Subject: Some Administrative and Funding Matters
Background : There are a few matters which need to be brought to your attention and for action:
School Caretakers’ and Cleaners’ (including Canteen Workers) Settlement

Caretakers and Cleaners Settlement : A ministry circular (2008-15) is on its way to you advising of the settlement details (refer also to previous NZSTA Memo’s) for this agreement and the Groundstaff. The new collective has now been signed this week and will be available online from the ministry on Monday 17 November 2008. NZSTA is arranging printed copies. The new printed rates are attached to this Memo.
The pay increase will occur in the next pay run for those on the central pay system and backdated for union members on the paid rates. Those not on the central payroll should make appropriate arrangements.
You will need to provide separate instruction to the pay centre if you wish to make any changes to those union members who are paid above the rates set out in the collective. There is no automatic increase for those paid above the paid rate but you should take this opportunity to reassess whether change maybe required, particularly if they have a remuneration package which incorporates allowances and/or overtime and/or call back as this may need to change if linked to the paid rates of the collective.
For existing employees who are not union members a new IEA will not be promulgated by the ministry until January 2009. However new employees from this point are entitled to the new rates from date of appointment. Remember to use NZSTA template appointment letters.
If you wish to review the pay rates of existing staff then that will need to be done under their present contractual arrangements. Discuss with your NZSTA industrial adviser if you have any queries about this.
We are presently working with the ministry and SFWU on what the funding arrangement will be for the addition payment that takes effect from July 2009.
Secondary and Area Groundstaff : The collective is now online at the ministry site www.minedu.govt.nz and we are arranging to print copies. The same detail as the Caretakers and Cleaners applies except that a new IEA will be promulgated as soon as possible for existing employees (there is no delay until January).
Annualisation: The 2009 Annualisation Agreement Form for Support Staff ESP23nt is available on Education Service Payroll website annualisation forms to your Payroll Service Centre at the same time you complete and send your Start of Year Staffing Form. Your Payroll Service Centre must receive your annualisation forms by 9 January 2009 or your employees will not be annualised in 2009. Annualisation forms received after this date will not be processed.
End of Year staffing forms: End of Year staffing forms are due back to your payroll service centre by 17 November 2008 at the latest. Please send these in if you have not already done so.
Start of Year staffing forms: Datacom will be sending out your Start of Year staffing forms on 16 November and they are due back 9 January 2009.
Schools on:
· e-SUE will be able to complete their form electronically
· e-SUE and authorised email will be able to return their form electronically.
It is important that you meet this deadline so that Datacom can set up and pay your existing employees correctly from the beginning of 2009.
Funding for Mid-Term Elections: For those boards who have been part of the mid-term election process and completed the appropriate forms the date for payment is the first week of December.
Payments made by parents or guardians of students to state schools - GST treatment : An IRD public ruling was issued in 2003 but expired in 2006. A revised draft ruling has been prepared by IRD which deals with the GST treatment of payments made by the parents or guardians of pupils who are New Zealand citizens or New Zealand residents and who are enrolled at state schools (including schools integrated with the state system of education under the Private Schools Conditional Integration Act 1975) to the Boards of Trustees of such schools. The NZSTA is presently considering the draft and discussing this with the Catholic Education Office/APIS in terms of its implications for integrated.
Comment deadline is 19 December 2008. If you have any views on this issue/draft please let us know but boards may also wish to make there own submissions (please copy to NZSTA if you do).
