Declaration of No Conflict of Interest and confidentiality for the involvement in ESPON EGTC activities
I hereby engage myself to respect the following principles confirming that:
a) The principle of no conflict of interest implies that I cannot be involved in activities in the implementation of ESPON EGTC activities where a conflict of interests exists.
b) For the purposes of paragraph a), a conflict of interests exists where the impartial and objective exercise of the activities is compromised for reasons involving family, emotional life, political or national affinity, economic interest or any other shared interest with a recipient.
c) To the best of my knowledge and belief, that there are no facts or circumstances, past or present, or that could arise in the foreseeable future, which might call into question my independence in the eyes of any party involved.
d) To the best of my knowledge and belief that I will assure to declare without delay any conflict of interest with regard to the operators whether as individuals or members of a consortium/proposal, or as subcontractors, which
- participate in the procurement procedure or other procedures related to the activities for which I am member and/or
- submit a tender/proposal for this activity.
e) If I discover or should it become apparent during the course of the evaluation process or the performance of other tasks that such a conflict exists or has arisen, I will declare it immediately to the ESPON EGTC, and if a conflict of interests is found, I will cease to take part in the implementation of the related activity.
f) I will keep all matters entrusted to me strictly confidential and not disclose to any third party any sensitive information or document that is revealed to me, in particular as part of the preparation of terms of references and the public procurement process, and I will not make any adverse use of the information given to me.
g) I acknowledge that I am liable in case of breach and the ESPON EGTC is not liable.
h) I acknowledge that Luxembourg tribunals are competent to decide on potential conflicts related to this declaration and its breach.
