Planning Commission Minutes

December 4, 2007

The West Nottingham Township Planning Commission held its regular monthly meeting on Tuesday, December 4, 2007, at the Municipal Building, 100 Park Road, Nottingham, Pennsylvania.

The meeting was called to order at 7:30 p.m. by Chairman, Neal Camens, followed by the Salute to the Flag.

November 6, 2007 MINUTESA motion to approve the minutes, as presented, was made by Dennis Byrne, seconded by Robert Rohrer. All in favor. Motion carried.

Welcome to new Planning Commission member

Chairman, Neal Camens and all members welcomed Jim Lewis to our Planning Commission.

Mr. Lewis was appointed by the Supervisors to fill the vacancy left by Adam Sapp.

Herr Foods—Manufacturing Plan (Preliminary / Final Plan

Mr. Drew Blank from Herr Foods gave an update on Planning Module Component 3 Section F. He explained the Department of Environmental Protection has required a letter from the township stating there is no problem with the change Herr Foods has made to their new plant. Since the original Sewage Module was submitted, Herr Foods has decided to add a second line. Therefore DEP asked to have a new narrative. Jim Gade has reviewed the narrative and sees no problem.

A motion to recommend the Board of Supervisors write a letter acknowledging revised narrative (November 20, 2007), new product line, no increase in original sewer flow and Township has no problems with this change, was made by Robert Rohrer, seconded by Neal Camens. Dennis Byrne abstained because employee of Herr Foods. Motion carried.

Recycling Ordinance Discussion

Supervisor David Ross explained that Act 140 of November, 2006 requires townships receiving recycling grants of more that $14,000.00, must have a Recycling Ordinance. After much discussion, it was decided that Recycling Coordinator, Robert McMahon and Supervisor, David Ross will rework the ordinance and continue discussion with the Planning Commission at the January, 2008 meeting.

Subdivision Projects

George W. Thompson, Jr. (Final Plan)—Joint with East Nottingham Township

·  Extension 19 February, 2008 accepted by Twp.

Bruce Vanderhoef (Final Plan) new

**Plan reviewed and accepted by Planning Commission.

OTHER PLANNING ISSUES

Village Vision Meetings—October 22 & November 13

Review and update will be given at the Task Force meeting on Monday, December 10.

R. Samuel McMichael Fireworks Retail Store (Final Plan)

·  Jim Gade, Township Engineer, is waiting for further information from Solicitor.

R.S. McMichael Industrial Park Subdivision (Sketch Plan)

·  Taken off agenda until further information received.

Wicklow Land Development (Subdivision)

·  Jim Gade just received a copy of packet submitted to Penn DOT. No change in original plans. Everyone is aware of the impact it will have on the intersection at Route 272 and Old Baltimore Pike. Mr. Gade feels we must put the burden on the applicant for a solution and bring it to Penn DOT.

·  Mr. Gade stated his review letter requires applicant to contribute to traffic solutions. Much discussion followed.

·  Mr. Gade has also gotten information from the Oxford Area Sewer Authority that is going to require “sewage needed” information from developers before the township approve the Preliminary Plan.

OTHER BUSINESS

CVS Update

·  Supervisor, David Ross reported the Supervisors voted to settle litigation with CVS. The plan will not be sent back to the Planning Commission for comment. This will still have to be agreed upon by CVS and Jim Mark.

·  There was also a question about the proposed light at Rt. 272 and Old Baltimore Pike having a light for emergency vehicles with the new firehouse in Nottingham.

·  Mr. Gade will check on proposal for the light.

Oxford Region Multi-Municipal Comprehensive Planning Committee.

December 5—6:30 p.m. - Public meeting at Herr Foods Visitor Center. Everyone urged to attend and express their ideas, especially the transportation needs.

Sewer Presentation by Rising Sun Officials

Supervisors have told Rising Sun the township is interested. Supervisor David Ross has had two follow up meetings and is trying to get officials from the PA Department of Environmental Protection (DEP) and Maryland Department of Environmental Protection together for discussion. The Act 537 plan has a 60 day extension until first part of January so it gives the township time to pursue information from Rising Sun.

Change of January, 2008 meeting

The meeting will be changed to January 8, 2008. It was agreed that the meeting will stay on the first Tuesday at 7:30 p.m. Secretary will inform the Township Secretary of the change and ask her to advertise the change.
