NOTICE OF RULEMAKING: ADOPTION OF PENDING FEE RULE AND TEMPORARY RULE

EFFECTIVE DATE: The effective date of the temporary rule is (include effective date here). This pending rule has been adopted by the agency and is now pending review by the (year) Idaho State Legislature for final approval. Pursuant to Section 67-5224(5)(c), Idaho Code, this pending rule will not become final and effective until it has been approved by concurrent resolution of the legislature because of the fee being imposed or increased through this rulemaking. The Pending rule becomes final and effective upon adoption of the concurrent resolution or upon the date specified in the concurrent resolution unless the rule is rejected.

AUTHORITY: In compliance with Sections 67-5224 and 67-5226, Idaho Code, notice is hereby given that this agency has adopted a pending and temporary rule. The action is authorized pursuant to Section(s) (include the specific statutory authority for rulemaking), Idaho Code, and (include any citation to a federal statute or regulation if that is the basis of authority or requirement for the rulemaking).

DESCRIPTIVE SUMMARY: The following is the required finding and concise statement of its supporting reasons for adopting a temporary rule and a concise explanatory statement of the reasons for adopting the pending rule. No changes have been made to the pending rule that differs from the proposed rule text.

In accordance with Section 67-5226, Idaho Code, the full text of the temporary rule is being published in this Bulletin following this notice. There are no changes to the pending rule and it is being adopted as originally proposed. The original text of the proposed rule was published in the (Bulletin publication date) Idaho Administrative Bulletin, Vol. (include the volume number), pages (include the page numbers).

TEMPORARY RULE JUSTIFICATION: Pursuant to Section(s) 67-5226(1) (include appropriate section(s) a, b, and/or c), Idaho Code, the Governor has found that temporary adoption of the rule is appropriate for the following reasons:
