IMPORTANT IMMIGRATION NEWS!!:
“Some Illegal Immigrant Detainees May Be Now Eligible for Release From Detention”A new policy shift was announced by President Obama’s Administration to potentially release thousandsof illegal immigrants now being detained at detention facilities across the country, if the immigrants can prove they have a potential path to legal residency and have no criminal history. To prove eligibility for release, these illegal aliens detained would have to meet two qualifications: A.that they already had an approved, by USCIS, an ImmigrantVisa Family Based or Employment BasedPetition AND B.that under the Immigration and Nationality Act, they are not “inadmissible”. This comesafter push by Immigration Custom Enforcement (ICE) to focus on detaining/deporting illegal immigrants who have committed crimes, rather than seeking to deport all illegal immigrants. EL SALVADORAN INTERIM WORK PERMIT
On March 8, 2011, USCIS announced that El Salvadoran TPS beneficiaries will receive interim Employment Authorization Documents (EADs)/work permits during the continued processing of their re-registration applications. These interim EAD’s will allow TPS beneficiaries to continue working while USCIS completes the processing of their re-registration applications. The original expiration date for Salvadoran EADs was September 9, 2010 but USCIS has automatically extended this validity period to March 9, 2011.
IMPORTANT REMINDER
It is important that you renew you work permit 4 months in advance from its expiration. The government is taking more than 3 months to adjudicate work permit applications (I-765 Employment Authorization Documents) so please don’t delay! For H-1B extensions, you need to file the application 6 months in advance. If you have questions, please contact our office.
