Executive Session.

The executive session of the School Pupil Transportation Advisory Committee (SPTAC) convened March 26, 2018,at 3:28p.m. Captain Lane,Committee Chair, welcomed the members to the SPTAC meeting. There were self-introductions.

Approval of Previous Minutes. The reading of the minutes from October 13, 2017, was waived, and the minutes were accepted as presented.

Agenda Item(s).

  • Item 1. Ms. Kari Anderson submitted an agenda item regarding the installation of lights over Exit signs in school buses.

Discussion. The Committee agreed that there were no prohibitions for installation of lights over Exit signs in school buses as long as the lights do not obstruct the driver’s ability to see clearly, at all times, while driving the bus.

Action Item. On April 4, 2018, Ms. Bowie responded, via email, to Ms. Anderson with the Committee’s response.

NONAGENDA ITEMS.

  • Ms. Florence revised language regarding her previously submitted proposal pertaining toSection 1222 of Title 13 (13), California Code of Regulations (CCR) relating to smoking and provided a copy to each member of the Committee (Attached).

Discussion. Mr. Barzuto asked if the proposal would have to comply with certain sections of the Health and Safety Code.

Action Item. Mr. Barzuto will research the Health and Safety Code and report the findings at the next SPTAC meeting.

  • The Chair announced the following SPTAC vacancies: Urban School Districts American Academy of Pediatrics Representative, Other than School Bus Operations Representative.

Next SPTAC Meeting.The Chair announced the next SPTAC meeting would be

heldin October 2018, in Anaheim, California, in conjunction with the CASTO’s Business Manager’s Forum. More details will follow.

Adjournment. The executive session adjourned at 3:46p.m.

PublicSession. The public session convened at 3:49p.m. Chairman Lane

welcomed the audience and expressed appreciation to CASTO for providing the venue for the meeting. There were self-introductions by the SPTAC members. The Chair reminded the audience that the session would address regulatory matters only, and that any concerns regarding statutory matters would be better addressed at the next CASTO conference during the agency panel session.

The Chair discussed the outcome of the SPTAC executive session and announced SPTAC vacancies. There were no questions from the audience.

Next SPTAC Meeting. The Chair announced the next SPTAC meeting would be

heldin October 2018, in Anaheim, California, in conjunction with the CASTO’s Business Manager’s Forum. More details will follow.

Adjournment. The public session adjourned at 4:00p.m.

Purpose and intent for change is to bring the California Code of Regulations in alignment with the California Education Code. The California Education Code prohibits smoking as stated in section 48901.

EC 48901

(a)No school shall permit the smoking or use of a tobacco product by pupils of the school while the pupils are on campus, or while attending school-sponsored activities or while under the supervision and control of school district employees.

(b)The governing board of any school district maintaining a high school shall take all steps it deems practical to discourage high school students from smoking.

(c)For purposes of this section, “smoking” has the same meaning as in subdivision (c) of Section 22950.5 of the Business and Professions Code.

(d)For purposes of this section, “tobacco product” means a product or device as defined in subdivision (d) of Section 22950.5 of the Business and Professions Code.

Current law

§1222.

When a pupil is aboard, smoking is prohibited in a school bus, PAB, or SPAB.

Proposed change – change existing language and add additional language

§1222.

(a)Smoking is prohibited in a school bus, school pupil activity bus, or pupil activity bus at any time.

(b)“Smoking” means (as defined in Section 22960.5 of the Business and Professionals Code [BPC]): inhaling, exhaling, burning, or carrying any lighted or heated cigar, cigarette, or pipe, or any other lighted or heated tobacco or plant product intended for inhalation, whether natural or synthetic, in any manner or in any form. “Smoking” (as described in Section 22950.5 BPC) includes the use of an electronic smoking device that creates an aerosol or vapor, in any manner or in any form, or the use of any oral smoking device for the purpose of circumventing the prohibition of smoking.

(c)“Tobacco product” means (as defined in 22950.5 BPC) any of the following:

(A)A product containing, made, or derived from tobacco or nicotine that is intended for human consumption, whether smoked, heated, chewed, absorbed, dissolved, inhaled, snorted, sniffed, or ingested by any other means, including, but not limited to, cigarettes, cigars, little cigars, chewing tobacco, pipe tobacco, or snuff.

(B)An electronic device that delivers nicotine or other vaporized liquids to the person inhaling from the device, including, but not limited to, an electronic cigarette, cigar, pipe, or hookah.

(C)Any component, part, or accessory of a tobacco product, whether or not sold separately.

(d)“Tobacco product” means any of the following:

(A)A product containing, made, or derived from tobacco or nicotine that

is intended for human consumption, whether smoked, heated, chewed, absorbed, dissolved, inhaled, snorted, sniffed, or ingested by any other means, including, but not limited to, cigarettes, cigars, little cigars, chewing tobacco, pipe tobacco, or snuff.

(B) An electronic device that delivers nicotine or other vaporized liquids to the person inhaling from the device, including, but not limited to, an electronic cigarette, cigar, pipe, or hookah.

(C)Any component, part, or accessory of a tobacco product, whether or not sold separately.

(e) “Tobacco product” (as defined in 22950.5 BPC) does not include a product that has been approved by the United States Food and Drug Administration for sale as a tobacco cessation product or for other therapeutic purposes where the product is marketed and sold solely for such an approved purpose.
