Education (Special Developmental Schools) Act 1976
BE IT ENACTED by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):
1.Short title and commencement
(1)This Act may be cited as the Education (Special Developmental Schools) Act 1976.
(2)This Act shall come into operation on the day on which it receives the Royal Assent.
2.Definitions
In this Act unless inconsistent with the context or subject-matter—
S. 2 def. of "special develop-mental school" substituted by No. 9714 s.88(a)(i).
"special developmental school" means any special school within the meaning of Division 2 of Part IV of the Education Act 1958 which is a school for intellectually handicapped children registered as a day training centre under the Mental Health Act 1959 for which the Education Department provides teachers or general educational facilities;

3.Determination of entitlements

Notwithstanding anything in any Act in computing the period of service of a member of the teaching service provided by the Education Department at a special developmental school who immediately prior to being so provided was a teacher at a place registered as a day training centre under the Mental Health Act 1959 for the purpose of determining any entitlement to long service leave or sick leave there shall be taken into account to the extent approved by the Minister in any case any service as a teacher at any place registered as aforesaid and any service so approved shall be deemed to be continuous with any other service required to be taken into account for the purposes aforesaid.
