MEMORANDUM OF UNDERSTANDING
This Memorandum of Understanding (“MOU”) will take effect on the 26th day of November, 2014.
BETWEEN:
The Office of the Commissioner of Official Languages of Canada
AND:
The Office of the French Language Services Commissioner of Ontario
AND:
The Toronto 2015 Organizing Committee for the Pan American and Parapan American Games (“TO2015”)
(“Participants” means the Office of the Commissioner of Official Languages of Canada, the Office of the French Language Services Commissioner of Ontario and TO2015 and “Participant” means any one of them.)
1. INTRODUCTION
1.1 Toronto will host the 2015Pan American and Parapan American Games (“the Games”) in the summer of2015. The Games will be the largest international multisport events ever held in Canada and will showcase the Greater Toronto Area and leave a lasting legacy. In their respective capacities as language rights ombudsmen, the Commissioner of Official Languages of Canada and the French Language Services Commissioner of Ontario view the Games as an excellent opportunity to work together with TO2015 to promote linguistic duality, a key component of Canadian and Ontarian identity, in advance of and during these highly anticipated Games.
2. OBJECTIVE AND SCOPE
2.1 This MOU is intended to record the agreement reached between the Participants to work together in promoting and ensuring the bilingual nature of the Games, while respecting linguistic duality within the limits of their respective mandates in accordance with the contractual agreements set out in ScheduleA.
3. PARTICIPANTS’ GUIDING PRINCIPLES
3.1 The Office of the Commissioner of Official Languages of Canada is guided by the Official Languages Act of Canada, which serves to:
- ensure respect for English and French as the official languages of Canada;
- ensure equality of status and equal rights and privileges as to the use of English and French in all federal institutions;
- support the development of English and French linguistic minority communities; and
- advance the equality of status and use of the English and French languages.
3.2 The Office of the French Language Services Commissioner of Ontario is guided by the French Language Services Act of Ontario, which serves to:
- recognize the cultural contribution of the Francophone population and preserve it for future generations;
- protect the Francophone minority in Ontario;
- promote French and its equality with English; and
- ensure that everyone has the right to communicate in French with and to receive available services in French from any head or central office of a government agency or institution of the Legislature.
3.3 TO2015, as a signatory to the 2015 Pan Parapan American Games Multi Party Agreement dated November5,2009, acknowledges that Canada’s official languages are English and French and therefore, in that light, will:
- undertake to communicate with and serve members of the public and participants in both English and French,
- take into account the needs of official language minority communities in developing and delivering its programs and services, and
- without limiting the foregoing, comply with Canada’s Official Languages Requirements set out in AnnexE (as attached in ScheduleB).
3.4 The Office of the Commissioner of Official Languages of Canada and the Office of the French Language Services Commissioner of Ontario, with the cooperation of TO2015, in the spirit of this MOU, agree to the complaints-processing mechanism set out in ScheduleC in order to resolve complaints that arise in advance of and during the Games.
4. FINANCIAL PROVISIONS
4.1 The present MOU will not impose any financial responsibilities on the Participants, except that each Participant will be responsible for the funding costs it incurs in its own interest as they relate to the implementation of this MOU.
5. MECHANISMS AND LIAISON
5.1 The Participants will meet at an opportune time to discuss information sharing and identification of strategic approaches of shared interest.
5.2 To effectively implement this MOU, the Participants will identify resource persons from their respective teams and ensure that this information is kept up to date (list of current resource persons is attached in ScheduleD).
6. INTERPRETATION
6.1 Any question about the interpretation or implementation of this MOU will be resolved through consultation between the Participants.
7. CONFIDENTIALITY
7.1 The implementation of this MOU will comply with the applicable legislative requirements in terms of disclosure of information gathered or created in the course of the Participants’ respective activities and with data security policies. Each Participant is responsible for the security and integrity of the data and information in its possession.
8. MODIFICATION
8.1 This MOU may be modified at any time with the written consent of the Participants.
9. REVIEW
9.1 This MOU will be reviewed six (6) months from the effective date in order to take stock of results obtained.
10. TERM/TERMINATION
10.1 The term of this MOU shall commence on the date it is signed and will terminate on December31,2015, unless earlier terminated in accordance with Section10.2. The Participants may agree to extend the term of this MOU.
10.2 Each Participant may terminate its participation in this MOU by providing sixty (60) days’ written notice to the other Participants or upon the written consent of the three Participants.

ANNEX E OF MULTI PARTY AGREEMENT
CANADA’S OFFICIAL LANGUAGE REQUIREMENTS
Hostco (TO2015) will ensure that:
a) There is sufficient capacity in Canada’s official languages, among its employees and volunteers, giving due recognition to the magnitude and complexity of the Games and the minority official language capacity available in Toronto and the Golden Horseshoe.
b) Members and organizations of the official language minority community are actively involved;
c) A language services coordinator is designated to oversee the implementation of these requirements;
d) All material it provides, distributes or authorizes to inform the general public, the participants or media prior to, during and after the Games is available simultaneously in Canada’s official languages;
e) Permanent and temporary signage at all sites, including the naming or renaming of a new or renovated facility which has been funded in whole or in part by Canada associated with, installed or authorized by Hostco (TO2015) for the duration of the Games, is in Canada’s official languages;
f) Written documentation providing administrative information to the athletes, coaches, technical officials and other delegation members (guides, manuals, schedules, instructions, etc.) is disseminated simultaneously in Canada’s official languages;
g) All information on its official website is made available and updated simultaneously in Canada’s official languages;
h) Opening and closing ceremonies will be staged in a manner that both of Canada’s official language communities are included and represented in the development, the production and use of talents. Further, the national anthem is sung in its bilingual version;
i) All public address announcements related to the Games are made consecutively in Canada’s official languages;
j) All security, emergency and medical services, and services provided by the Hostco (TO2015) or on behalf of Hostco (TO2015) to the athletes, coaches, technical officials, other delegation members and public are available at all times in both of Canada’s official languages; and
k) Any events, cultural festivals or displays occurring before, during or after the Games and sponsored or promoted as part of the Games include presence of both of Canada’s official languages in the development, the production and the use of talent.
SCHEDULE C
COMPLAINTS PROCESS
THE PURPOSE OF THIS SCHEDULE IS TO CLARIFY THE OPERATIONAL PRINCIPLES THAT WILL BE APPLIED WHEN HANDLING COMPLAINTS AND REQUESTS FOR INFORMATION AND INTERVENTION
1) The public may make a request for information, file complaints with, or seek intervention from either of the Commissioners’ offices, according to the jurisdiction of each.
2) Upon receiving a complaint or a request for information or intervention, representatives from the Commissioners’ offices will immediately hold a discussion to decide on the best approach to adopt.
3) Given the limited duration of the events, once TO2015 is informed of a situation related to the implementation of its language commitments, it will take, in a timely manner, the necessary measures, as appropriate, to correct the situation and to avoid a reoccurrence.
4) The signatories, along with their respective counterparts, agree to work together and coordinate their efforts to contribute to the success of the Games while promoting Canada’s linguistic duality.
5) An action plan for the implementation of these principles shall be drafted by the Participants.
