CHAPTER1.ADMINISTRATIVE OPERATIONS

SUBCHAPTER1.GENERAL PROVISIONS

490:1-1-2.Definitions

Thefollowingwordsorterms,whenusedinthisChapter,shallhavethefollowingmeaning,unlessthe contextclearlyindicatesotherwise:

"Accreditedcollegeoruniversity"meansacollegeoruniversitythatisdomiciledwithintheUnitedStates andthatisaccreditedby:theNorthCentralAssociationofCollegesandSchools,TheHigherLearning Commission;theSouthernAssociationofCollegesandSchools,CommissiononColleges;theWestern AssociationofSchoolsandColleges,AccreditingCommissionfor SeniorCollegesandUniversities;the NewEnglandAssociationofSchoolsandColleges,CommissiononInstitutionsofHigherEducation;the MiddleStatesAssociationofCollegesandSchools,MiddleStatesCommissiononHigherEducation;orthe NorthwestCommissiononCollegesandUniversities.

"Administrator-In-Training"or"AIT"meansanindividualservingaBoard-approvedinternshipwithinthe facilitytypeforwhichheisseekinglicensure/certificationunderthesupervisionofapreceptor'certified' bytheBoard. IndividualsservinganAITinternshipmayalsobereferredtohereinas'intern/trainee'.

"Administrator"meansanyindividualdulylicensedorcertifiedbytheBoardregardlessoftheroleor functionheperforms.

“Administrator of Record” or “AOR” means the administrator licensed by this Board who has the authority and responsibility for the total operation of the facility, subject only to the policies adopted by the governing authority.

"AdultDayCare(ADC)Administrator"meansalongtermcareadministrator(ordirector)dulylicensedby theBoardtoserveinthiscapacityinanAdultDayCareCenter. Thescopeofpracticeofanindividual licensedas anAdultDayCareAdministratorislimitedtoalicensedAdultDayCareCenter.

"AdultDayCare(ADC)Center"shallhavethesamemeaningassuchtermisdefinedintheAdultDayCare Act,Title63O.S.Section1-870etseq.

"Adverseaction"meansrevocationorsuspensionofalicense,reprimand,censure orprobation;anyother lossoforrestrictionplaceduponthelicense, including,butnotlimitedto therighttoapplyfor,orrenewa license;voluntarysurrenderinlieuofdiscipline,non-renewal(excludingnonrenewalduetonon-payment offees,orretirement);administrativefinesandanyother negativeactionorfindingbytheBoard.

"AssistedLivingCenter"shallhavethesamemeaningassuchtermisdefinedintheContinuumofCare and AssistedLivingAct,Title63O.S.Section1-890.1 etseq.AlsoknownasanAssisted LivingFacility(ALF).

"Board"meanstheOklahomaStateBoardofExaminersforLongTermCareAdministrators(OSBELTCA)or itsstaff.

"Certification"contextually,priortotheeffectivedateoftheserules,meanstheauthorizationgrantinga person theprivilegeofservingasalongtermcareadministratorandcontinuesuntillicensedin accordancewiththeserulesoruntilOctober1,2012,whicheveroccursfirst. Theexceptionisthecertified assistantadministrator(CAA) whichthisBoardcontinuestocertify. Certificationaftertheeffectivedateof theserulespertainstothecompletionoftrainingatanapprovedinstitutionofhigherlearningorother bodyconductingsuchtraining(exceptAdministratorUniversityforNursingHome Administratorsand BoardconductedtrainingforAdultDayCareadministrators). Theinstitution orbodycertifiesthatthe individualhasbeenproperlyandcompletelytrainedandisprepared,asaprerequisite,forthestate standardsexamand/orNABRC/ALexam.CertificationoftrainingisastepinthelicensureprocessforRC andRC/ALlicensure.

“Certified Assistant Administrator (CAA)” or"Assistant Administrator" asusedhereinmeansanindividualwhohasbeen 'certified'bytheBoardas havingmettheminimumqualifications establishedbythe Boardto beabletoserveas afull-time, Certified AssistantAdministratorin alicensedlongtermcarenursingfacility,andwhoactsunderthedirection, supervisionandlicenseofalicensednursing homeadministrator whoisthe"Administrator-of-Record"at two-or-moremore than one licensedfacilitieswhicharelocated within a50-mileradiusofeachotherand. whereinthetotal occupiedbedcountdoesnotexceed120beds.

"ContinuumofCareFacility"shallhavethesamemeaningassuchtermisdefinedintheContinuumof CareandAssisted LivingAct,Title63O.S.Section1-890.1 etseq.

"Degreeequivalencyevaluation"meansanequivalencyevaluationofadegreethatwasearnedfrom a collegeor university notdomiciledintheUnitedStatesagainstadegreeearnedfroman'accredited collegeoruniversity'(seedefinitionearlierherein)thatisperformedbyoneofthefollowing:

(A) EducationalCredentialEvaluators(ECE)
(B) Educational Records Evaluation Service(ERES)
(C) InternationalEducation ResearchFoundationCredentialsEvaluationService (IERFCES)
(D) WorldEducationServices(WES)

"FormalComplaint"meansaformalallegationbytheBoardthatprobablecauseexiststhatanindividual licensedasalongtermcareadministratorhasviolatedapplicablestatutesand/orrules.Theseallegations arewritteninalegaldocumentfiledwiththeBoardbyitsprosecutingattorney.

“Health Services Executive” or “HSE” means a broad-based NAB verified qualification which exceeds this Board’s standards to be licensed as a nursing home administrator (NHA). It is not a license and it does not grant the holder of this qualification any additional privileges with the NHA license.

"IntermediateCareFacilityfortheMentallyRetarded(ICF/MR)"meansafacilitywhoseprimarypurposeis toprovidehealthandrehabilitativeservicesforpersonswithmentalretardationor arelated condition, andotherwisemeetstheConditionsOfParticipation(COPs)foundat42CFR§483.400etseq.ICF/MRis synonymouswiththetermICF/IID(intermediate carefacilityforindividuals withanintellectualdisability).

"IntermediateCareFacilityfortheMentallyRetarded,16Beds andLess(ICF/MR-16)"meansafacility withsixteen(16)orfewerlicensedresidentbedsthatservespersonswithmentalretardationorwith relatedconditionsandthatotherwisemeetstheConditionsOfParticipation(COPs)foundat42CFR §483.400etseq.

"LapsedLicenseorExpiredLicense"meansalicensethatisnolongervalidbecausethelicenseefailedto renewhis/her licensebytherenewal deadline,causingthelicensetolapseorexpire.

"License"meansthewrittenauthorizationoftheBoardgrantingapersontheprivilegeofservingasa longtermcareadministrator foraspecificperiodof time,andfurther,alegalinstrumentobligatingthat persontoadheretotherules,regulations andstatutesthatgovernthelicense.

"LicensingYear"shallmeanthespecificperiodoftimealicense/certificationissuedbytheBoardisvalid. ForpurposesoftheseRules,theterm"licensingyear"shallhavethesamemeaningas"calendaryear,"the timeperiodbeginningat12:01a.m.,January1,andendingas of12:00midnight,thesameDecember31.

"LongTermCare"primarilyforthepurposesofthisboard,asusedherein,includescaregivenat facilities wherealicensedlongtermcareadministratorisrequiredsuchas anursingfacility,assistedliving facility,residentialcarefacilityoranadultdaycarecenter.Itdoesnotencompasstemporarycare situationssuchasaswingbed hospital.

"NationalAssociation ofLongTermCareAdministratorBoards"("NAB")iscomposedofstateboardsor agencies responsibleforlicensinglongtermcareadministrators. ThebasicobjectiveoftheNAB isto assisttheseboardsandagenciesincarryingouttheirstatutoryand regulatoryresponsibilitiesinthe licensure,re-licensureandregulationoflongtermcareadministrators. OneofNAB's functionsisthe developmentandadministrationofthenationallongtermcareadministratororNursingHome Administrator(NHA)examination,aswellastheResidentialCare/AssistedLiving(RC/AL)examination.

"NABDomainsofPractice"referstothetasksperformedbyalongtermcareadministratorandthe knowledge,skillsandabilitiesidentifiedbyNABasnecessarytoperformthosetasksinitsprofessional practiceanalysis. TheNABDomainsofPracticecanbefoundontheNationalAssociationofLongTerm CareAdministratorBoards(NAB)websiteat

"NotificationbyOSDH"referstotheOSDH(OklahomaStateDepartmentofHealth)notifyingtheBoardof surveyresultsofanursingfacilitythatincludeasubstandardqualityofcarecitation. Anotificationmay becomeareferral.

"NursingHome,andNursingFacility,LongTermCareFacility,SpecializedHome,andSpecializedFacility"shall havethesamemeaningsasthetermrefer to both "Nursing Facility"and “Specialized Facility” assuchtermisterms are definedintheNursingHomeCare Act,Title63O.S.Section1-1901etseq.and/orasdefinedat 42CFR§483.1 etseq.

"NursingHomeAdministrator(NHA)" meansalongterm careadministrator dulylicensedbytheBoard toserveinthiscapacityinanursing facility, nursinghome,skillednursingfacilityoranysimilarlyworded facilitytype. TheirscopeofpracticeincludesICF/MR,RCF,ALFandAdultDayCareCentersandthetermis synonymouswithnursingfacilityadministrator.

"Preceptor"meansanindividualqualifiedbytrainingandexperience,whoiscurrentlylicensedasalong termcareadministratorinOklahoma,is'certified'bytheBoardasaqualifiedpreceptorandischarged with coordinatingthe training of anAITintern/trainee whoisenrolledinaBoard-approvedAdministrator-in­ Training(AIT)internshipprogram.

"Probation"isacondition(s)imposedforaspecifiedperiodoftimeattheinitialissuanceofalicenseor containedinanorderresultingfromacomplaintagainsttheadministrator.

"Provisionallicense"meansthetemporaryauthoritytoserveasalongtermcareadministratorasgranted bytheBoardtoanindividualofgoodcharacterwhomeets appropriateconditionsandrequirements prescribedbytheBoard.

"RC/ALAdministrator"meansalongtermcareadministrator duly licensed by theBoardtoservein thiscapacityineitheranRCForALF. ThescopeofpracticeofanindividuallicensedasanRC/AL administratorislimitedtoeitheralicensedResidentialCareFacility(RCF)oralicensedAssisted Living Facility(ALF).

"ReferralorReport"meansanissueorconcernregardingalongterm careadministrator thathasbeen reducedtowritingandisforwardedtotheBoardforadetermination astowhetheraviolationofthe Board'sRuleshasoccurred. Suchreferralorreportmaybemadebyanindividualoragency.

"ResidentialCare(RC)Administrator" meansalongterm careadministrator dulylicensedbythe Boardto serveinthiscapacityinonlyanRCF. Thescopeofpracticeofanindividuallicensedasa ResidentialCareAdministratorislimitedtoalicensedResidentialCareFacility(RCF).

"ResidentialCareHome"or"ResidentialCareFacility(RCF)"shallhavethesamemeaningassuchterm isdefinedintheResidentialCareAct,Title63O.S.Section1-819etseq.

"RevocationorRevokedLicense"isasanctionimposeduponalicense/certificatebytheBoardthatresults inacompletelossoflicense/certificateandallprivilegesattendanttheretoandrequiresholderto surrenderhislicense/certificate, theannuallicense/certificationrenewalcardandallotherlicenseor certificate-related documentstotheBoard.

"Specializedfacility"shallhavethesamemeaningassuchtermisdefinedintheNursingHomeCareAct, Title63O.S.Section1-1901etseq.

"SuspensionorSuspendedLicense"isasanctionimposeduponalicense/certificatebytheBoard. The licenseeretainshislicense/certificateandhisannualrenewalcardandthereforemustrenewthelicense, yetheshallnotfunctioninthecapacityasalongtermcareadministratoruntiltheBoarddeterminesthat conditionsresponsibleforthesuspensionnolongerexist,anyorallotherrestorationrequirements imposedbytheBoardhavebeenmet,andtheBoardhasrestoredhisstatus.

490:1-7-2.Scheduleof fees

(a)InitialLongTermCareAdministratorLicense-$200.00

(1) This licensure fee applies to all original licensures and certifications.
(2) The initial license will expire on December 31st of the year it was effective.

(b) AnnualRenewalsfees

(1)NHALicense -$200.0000 per year;

(2)CertifiedAssistant -$75.0000 per year;
(3)RC/ALLicense -$175.0000 per year;

(4)RCLicense-$100.0000 per year;

(5)ADCLicense -$100.0000 per year;

Subchapter9. ContinuingEducation

490:1-9-2.Criteriaforcontinuingeducationprograms

(a)InorderfortheBoardtoapproveaprogramforcontinuingeducationhours,anapplicationshallbe completedbythesponsorandreviewedandapprovedbytheBoard.

(b)Sponsorsshallsubmittheir applicationtotheBoardatleast30daysinadvanceoftheprogram, providedhowever,shouldtheBoardfail tomeetthroughlackofaquorumorothercircumstance,the applicationwillbereviewedatthenextmeetingoftheBoardandifapproved,hourswillbeawarded retroactively.

(c)Theapplicationshallcontaindocumentationthatcertifiesthefollowingcriteriaare beingmet:

(1) TheprogramshallrelatetoLongTermCareAdministrationandbedesignedtopromote continuedknowledge,skillsandattitudesconsistentwithcurrentstandardsinlongtermcare administration.

(2) Theprogramshallbedesignedtoassistadministratorstoimprovetheirprofessional competencies.

(3) TheprogramshallbeopenandavailabletoalllongtermcareadministratorsinOklahoma.

(4) Thefacilitywheretheprogramwillbeconductedshallprovideadequatespaceto accommodatepotentialattendees andhavetheabilitytosupplytheneededequipment.

(5)Thefaculty/instructors musthaveexperienceinlongtermcaresupervisionandadministration, or haveexpertisein teachingandinstructional methods suitableto thesubjectpresented,or havesuitableacademicqualificationsandexperienceforthesubjectpresented.

(6) Thelearningobjectivesintheprogrammustbereasonableandclearlystated inbehavioral termswhichdefinetheexpectedoutcomesforparticipants.

(7) Thelearningobjectivesmustbeconsistentwiththeprogramcontentandthemechanismby whichlearningobjectivesaresharedwithparticipantsmustbeidentified.
(8)Theteachingmethodsin theprogrammustbeclearlystated,mustbeappropriatetothe subjectmatter,andmustallowsuitabletime.

(9)Instructionalaidsandresourcematerialsthatwillbeutilizedintheprogrammust
bedescribed.

(10) Sponsorsshouldbequalifiedinthesubjectmatterpresented. TheBoard,initssole discretion, mayapproveprograms fromanaccreditededucationalinstitution,aprofessional associationand/ortradeassociation,aprivateeducationalgroup,orastateagency,orfrom anothersourceiftheprogramcontentisdeemedtobeofsufficientvaluetoOklahomalongterm careadministrators.

(11)Theregistrationfeeforaprogrammustbepublishedclearlyonpromotional
material.

(12)RegistrationfeesmaybereviewedbytheBoard.

(13)ThesponsormustallowtheBoardtoevaluatetheprogram.

(14)Thesponsormustprovideanevaluation form,approvedbythe Board, foreachprogram participant'sresponses.

(15)Within15daysaftertheconclusionoftheprogram,thesponsorof Board approved programs (not NAB/NCERS approved programs) mustprovidetotheBoarda listofparticipantsandasummaryoftheevaluationsforeachprogram. NAB/NCERS approved sponsors will use the NAB CE Registry to report attendees for those programs.

(16)TheapplicationpresentedtotheBoardmuststatethemethodtobeusedin certifying attendanceoron-linecompletion.

(17) Toreceivefullcredit,attendeesmustattendthefullprogramand/orlog-in foron-line attendanceforthefullprogram.Seealso490:1-9-1(j).

(18) Partialcreditofaminimumoftwoclockhoursmaybeearnedinadivisible
program.

(19)Instructionalhoursmustbebased uponclockhours(60minutes= 1clockhour).

(20)Theagendamustshowregistration,mealtimes(notincludedincredithours),anda breakdownofthedailyeducationalactivities.

(21)Themaximumnumberofhoursthatcanbeapprovedorearnedshallbesevenclockhoursper day.

(22) Thetargetgroupforprogramsshallbelongtermcareadministrators andotherdisciplines relatedtolongtermcare.

(23)Licensedadministratorswhoare"presenters"ofapprovedCEprogramsmayreceivecredit onetimeannuallyfortheclockhourvalueoftheclass(es)theypresent.Ifthematerialispresented multipletimes,creditisonlyawardedonceperlicensureyearforthesameeducationalmaterial.

(24)LicensedadministratorswhopresentinAdministratorsUniversity(AU)orotherBoard approvedentryleveltrainingsuchasRC,RCALorAdultDayCareinitiallicensuretraining,will receiveCEcreditonetimeannuallyfortheclockhourvalueofthematerialtheypresent.
