Guidelines for Child Labor Requirements
THE FAIR LABOR STANDARDS ACT
The following document is a summary of the key requirements of Part 570 of the FLSA which regulate the employment of minors under the age of 18.
PROHIBITED EMPLOYEMENT for minors 16 & 17 years of age:
- Motor vehicle OPERATION or outside work on any public road or highway. Note: Vehicle operation may be permitted if vehicle operated does not exceed 6,000 pounds and vehicle operation is restricted to daylight hours only. The operation of power driven mowers such as riding power mowers, golf course mowers, etc., is permitted at ages 16 & 17, except on public roadways.
- Work involving the operation of power-driven woodworking machines including the supervising or controlling he operation of the machine, feeding material into such machines, and helping the operator to feed material into such machine (power saws, lathes, drill press, planers, routers, chippers, etc.).
- Operation of or assisting in the operation of an elevator, crane, hoist, high lift truck, or derrick.
- Riding on a manlift or on a freight elevator.
- Operating, assisting to operate, setting up, adjusting, or repairing any horizontal or vertical mixers or bakery machines.
- Operating or assisting to operate any power driven paper products machinery, such as arm-type wire stretcher or stapler, circular or band saw, corner cutter or mitering machine, corrugating and single or double facing machine, envelope die cutting press, guillotine paper cutter shear, horizontal bar scorer, laminating or combing machine, sheeting machine, scrap paper baler or vertical slotter.
- Operating a platen die cutting press, platen printing press or punch press.
- Operator of or helper on power driven fixed or portable machines.
- All work involved in wrecking, demolition, and shipbreaking operations.
- All work involved in roofing operations.
- Working on excavation operations, including excavating, working in or backfilling trenches, excavating for buildings or other structures, or working in such excavations, working within tunnels prior to the completion of all driving and shoring operations.
- Work as an operator of or helper on all rolling machines.
- Work as an operator of or helper on any pressing or punching machines.
- Work as an operator of or helper on all bending machines.
PROHIBITED EMPLOYMENT for minors 14 & 15 years of age:
- Any of the employment prohibited for 16 & 17 year-old employees.
- Manufacturing, mining or processing work.

- Operation or tending of any hoisting apparatus or of any power driven machinery.
- Operation or services as helpers on any motor vehicles.
- Outside window washing.
- Work with power driven food slicers, grinders, choppers, cutters and mixers, etc. (except as noted below).
- Work in freezers and meat coolers.
- Work in warehouses.
- Loading and unloading goods to and from trucks.
- Maintenance or repair of machinery.
- Any work at an actual construction site, in the transformation of people or property, warehousing and storage, communication and public utilities and construction.
- Public messenger service.
PERMITTED EMPLOYMENT of minors 14 & 15 years of age:
- Office and clerical work.
- Cashiering.
- Errand and delivery work by foot, bicycle and public transportation.
- Clean up work, including the use of vacuum cleaners and floor waxers, and maintenance of grounds, but not including the use of power-driven mowers or cutters.
- Kitchen work involving prep and serving of food and beverages, including use of machines and devices used in performance of work such as dishwashers, toasters, dumbwaiters, popcorn poppers, milk shake blenders and coffee grinders.
- Dispensing gasoline and oil, courtesy service, car cleaning, washing and polishing cars and trucks.
HOURS OF WORK for minors 14 & 15 years of age:
Employment permitted only outside of school hours.
Maximum of 40 hours per week when school is not in session. No overtime is permitted.
Maximum of 18 hours per week when school is in session.
Maximum of 8 hours per day when school is not in session.
Maximum of 3 hours per day when school is in session.
Work permitted only between 7:00 a.m. and 7:00 p.m., except from June 1 through Labor Day work permitted between 7:00 a.m. to 9:00 p.m.
CIVIL PENALTIES FOR VIOLATION OF FLSA CHILD LABOR REGULATIONS
Civil penalties of up to $10,000 for each violation.
For oppressive violations, up to $10,000 fine or imprisonment of up to six months or both per violation.
