LEGAL CRITERIA
1. Authority for the waiver: Specific code section: EC 60422(c)(1) through (3)Section 60422(c) The State Board of Education may grant the school district additional time to meet the purchasing requirements of subdivision (a) if the governing board of the school district demonstrates, to the satisfaction of the state board, that all of the following criteria apply to the district:
The school district has implemented a well designed, standards-aligned basic instructional materials program.
The school district, at the time of its request for additional time pursuant to this subdivision, has sufficient textbooks or basic instructional materials for use by each pupil.
The school district has adopted a plan for the purchase of standards-aligned instructional
materials in accordance with subdivision (a) but the plan indicated an alternative date for compliance that is declared in the request for additional time.

(a) A local governing board shall use funding received pursuant to this chapter to ensure that each pupil is provided with a standards-aligned textbook or basic instructional materials, as adopted by the State Board of Education subsequent to the adoption of content standards pursuant to Section 60605 for kindergarten and grades 1 to 8, inclusive, or as adopted by the local governing board pursuant to Sections 60400 and 60411, for grades 9 to 12, inclusive. Pupils shall be provided with standards-aligned textbooks or basic instructional materials by the beginning of the first school term that commences no later than 24 months after those materials were adopted by the State Board of Education.
5. Desired outcome/rationale. Give a general description of what adoption you want to postpone and the reason:
Kings Canyon Joint Unified School District wishes to postpone the 2008 Reading Language Arts adoption 19 months, and start the 2010-11 school year with the new RLA adoption and professional development in place to support teachers and students. The district is currently using state-adopted materials from the 2000 list, Houghton-Mifflin California Edition for grades K through 5 and Prentice Hall for grades 6 through 8. These materials provide full coverage of the Reading Language Arts Content Standards. These materials are still in good condition and school sites and teachers have recently, within the past 2 years began using the instructional resources with fidelity. In addition our English Learner instructional resources are Avenues (K-5), Shining Star (6-8) and Visions (9-12).
The percentage of KCUSD students scoring Proficient or Advanced has steadily increased from 34% in 2005-06 to 37% in 2007-08. The district submitted a copy of its sufficiency resolution KCUSD Board Approved October 21, 2008 for 2008-09, stating that its students have sufficient instructional materials.
During the 2007-08 Math Adoption, the district adopted new math curriculum for kindergarten through high school Algebra and all teachers are participating in SB 472 math training during the fall of 2008. This intensive five day training will be completed during the first three months of school has allowed teachers to learn all the components of the program while actually using the resources with their students. It is important to consider the critical importance of both the English Language Arts and Math adoptions as these are the two high stakes content areas as measured by the AYP under NCLB.
KCUSD also wishes to adopt the necessary instructional resources and have the funds to provide for the professional development to support their implementation. Having the year between the math adoption and the RLA adoption will provide the fiscal resources to accomplish this goal.

· Convene the Primary and Secondary RLA Adoption Committees and use the Tool Kit to establish KCUSD priorities.
· The committees make their selections and the texts are ordered in the early spring of 2011.
· District wide implementation of the new RLA Adoption Fall 2011.
· There will be SB 472 training for all KCUSD staff implementing the RLA curriculum for Reading Language Arts during the first trimester of 2011.
