Minutes of the Council meeting of the Delhi Medical Council held on 09th March, 2017in Conference Room of the Delhi Medical Council.

A meeting of the Delhi Medical Council was held on 09th March, 2017at 2.30 pm in Conference Room of the Delhi Medical Council.

The meeting was adjourned at 2.30 pm due to lack of quorum. The meeting was reconvened at 3.00 pm.

Dr. Arun Kumar Gupta welcomed the members to the meeting.

The following agenda was discussed :-

1.Minutes of the last meeting held on 19thJanuary, 2017.

The minutes of the last Council meeting held on 19th January, 2017 were circulated to all the members present, for information.

2.Action taken report of minutes of the meeting held on 19th January, 2017.

Action taken report, which was circulated to all the members present, was approved. The same are appended herewith as annexure ‘A’.

3.Presentation by VMC Management Consulting Pvt. Ltd on Design, Development and Management of Smart Admin- A web based Administrative Application for Delhi Medical Council.

A presentation on Design, Development and Management of Smart Admin-A web based Administrative application for Delhi Medical Council was given by VMC Management Consulting Pvt. Ltd. The Council directed that a Committee of the members may be constituted which will examine the cost benefit of the project in detail and revert back to the Council with its recommendations.

4.To discuss cases of medical negligence and unethical conduct.

(a)The Order of the Disciplinary Committee in complaint No.1121 of Shri A.S. Khan r/o. 3574, Jatwara Street, Near Sablok Clinic, Netaji Subash Marg, Darya Ganj, New Delhi-110002, alleging medical negligence on the part of doctors of Saket City Hospital, in the treatment administered to complainant’s son Shri Tahir Hussain at Saket City Hospital, Mandir Marg, Press Enclave Road, Saket, New Delhi – 110017, was confirmed by the Delhi Medical Council.

(b)The Order of the Disciplinary Committee in complaint No. 1149of Shri Chetan Singh r/o. HR-249/6, Pul Prahaladpur, PO Badarpur, New Delhi- –110044, forwarded by Medical Council of India, alleging medical negligence on the part of Dr. Sanjay Maheshwari, 283, DDA Janta, Pul Pehladpur, PO Badarpur, New Delhi – 110044, in the treatment administered to complainant’s father Shri Chand, was confirmed by the Delhi Medical Council.

(c)The Order of the Disciplinary Committee in complaint No.1542 of Shri Devender Singh, WZ-591, First Floor, Gali No.22, Shiv Nagar, New Delhi-110058 alleging medical negligence on the part of Dr. Vivek Khanna of Khanna Nursing Home(Khanna Hospital), C-2/396, Janakpuri, New Delhi-110058, in the treatment administered to the complainant at Khanna Nursing Home, was confirmed by the Delhi Medical Council.

The Council also confirmed the punishment of removal of name awarded to Dr. Vivek Khanna(Delhi Medical Council Registration No.10822) by the Disciplinary Committee.

The Council further observed that the Order directing the removal of name from the State Medical Register of Delhi Medical Council shall come into effect after 30 days from the date of the Order. The Order of the Disciplinary Committee stands modified to this extent and the modified Order is confirmed.

(d)The Order of the Disciplinary Committee in complaint No. 1372 of Shri Alimuddin, r/o, A-151-152, Gali No.9, Wazirabad, Delhi-110084, alleging medical negligence on the part of Dr. Shekhar Srivastav, in the treatment administered to the complainant’s mother late Noor Jahan at Sant Parmanand Hospital, 18, Shamnath Marg Civil Lines, New Delhi-110054, resulting in her death, was confirmed by the Delhi Medical Council.

(e)The Order of the Disciplinary Committee in complaint No. 1958- An inspection report No.F.12(3)/CDMO/SWD/DHS/AQ/06/pt-IX/6936 dated 22nd March, 2016 of the Chief District Medical Officer(South West), Directorate of Health services, Govt. of NCT of Delhi, Sector-2, Disp. Complex, Dwarka, New Delhi-110075 in respect of Dr. Prashant, Life Line Medicare Centre, F-11, Shokeen Plaza, Pocket-7, Sector-12, Dwarka, New Delhi-110075, was confirmed by the Delhi Medical Council.

The Council also confirmed the punishment of removal of name awarded to Dr. Prashant (Delhi Medical Council Registration No.16855)by the Disciplinary Committee.

The Council further observed that the Order directing the removal of name from the State Medical Register of Delhi Medical Council shall come into effect after 30 days from the date of the Order. The Order of the Disciplinary Committee stands modified to this extent and the modified Order is confirmed.

(f)The Order of the Disciplinary Committee in complaint No. 1120of Shri Ashok Srivastava s/o. Shri R.R. Srivastava, r/o. D-36, Ground Floor, Anand Vihar, Delhi– 110092, alleging medical negligence on the part of Dr. Vijay Arora of Sir Ganga Ram Hospital, in the treatment administered to the complainant at Sir Ganga Ram Hospital, Rajinder Nagar, New Delhi – 110060,was confirmed by the Delhi Medical Council.

(g)The Order of the Disciplinary Committee in complaint No. 1254of Shri Radhey Shyam r/o. H-15, Andrews Ganj Extension, New Delhi – 110049, alleging professional misconduct on the part of Dr. Saurabh Jain of Safdarjung Hospital, in the treatment administered to the complainant at Safdarjung Hospital,was confirmed by the Delhi Medical Council.

(h)The Order of the Disciplinary Committee in complaint No. 1499of Shri Satbir, r/o, House No.D-37A, Gopal Nagar, Najafgarh, New Delhi-110043, forwarded by the Medical Council of India, alleging medical negligence on the part of Dr. Renu Mahindru, in the treatment administered to the complainant’s wife Smt. Asha Lata at Mahindru Hospital, E-1, Kiran Garden, Opp. Metro Pillar No. 712, Uttam Nagar, New Delhi-110059, resulting in her death on 8.10.2014 at Mata Chanan Devi Hospital, C-1, Janakpuri, New Delhi-110058, was taken up for confirmation before the Delhi Medical Council.

Whilst confirming the decision of the Disciplinary Committee, the Council observed that in the facts and circumstances of this case, the punishment of removal of name of Dr. Renu Mahindru from the State Medical Register for the period of sixty days was a bit harsh punishment and the same was not warranted. It was further observed that interests of justice will be served if the name of Dr. Renu Mahindru is removed from the State Medical Register of the Delhi Medical Council for the period of fifteen days. The Council, therefore, directed that name of Dr. Renu Mahindru(Delhi Medical Council Registration No.10647) be removed from the State Medical Register of the Delhi Medical Council for a period of fifteen days with a direction that Dr. Renu Mahindru should undergo twelve hours of Continuing Medical Education (C.M.E.) on the subject of ‘High Risk Obstetrics’ within a period of six months and submit a compliance report to this effect to the Delhi Medical Council.

The Council further observed that the Order directing the removal of name from the State Medical Register of Delhi Medical Council shall come into effect after 30 days from the date of the Order.

This observation is to be incorporated in the final Order to be issued. The Order of the Disciplinary Committee stands modified to this extent and the modified Order is confirmed.

(i)The Order of the Disciplinary Committee in complaint No. 1133 of Shri Varun Tandon, 51, Chander Nagar, Janak Puri, New Delhi, alleging medical negligence on the part of Dr. Pradeep Jain and Fortis Hospital, Shalimar Bagh, New Delhi-110088, in the treatment administered to the complainant’s mother late Darshana Tandon, resulting her death on 31.1.2013 at Fortis Hospital, was taken up for confirmation before the Delhi Medical Council.

Dr. Arun Kumar Gupta recused himself from the proceedings.

Whilst confirming the decision of the Disciplinary Committee, the Council observed that in the facts and circumstances of this case, the punishment of warning awarded to Dr. Pradeep Jain (Dr. Pardeep Kumar Jain), Dr. Gokaran Manjhi and Dr. Vivek Goel by the Disciplinary Committee is not warranted,however, Dr. Pradeep Jain (Dr. Pardeep Kumar Jain), Dr. Gokaran Manjhi and Dr. Vivek Goelshould be more deligent in the treatment of their patients in future and should undergo six hours of Continuing Medical Education (C.M.E.) on the subject of ‘Drug Allergy’ within a period of six months and submit a compliance report to this effect to the Delhi Medical Council.

This observation is to be incorporated in the final Order to be issued. The Order of the Disciplinary Committee stands modified to this extent and the modified Order is confirmed.

(j)The Order of the Executive Committee in complaint No. 1944 of Shri. Manni Lal s/o late Shri Munna Lal r/o- MIG 25/28, Rampura, Deheli, Sujanpur, Kanpur, U.P. forwarded by the Directorate General of Health Services, Govt. of NCT. of Delhi, alleging medical negligence and professional misconducton the part doctors of Indraprastha Apollo Hospital, Sarita Vihar, Delhi Mathura Road, New Delhi-110076, was confirmed by the Delhi Medical Council.

(k)The Order of the Executive Committee in complaint No. 1554of Shri Inderjit Sharma, A-96, Shivaji Vihar, Janta Colony, New Delhi-110027, forwarded by the Medical Council of India, alleging medical negligence, in the treatment administered to the complainant’s son Shri Paramjeet at Khetarpal Hospital, F-95, Bali Nagar, Main Najafgarh Road, New Delhi-110015, was confirmed by the Delhi Medical Council.

(l)The Order of the Executive Committee in complaint No.1818of Smt. Anjana Kohli w/o Shri. Mohan Lal Kohli, r/o- C-7/109, Sector-05, Rohini, Delhi-110085, alleging medical negligence on the part of doctors of Baba Saheb Ambedkar Hospital Sector-06, Rohini, Delhi-110085, in the treatment administered to complainant’s son Shri. Sharad Kohli at Baba Saheb Ambedkar Hospital, resulting in his death on 30.10.2013, was confirmed by the Delhi Medical Council.

(m)The Order of the Executive Committee in complaint No.1792 of Smt. Anita Gupta r/o- C-5/S-1, DLF, Dilshad Ext.-II, Bhopura, Sahibabad, Ghaziabad, U.P.-201005, alleging negligence on the part of doctors of Jeevan Jyoti Clinic and Hospital, G.T.B Chowk, Dilshad Garden, Delhi-110095 in the preparation of Ultrasound report of the complainant, was confirmed by the Delhi Medical Council.

(n)The Order of the Executive Committee in complaint No.1577 of Shri Surendra Kumar Singh s/o Late Shri. Bali Ram Singh, G-11/79, Sector-15, Rohini, New Delhi-110085,forwarded by the Medical Council of India, alleging medical negligence on the part of Dr. Mithlesh Kumar Singh of Bhagwati Hospital, in the treatment administered to the complainant’s daughter Late baby Jiya at Bhagwati Hospital, CS/OCF-5,(Near Popular Apartment & Mother Dairy Booth) Sector-13, Rohini, Delhi-85, resulting in her death on15.03.2015, was confirmed by the Delhi Medical.

(o)The Order of the Executive Committee in complaint No.1567of Shri Arun Kumar r/o- E-117, Camp No.02, Nangloi, Delhi-110041, forwarded by the Health & Family Welfare Department, Govt. of NCT of Delhi, alleging medical negligence in the treatment of complainant’s new born baby at Bhagwan Mahavir Hospital, Pitampura, New Delhi-110034, was confirmed by the Delhi Medical Council.

(p)The Order of the Executive Committee in complaint No.1484 of Smt. Prem Ghuna, w/o, Shri S.K. Ghuna, r/o, 1334, Sector-15, Part-II, Near Salwan Public School, Gurgaon-122001, alleging medical negligence on the part of Dr. Surya Bhan and Primus Super Speciality Hospital, Chanakya Puri, New Delhi-110021, in the treatment administered to the complainant Smt. Prem Ghuna at Primus Super Speciality Hospital, was confirmed by the Delhi Medical Council.

(q)The Order of the Executive Committee in complaint No.2012- a reference no DF(Central)/PF/2016/849 dated 03.06.2016 from President DCDRF (Central) in respect of case No.145/2007 Yudhistar Lal Chawla v/s Ganga Ram Hospital, was confirmed by the Delhi Medical Council.

(r)The Order of the Executive Committee in complaint No.1702 of Shri Tarun r/o- Sarai Basti, 19/214 Rohilla, 3rd Floor, Delhi-110035, alleging medical negligence on the part of Dr. Vinod Kumar of Lok Nayak Hospital, New Delhi-110002, in the treatment administered to the complainant at Lok Nayak Hospital, New Delhi-110002, was confirmed by the Delhi Medical Council.

Dr. Deepak Kumar Tempe recused himself from the proceedings.

(s)The Order of the Executive Committee in complaint No.1633 of Shri Laxmi Kant r/o- House No.307, Block-C-3, Sultan Puri, New Delhi-110086, alleging medical negligence on the part of Dr. Jyoti Dhapar, Dr.Atul Dhapar and Dr. Grover of Kamlesh Medical Centre, in the treatment administered to the complainant at Kamlesh Medical Centre, 423, Bhera Enclave, Pachim Vihar, Delhi, was confirmed by the Delhi Medical Council.

(t)The Order of the Executive Committee in complaint No.1442of Shri Sharif Beg, r/o, F-14/3, Nafees Road, Jagabai Extension, Jamia Nagar, New Delhi, alleging negligence on the part of doctors of Gulshan Medicare, G-2, South Extension, Part-2, New Delhi-110049 in the preparation of blood test report, was confirmed by the Delhi Medical Council.

(u)The Order of the Executive Committee in complaint No.2013-Suo motu notice of an advertisement published in the newspaper Nav Bharat times dated 06.01.2017 by Dr. Gaurav Chanana, Dr. G.P. Dureja, Dr. Dhruv Bibra, Dr. Siddharth Hora at Delhi Pain Management Centre, in violation of code of Ethics, was confirmed by the Delhi Medical Council.

5.To discuss about the Minutes of the Anti Quackery Committee.

Minutes of the meeting of the Anti Quackery Committee of the Delhi Medical Council held on 21st February, 2017, which were circulated to the members present, were confirmed. The same are appended herewith as annexure ‘B’.

6.To discuss about the Minutes of the Finance Committee.

Minutes of the meeting of the Finance Committee of the Delhi Medical Council held on 1st March, 2017, which were circulated to the members present, were confirmed. The same are appended herewith as annexure ‘C’.

7.To discuss about the issues related to Land & Building Committee.

The President informed that the negotiations with the Delhi Metro Rail Corporation forthe officespace for the Delhi Medical Council are in advance stage. The Delhi Metro Rail Corporation has been requested to send a revised proposal in this regard. The same is expected for very soon. Once the same is received, the same shall be considered by the Land & Building Committee, which shall thereafter make it recommendations to the Council for the further consideration.

8.To discuss about the State Medical Council meeting schedule on 25th March, 2017 and 26th March, 2017.

The President informed that National Conference of all the State Medical Councils is being convened on 25th and 26th March, 2017 at Hotel ‘The Lalit’, New Delhi to discuss the issues Registration, Session on CME/Accreditation, Anti-Quackery Session, Session on Ethical Issues and Open Session with MCI (Interactive Session).

The Council directed that a Committee be constituted to assist the office for better organization of the State Medical Council meeting.

9.Any other item with permission of Chair

The issue of registration of individuals who have submitted forged documents and against whom FIRs have been requested to the police for registration, was taken up for consideration.

The Council after due deliberations, reaffirm its decision taken in last Council meeting held on 19th January, 2017 and further observed that these individuals cases cannot be reconsidered till the criminal investigation is completed.
