a)Wheneveranapplicanthasbeen notifiedbyNABPthattheapplicantdoesnotmeettherequirements forpersonalregistrationlicensurebyreciprocity,theapplicantmayinwritingrequesttheBoard toreview thebasisofNABP’s decision.

(b)TheBoardshallmakethefinaldeterminationofanyapplicant’seligibilitytoberegistered asapharmacistbyreciprocity.

(c)Areciprocityapplicationshallbevalidfor oneyear afterthe date ofapprovalbyNABP.

(d)Allfees submitted totheBoardinconnectionwithanapplicationforpersonalregistrationlicensure by reciprocity,reviewedandacteduponbytheBoard,arenonrefundable.

(2)SpecificRequirementsforGraduatesofACPE-accreditedorBoard-approvedColleges/SchoolsofPharmacy.

(a)TherequirementsfortheissuancebytheBoardofapersonalregistrationlicense byreciprocitytoanapplicantwhohasgraduatedfroman ACPE-accredited orBoard-approvedcollege/schoolofpharmacyshallincludethefollowing:

1.NABPapproval;

2.documentationofintershipinternshipexperienceasrequired byin accordance with247 CMR8.01;

3.passingscore(atleast 75%)onMPJE; and

4.ifrequested,theapplicantshallpersonallyappearbeforetheBoardtodiscussanymatterrelatedtotheapplication.

(b)UponreceiptbytheBoardofevidenceofanapplicant’sNABPapprovalandpayment of all requiredfee(s), unless waived in accordance with M.G.L. c. 112, § 1Btheappropriate fee,theapplicantmayregisterwithNABPtotake MPJE.

(3)Specificrequirementsforgraduatesofnon-approvedcolleges/schoolsofpharmacy:

(a)Therequirementsfortheissuanceofapersonalregistrationlicensurebyreciprocitytoanapplicant who hasgraduatedfromanon-approvedcollege/schoolofpharmacyshallinclude:

1.ReceiptbytheBoardofanofficialcopyoftheapplicant'sFPGECCertificatefromNABP;

2.documentationsatisfactorytotheBoardofpracticalexperienceof internship experiencein accordance withasrequiredby247 CMR8.01;

3.passingscore(atleast 75%)onMPJE; and

4.ifrequested,theapplicantshallpersonallyappearbeforetheBoardtodiscussanymatterrelatedtotheapplication.

3.03:DuplicateCertificate of RegistrationLicensure

To request a duplicate certificate of personal registrationlicensure(wallet card), a registrant shall submit a Board-approved form and required documentation. In the event that an original certificate of registrationlicensureis recovered after a duplicate certificate has been issued, the duplicate shall be promptly returned to the Board.

3.04:Personal RegistrationLicensureRetirement

(1)A licensee who meets the eligibility requirements in 247 CMR 3.04(2) may submit a petition to the Board to request that his or her licensebe placed on retired status. A retired status is a nondisciplinary status. The Board may decline to review any petition for reinstatement or return to current status from any licenseewhose status has been changed to retired status.

(2)A licensee will be eligible to submit a petition for retired status, if her or she:

(a)has a license that is not surrendered, suspended or revoked at the time ofthe petition;

(b)demonstrates, to the board's satisfaction, that he or she intends to permanently retire from active practice in the Commonwealth and in all other jurisdictions;

(3)A licensee with a retired status may not practice.

(4)Nothing in this section shall prevent the Board from initiating, pursuing or taking a

disciplinary action against a licensee whose license is in retired status, including an action that imposes discipline or changes the status from retired to revoked or suspended, if the Board determines that such action is in the best interests of public health, safety or welfare.
