TERMS AND CONDITIONS FOR THE HIRING OF THE SANDTON HINDU SAMAJ HALL AND FOR THE RENTAL OF ASSOCIATED EQUIPMENT

1. GOODS NOT PERMITTED ON PREMISES:Meat products, alcohol, drugs, poisonous products, prescription medication, illegal or offensive items, firearms, fireworks, ammunition, explosives, weapons dangerous or counterfeit goodsare not permitted on the premises of the Sandton Hindu Samaj.

2. RELEASE:The Sandton Hindu Samajshall accept no responsibility or liability in respect of any damage to or loss of any property, articles or goods, of whatever nature, placed or left upon the premises by the hirer, or for the injury to or death of any person or damage to clothing of persons entering the premises or making use of equipment on the premises hired, and it shall be an explicit condition that the hirer indemnifies and holds the Sandton Hindu Samajharmless against any claim made by any person or persons on any grounds whatsoever.

The Sandton Hindu Samajshall not be liable for any loss suffered by the hirer as a result of any accident, breakdown, failure or defect in respect of any machinery, appliances, lighting equipment or arrangements thereof in the hall hired, or in respect of any other machinery, appliances or arrangement howsoever caused.

Parties contracting with the Sandton Hindu Samaj are responsible for the acts of their guests and of those providing hired services and will pay for any damage caused by them to the Sandton Hindu Samaj. Parties contracting with the Sandton Hindu Samaj will use their best efforts to ensure that their guests are familiar with the proper conduct expected of them in and around the Sandton Hindu Samaj.

The hirerand their guests and of those providing hired servicesshall indemnify and hold harmless the Sandton Hindu Samajfrom and against any claim against a judicial order, damages or otherwise and for costs, including attorney and client costs which may be instituted against the Sandton Hindu Samajby reason of any infringement by the hirer, employee, booking agent or employee of the hirer whilst using the hall, of the copyright in any form of any person or company and in the conduct (including external advertisement and broadcasting) of any performance, work or act therein.

3. CLEANING:The Hirer must keep the Sandton Hindu Samaj hall and the surrounding areas free from rubbish and litter at all times. All rubbish and accumulated must be removed from the Sandton Hindu Samaj and/or hall prior to the lessor vacating the premises on the day.

Caterers/ Florists/ Decorators/ Party Planners and other subcontractors must leave areaclean.

  • The Kitchen must be left in a neat and tidy manner.
  • Counters and all equipment must be thoroughly cleaned.
  • Trash and garbage must be removed from the hall and must be deposited in the bins on the premises.
  • Sandton Hindu Samajstaff will inspect the kitchen / work space after each event and may invoice the hirer for the cost of additional cleaning required.
  • All tables must be put in the storage space. Stack chairs along the wall on both side of the hall.
  • All Toilets must be left in clean and tidy state

4. CANCELLATIONS:The Sandton Hindu Samaj also reserves the right to cancel any booking in circumstances where a hirer has submitted false or misleading information. If the Sandton Hindu Samaj cancels a booking a refund will be given at the discretion of the Sandton Hindu Samaj Committee in line with the below schedule.

Should you move this event to another venue, or cancel this commitment for any reason, it is agreed that the following schedule represents damages paid to Sandton Hindu Samaj for cancellation of this agreement:

30 - 60 days prior to the event / 50% Refund
Less than 30 days prior to the event / NO Refund

5. ADVERSE WEATHER:

The Sandton Hindu Samajwill operate the Mandir in a variety of adverse weather conditions and Sandton Hindu Samajstaff or volunteers will remain in attendance irrespective of adverse conditions. There will be no refund for cancellations due to adverse weather.

6. FIRE HAZARD:Hirers that are operating an open flame fire to cook food are at the very least to know the location of the fire extinguishers that are located in the hall.

No Naked Flame(except for ceremonial fires) - other candles or sources of naked flame are not permitted,without prior approval of the Property Supervisor. Hirers must notify the Sandton Hindu Samaj at the time of booking if it is intended to use a naked flame in the building.

7. BREACH:Any breach of these Conditions by the hirermay, at the option of the Sandton Hindu Samaj, result in the booking being withdrawn and/or further bookings not being accepted.

8. SMOKING:No smokingis allowed within Sandton Hindu Samaj building or on our grounds. Smoking is only allowed within dedicated and/or permitted smoking areas.

9. USE OF BUILDING - The Hirer will need to set up any chairs and tables that theyrequire. They must make sure that these items are put away in theirdesignated area, after the function. Hirers must not dragtables and chairs across the floor and must stack chairs no more than ten high. All exits,corridors, lobby, and forecourts must be kept clear and free from obstructions.

You will need to control access to the kitchen at all times to ensure that you maintain hygiene regulations. For safety and insurance purposes, Hirers must not allow children in the kitchen area and they must leave floors, worktops and equipment in a clean, safe and tidy condition.

Before vacating the building, hirers must ensure that they securely close and lock all windows and doors. They must also turn off all taps, turn off and clean all kitchen equipment, remove all rubbish, switch off all lights, and check that everyone has left the building.

The Sandton Hindu Samajand its representatives shall have admission to the premises, or any part thereof, at all times.

10. LIABILITY OF HIRER FOR DAMAGES

The hirer shall be liable, and shall compensate for, any breakage or other damage of whatever nature to the hall, furniture, equipment or any other property of the Sandton Hindu Samaj that may have occurred during the period of hiring.

Should any furniture, equipment or any other property be found to be defective, damaged or broken, this shall be pointed out by the hirer to the Property Supervisorbefore being used, failing which, everything shall be considered as being in proper order. The hirer shall make good any article owned by the Sandton Hindu Samaj, lost or missing from the hall during, or in connection with any hiring out.

After every function, the hall shall be inspected by the Property Supervisorand the hirer or anyone authorised by him on his behalf, and any damage shall there and then be taken note of and deducted from the deposit paid by the hirer.

In the event that the deposit amount is not sufficient to cover the damages, the Sandton Hindu Samaj shall have the right to collect such amount from the hirer in any manner the Sandton Hindu Samajdeems fit and the hirer will be also liable for the collection costs including attorney costs on an attorney and client scale.

11. RESPONSIBILITY OF HIRER

The hirer shall be responsible for the due observance and the carrying out of the stipulation that no person shall be admitted to the hired hall, or having gained admission thereto, be permitted to remain therein if he is in a state of intoxication or behaves in an unseemly manner or is unsuitably or indecently dressed.

It shall be a condition of the agreement that the Property Supervisorshall have the right and power to eject from the hall any person who is in a state of intoxication or who behaves in an unseemly or offensive manner or who is unsuitably or indecently dressed.

12. OBSERVANCE OF MUNICIPAL BY LAWS

The hirer shall observe the provisions of any law and municipal by-laws in the conduct of the function, entertainment or performance for which the hall has been let to him and shall not permit or allow any breach thereof.

12. PARKING

Vehicles must be parked in designated parking spaces and during the designated times only. Vehicles found in violation of this will be towed at the cost to the owner. Vehicles may not park overnight. The Sandton Hindu Samajshall accept no responsibility or liability in respect of any damage to or loss to any vehicle parked on the property of the Sandton Hindu Samaj
