Minutes of the Regular Council Meeting

April 8, 2010

CALL MEETING TO ORDER

Mayor Mary Jo Dylla called the meeting to order at 7:30 pm.

ROLL CALL AND ESTABLISH A QUORUM

Roll call was taken. Members present were Councilman Walter Wyrwich, Councilman Justin Jones, and Councilwoman Susann Baker. Councilman Dwayne Padalecki, Councilman Francisco Arevalo and the city secretary were out. A quorum was established.

READING AND APPROVAL OF MINUTES

Council read over the minutes of the regular city council meeting of March 4, 2010.

Councilwoman Susann Baker moved to accept the minutes as written. Councilman Walter Wyrwich seconded the motion. All were in favor; the minutes were approved.

APPROVAL OF FINANCIAL SUMMARY

The financial summary was tabled until next month.

REPORT FROM VFD

Fire Chief Larry Padalecki attended the ESD tonight, so the report from the VFD will be tabled until next month.

REPORT FROM CODE COMPLIANCE

Kathy Palmer said she had a report of a sign that went up on at LaVernia Road and FM1346 within our city limits. It was a big for sale sign that was spray painted in red ‘Land for Sale’ on Adkins/St. Hedwig Rd. The City took it down since it was in our right of way and we will be watching to see if it comes back up.

We had a citizen complain about property on Pittman Road where there is trash, standing water causing mosquitoes, and things along this line. The citizen wanted to know what things we had in place in the zoning ordinance regarding health and safety. Mrs. Palmer asked her to attend the meeting so it would be on record, but she said she is never in town. Mrs. Palmer asked that she write a letter to make sure she includes the name and address and they will see what they can do; at the very least we can send a letter.

There was another sign that came up on E. Lupon Road that is a business sign that is in a residential area and in the city right of way. Mrs. Palmer is currently trying to contact that citizen to let them know it needs to come down.

Kathy reported that there have been a lot of frequently asked questions regarding code compliance, so Mrs. Palmer decided to put a page on the website pertaining to this.

REPORT FROM PLANNING AND ZONING

Kathy Palmer reported for the Planning and Zoning Commission. The Planning and Zoning meeting will be next Thursday, April 15th. They will be discussing the contents of the Subdivision Ordinance and updating any changes that have occurred since adoption.

Abbott Estates are in the process of receiving addresses from CPS Energy. Apparently they have lost the original plat and are waiting for addresses from CPS. They will be giving us a copy along with the field notes, hopefully within the next couple of weeks.

CITIZENS TO BE HEARD

Kenneth Mihalski commented on the great job that MD Systems did for the City on the Spring Clean Up Day. He said they had a large showing, but MD picked everything up. Kenneth said they left the place spotless.

Charles Mikolajczyk Jr. is a resident nearby in Adkins. He said he will be around for awhile because he said there are some items that he doesn’t agree with city council or the P&Z Commission. He said he has issues that are unresolved that deal with Texas Statutes Ch. 211 and 212, and he will be here the next few months.

Rogelio “Roger” Lopez, Jr. introduced himself. He said he is our Justice of the Peace, Precinct 4 Judge. He said our court is located at the corner of 87 and 410. He said the court handles traffic violations, truancy, civil disputes up to $10,000, landlord/tenant disputes and game and fish violations. Judge Lopez welcomes input; he has an open door policy in his court, and if you have any ways to improve our system or how to keep our kids in school, let him know.

Runoff elections are this Tuesday, April 13th. Mr. Lopez said it is very important to get out there and vote.

OLD BUSINESS

A.  ROADS

1. GENERAL ROAD MAINTENANCE

Councilman Justin Jones reported for the roads. The patching part of the roads is completed with the exception of the stripe patching. We are still working on ordering signs and replacing them.

One 18 yard load of road base was delivered and spread at the 13287 block of Adkins/St. Hedwig Road with the help of E.J. Cielencki.

The road repairs on Felix Road were completed by Plates Backhoe Service. The entire length of the road was reworked with a maintainer and required two 18 yard loads of road base.

The landowner on 14031 LaVernia Road had issues with his culvert. The concrete apron is crumbling due to lack of steel in the slab. This is a 48 inch culvert with 2 AT&T phone cables running through the culvert. He will be getting with Texas Road Repair to get their professional assessment of the problem area. In Councilman Jones’s opinion, the culvert would need to be extended by another 4 feet and the existing concrete apron will have to be removed and replaced with a new one that will extend down both sides of the pipe in order to keep it from breaking down in the future.

There is still some debate being done regarding the 3 roads Councilman Jones selected to be resurfaced as to expand the scope of the work. The roads are North Gable from the intersection of E. Gable all the way to Martinez Creek Bridge, which is approximately 6,240 linear feet of road work. Some areas of that road need to be taken down to the base. The next road would be Kusmierz, from Abbott Road to 1518, which is 4,390 linear feet. Finally, Miller Road from Graytown to the Martinez Creek Bridge, which is approximately 12, 227 linear feet. Councilman Jones stated that there are long stretches of this road that will be improved with a seal coat while there are some significant areas that will require going down to the road base.

Councilman Padalecki made the suggestion from a previous conversation that we structure the bid request as 3 separate projects for simultaneous release, which Councilman Jones believes this will be a good idea to give us the most flexibility with how to proceed with the process.

B.  CITY PARK

Councilwoman Susann Baker ordered the plaques that she spoke about at the last city council meeting. They are very inexpensive but shows who donated the bench.

Mrs. Baker wanted to add to the agenda for next month discussion for the next section of the sidewalk.

Mayor Dylla said she knew of someone who offered their services free to the city for architectural drawings.

NEW BUSINESS

a.  WASTE RENEWAL AGREEMENT BID PACKETS GO OUT THIS MONTH

Bid packets were mailed out on April 1st to several contractors. The ad will go out for 2 weeks in the Wilson County News and we will be opening bids at the May meeting.

ANNOUNCEMENTS

·  The Mayor announced that our census rep has been at the City Hall every Monday and Thursday from 5:00 pm till 7:00 pm. The rep will only be here until Monday, April 19th. If you need a census form, please pick one up and send it back.

·  There will be no city election in May. No one signed up to run against the present council.

·  The Planning and Zoning Meeting will be here Thursday, April 15th at 7:00 pm.

·  East Central School Foundation Gala will be held Saturday, April 10th. The Mayor has raffle tickets if anyone is interested.

·  CPS Energy will start installing decorative lighting with no cost to the City. It will start at the grooved pavement at Pittman Road. The Mayor said TX Dot will be coming in to adjust Pittman Road to lower it down a little bit because of the water standing there. There will be a concrete apron that will continue on down by the Roberson’s. This will improve the drainage through there since it is such a low lying area.
