VIETNAM POLICY AND REGULATORY UPDATE

  1. Decree No 121/2008/QD-TTg of December 3, 2008, on investment activities in the Post and Telecommunications sector, provides for conditions on direct investment in various forms in the post and telecommunications sector for business purposes.This Decree applies to domestic and foreign investors making investment activities in the post and telecommunications sector in the Vietnamese territory; and organizations and individuals involved in investment activities in the post and telecommunications sector.
  2. Directive No. 34/2008/CT-TTg of December 3, 2008 On promoting the use of the e-mail system in the operation of state agencies to assure conditions for the operation of the e-mail system in state agencies at all levels.
  3. Decision No. 155/2008/QD-TTg of December 1, 2008 on Approving the plan on adjustment of local fixed telephone service charges. This Decision regulates Local fixed telephone services provided at public service places or to major customers, enteiprises and service resale.
  4. Circular No. 05/2008/TT-BTTTT of November 12, 2008, on Guilding a number of articles of the Government’s decree No. 97/2008/ND-CP of August 28, 2008 on the Management, Provision and Use of Internet services and electronic information on the internet. This guidline instructs details of the Internet services for users and providers.
  5. Circular No. 07/2008/TT-BTTTT of December 1S3 2008, Guiding a number of contents of the Government's Decree No. 97/2008/ND-CF of August 28, 2008, on the management, provision and use of Internet services and information onthe Internet regarding the supply ofinformation on blogs. This Circular instructs the responsibilities of the users and enterprises providing a social network services.
  6. Circuiar No. 09/2008/TT-BTTTT of December 24, 2008, on guiding the management and use of Internet resources. This Circular guides regulations on the management and use of Internet resources with respect to all organizations and individuals involved in Internet-related activities in Vietnam.
  7. Circular No. 10/2008/TT-BTTTT of December 24, 2008 on Providing for the settlement of disputes over Vietnam's country code domain name '.vn' This Circular provides for the settlement ofdisputes over domain names arising in theprocess of using domain names of different levelslower than Vietnam's country code domain name".vn" (below referred to as domain names);grounds for settlement of disputes over domainnames; forms of settlement of disputes overdomain names, and disposal of disputed domainnames.This Circular applies to plaintiffs anddefendants involved in the settlement of disputesover domain names arising in the use process.
  8. Circular No. 12/2008/TT-BTTTT of December 30, 2008, guiding the implementation of a number of provisions of the Government's Decree No. 90/2008/ND-CP of August 13, 2008, against spam. This Cicular guides in detail the issuance, extension and withdrawal of management codes; responsibilities of relevant parties and reporting and statistics regulations relatively with anti-spam regulations.
