Terms and Conditions of Participation
In consideration of accepting this entry and allowing me/us to participate in the City of Tea Tree Gully (Council) Move Your Paws Dog Walk (Event), I/we the undersigned:
1. release the Council, its elected members, employees, contractors and agents from all liability for death or personal injury suffered by me/us, or loss of or damage to my/our property, arising out of or in connection with my/our participation in or attendance at the Event (wheresoever occurring) or otherwise arising in relation to the Event (the release);
2. agree to indemnify and forever hold harmless the Council, its elected members, employees, contractors and agents from and against any claim, action, proceedings or demand for damages for negligence or liability of any kind which may be brought or made against the Council by any person in respect of any loss, damage or injury (including death) occurring to any person or property arising out of or in connection with my/our participation in or attendance at the Event (wheresoever occurring) or otherwise arising in relation to the Event (the indemnity);
3. agree that the indemnity includes any costs incurred by the Council in defending any actions, proceedings, claims and demands or in being represented at proceedings, inquiries or inquests;
4. agree that the release and indemnity extend to the participation in or attendance at the Event of any child or person in my care;
5. agree that my/our participation in the Event is exclusively at my/our own risk and that I/we have the option of withdrawing or not participating in the Event at any time;
6. agree to take all necessary precautions and actions to ensure that I/we and any child or person in my/our care is safe and supervised (including, but not limited to, wearing suitable clothing and acting in a responsible manner) at all times during my/our participation and attendance at the Event;
7. declare that I/we and my/our dog(s) are physically fit and able to participate safely in the Event;
8. understand that I/we must comply with all directions and instructions from any employee, contractor or agent of the Council related to my/our attendance at and participation in the Event;
9. agree to adhere to any comply with any Event rules set by Council, understand that I/we must follow the approved course and agree that I/we will observe normal traffic and road rules during my/our participation in and attendance at the Event;
10. agree that the Council or its employees, contractors or agents can reject, cancel or remove me/us from the Event and within the close proximity of the Event if in their reasonable opinion: (i) my/our actions or the actions of my/our dog(s) may cause risk of injury or harm to me/us or bystanders or participants in the Event; (ii) there is a risk of damage to property as a result of my/our or my/our dog(s) behaviour; (iii) my/our behaviour is inappropriate, offensive or abusive; (iv) I/we are engaging in or likely to engage in any form of unauthorised or ambush marketing;
11. agree that the Council may refuse me/us entry to the Event on any grounds;
12. consent to receive and agree to pay for any medical treatment (including doctor, ambulance and/or hospital fees and expenses) which is considered in the reasonable opinion of Council or its employees, contractors or agents to be advisable before, during or after the Event, either for me/us or any child or person in my/our care;
13. consent to my/our name or any picture or video of me/us being used freely in any broadcast, telecast, online publication or in print by Council in relation to the Event or future like event(s) whether for advertising, promotion or archival use;
14. acknowledge that I/we are solely responsible for my/our personal possessions and equipment at all times during, before and after my/our participation in the Event;
15. agree that my/our dog(s) is/are registered for the 2017-18 financial year and will, at all times during its participation in the Event, have a current registration disc affixed to its collar;
16. agree that my/our dog(s) will be kept on a leash not exceeding 2 metres in length for the duration of my/our participation in the Event and that I/we am/are responsible for immediately removing and disposing of any of my/our dog(s) faeces during the Event;
17. declare that my/our dog has never, to the best of my/our knowledge, attacked, harassed or chased any person or animal owned by another person;
18. agree that if a provision of this agreement is ruled by a Court to be invalid or unenforceable, that provision shall be severed or modified to the minimum extent required to make the provision enforceable and that nothing in this agreement is intended to limit my/our rights under the relevant Australian Consumer Law.
Participants should be in good physical condition and prepared to enjoy walking on irregular surfaces along the trail including small hills, uneven terrain, grass, and footpaths. We ask that you appraise your own capabilities honestly. In addition those individuals requiring special attention, treatment or whose condition limits their activities must disclose this information to the event organiser.
