General Facilities Application Instructions

Authority

California Education Code Section 8278.3 established the Child Care Facilities Revolving Fund (CCFRF) to provide funding for the purchase of new relocatable child care facilities for lease to school districts and contracting agencies that provide child care and development services. The CCFRF is administered by the California Department of Education (CDE), Child Development Division (CDD).

Application

The completion of the CCFRF General Facilities Application, Form CCFRF-1B, constitutes an application for funding from the CCFRF for the lease-purchase of relocatable child care facilities. All funds advanced from the CCFRF must be repaid by the school district or contracting agency (hereafter shall be referenced as “contractor”) over ten years, with no interest. The CCFRF is not a grant program.

Contractors must submit a separate application for each relocatable building project. Contractors may apply for as many buildings as they need; however, no one contractor may receive more than 10 percent of the CCFRF funds available in any given fiscal year.

  1. Submit one application for each relocatable building project.
  1. Complete both Parts A and B of the application.
  1. Sign the application. An original signature is required.

Eligibility

To be eligible for CCFRF funding, contractors must: (1) be currently under contract with CDE’s CDD to provide subsidized child care and development services and (2) be considered by the CDE to be in good standing.

Instructions for Completing the Application

Type of Application

Indicate whether this is a new application or an amendment to an existing application. If amended, list the CCFRF project number or the CCFRF contract number for the existing application.

Part A. Project Information
Contractor Information

Enter the following:

  • The legal name of the contractor
  • The vendor number for the contractor
  • The mailing address, city, and zip code of the contractor
  • The contractor’s contact person, title, telephone and fax numbers, and e-mail (all CCFRF program correspondence will be sent to the contact person)
Proposed Child Care Facility Information

Enter the following:

  • The name of the proposed child care facility
  • The name of the legal owner of the land on which the relocatable building will be placed
  • The street address, city, and zip code of the proposed facility or site where the relocatable child care building will be located
Amount Requested

The contractor may apply for the Maximum Allowance, and the amount may be amended at a future date based on the project’s actual costs. All costs must be justified by the architect’s certification of final costs, approved by the CDD, and subject to the Maximum Allowance defined in the CCFRF Contract and Lease to Own Agreement. Contractors may choose one of the two following options:

Option 1: Basic Building

The Maximum Allowance is up to $210,000 for a single freestanding relocatable building consisting typically of three 12 by 40 foot sections, including architect and inspection fees, site development, and site improvement costs.

  • Enter the amount requested.
Option 2: Enhanced Building

For each additional 12 by 40 foot section beyond the basic building as described above, an additional allowance of up to $70,000 may be requested for each additional section added to the enhanced building to increase capacity and serve additional eligible children.

Enter the following:

  • The amount requested
  • The planned size of the building in square feet
  • The number of 12 by 40 foot sections needed to construct the building

Complete the accompanying Multiple Classroom Building Allowance (MCBA) application form and submit it with the General Facilities Application.

Snow Load

Contractors located in higher elevations, receiving levels of snow during winter months, may apply for an additional allowance of up to $15,000. Contractors must show justification for this allowance.

Present Need

To be eligible for the CCFRF, contractors must certify they have a present need due to at least one of the reasons listed. Check all applicable boxes to indicate the present need.

  • Class Size Reduction (CSR) or Other Displacement: The child care program has ended, been moved, or reduced due to class size reduction or other displacement.
  • Program Expansion: The child care program has expanded and will serve additional eligible children currently not served by the program.
  • Replacement/Health and Safety: The current facility is substandard and/or must be replaced for health or safety reasons.

Number of Children Proposed to be Served by Program Type

Indicate the following:

  • Number of subsidized children your agency serves for each child care program(s) administered by the CDD
  • Total number of non-subsidized children your agency serves (this category includes children not funded by any of the CDE subsidized programs)

Note: At least 50 percent of the children served in the CCFRF facility must be subsidized

children.

Part B. Certifications

Contractors

Contractors must certify they currently provide subsidized child care and development services under one of the programs administered by the CDD.

Use of the Facility

Contractors must certify the funds applied under the CCFRF shall be used primarily for child care and development services to subsidized children for the entire lease period. It is acceptable to serve both subsidized and non-subsidized children in the facility funded by the CCFRF; however, at least 50 percent of the children served in each facility must be in a subsidized child care and development program administered by the CDE.

Public Land

Contractors must certify the facilities acquired under the CCFRF shall be placed on public land. Exceptions may be made if there is no available space on public land and there are no available child care and development services in the area to be served. To qualify for an exception, the contractor must attach the Request for Public Land Exception for Relocatable Buildings, form CCFRF-15, to the application. If the required justification form is not included as appropriate, the application form will be returned to the contractor which could result in delays in processing the contractor’s CCFRF application.

Site Availability

Contractors must certify the proposed site is available to be used for the placement of the facility funded under the CCFRF for the term of the CCFRF Contract and Lease to Own Agreement. If the contractor does not own the land on which the relocatable building will be placed, a copy of a ground lease between the contractor and the property owner of the site must be submitted to the CDD for approval prior to release of funds. The ground lease must be no less than ten years from the start of repayment and shall include time for construction phases.

Excess Costs

Contractors must certify they have, or have access to, sufficient funds to pay any project-associated costs in excess of the specified Maximum Allowance. Any excess costs must be funded by the contractor.

Non-Discrimination Compliance

Contractors must certify they have, unless exempt, complied with the non-discrimination program requirements of the applicable California Government Code Section 12990(a-f) and California Code of Regulations, Title 2 as specified.

CCFRF Contract and Lease to Own Agreement

Contractors must certify they understand this application will become a part of the CCFRF Contract and Lease to Own Agreement and will be considered a binding commitment.

Significant changes to the project must be made by amending the application and approved by the CDE. Significant changes include, but are not limited to, changes in proposed facility name/location and size of the project. Contact the CDD staff identified in this document if the application must be amended.

Code Compliance Certification and Signature

All contractors must certify the accuracy of the information in the application and contractor’s compliance with relevant codes and regulations. The person signing the application must be the authorized agent of the governing board of the contractor, and in signing the application, certifies under penalty of perjury the information in this application is true and correct and that the contractor will comply with all relevant local, state, and federal statutes and regulations.
