Minutes of the Council meeting of the Delhi Medical Council held on 12th March, 2014in Conference Room, Delhi Medical Council, New Delhi

A meeting of the Delhi Medical Council was held on 12th March, 2014at 2.30 pm in Conference Room, Delhi Medical Council, New Delhi.

The meeting was adjourned at 2.30 pm due to lack of quoram. The meeting was reconvened at 3.00 pm.

Dr. Vinay Aggarwal, Vice President chaired the meeting.

The following agenda was discussed :-

  1. Confirmation of the minutes of the last meeting held on 15th January, 2014.

Minutes of the last Council meeting held on 15th January, 2014, which were circulated to all the members, were confirmed.

Action taken report, which was circulated to all the members, was approved.

  1. To discuss about the progress of Online CME

Dr. Anil Goyal, Chairman, CME Committee briefed the members about the topics and the faculty, which will be considered for CME. The Council directed that the same be provided to all the members, for their comments,after which CME Committee may take up this issuefor finalization.

  1. To discuss cases of medical negligence and unethical conduct

(a)The Order of the Disciplinary Committee in complaint No. 946–A representation from SHO, Police Station North Rohini, Sector-7, Rohini, Delhi, seeking medical opinion in respect of death of late Deepa, w/o Shri Kundan, r/o House No. K-1862, Jahangirpuri, Delhi, allegedly due to medical negligence in the treatment administered to late Deepa at Dr. Baba Saheb Ambedkar Hospital, Rohini, Delhi, was confirmed.

(b)The Order of the Disciplinary Committee in complaint No. 937 of Shri Vijay K. Kapoor, President of 52 Delhi Government Officers Flats, Greater Kailash-I, New Delhi-110048, forwarded by Medical Council of India, alleging medical negligence on the part of Dr. A.K. Gadpavle, in the treatment administered to complainant wife’s late Rama Kapoor at Dr. R.M.L. Hospital, New Delhi, resulting in her death on 23.12.10, was confirmed.

(c)The Order of the Disciplinary Committee in complaint No. 1073 - A representation from Police Station Sangam Vihar, New Delhi, seeking medical opinion in respect of alleged medical negligence, in the treatment of Smt. Veerwati, w/o Shri Sanjay r/o. E-6/56A, Sangam Vihar, New Delhi, in the treatment administered to Smt. Veerwati at R.K. Hospital E-7A/103, Ratiya Marg, Opp. Street No. 17, Sangam Vihar, New Delhi – 110062, was confirmed.

(d)The Order of the Disciplinary Committee in complaint No. 922of Smt. Inder Mohini, r/o 28/22, Punjabi Bagh Extensioin, New Delhi-110026, alleging medical negligence, in the treatment administered to the complainant at Bharti Eye Foundation, 1/3, East Patel Nagar, New Delhi-110008, came up for confirmation before the Delhi Medical Council.

Whist confirming the Order of the Disciplinary Committee, the Council observes that since Dr. Sanjiv Gupta and Dr. K.K. Narang were the operating surgeons, both were guilty of professional misconduct in respect of treatment of Smt. Inder Mohini. The Council further observes that the decision of the Delhi Medical Council holding Dr. Sanjiv Gupta (DMC registration No. 18978) and Dr. K.K. Narang (Dr. Keshav Kumar Narang - DMC registration No. 4730) guilty of professional misconduct is final. However, the Order directing the removal of name from the State Medical Register of Delhi Medical Council shall come into effect after 30 days from the date of the Order. The Council also confirmed the punishment of warning awarded to Dr. Sudhank Bharti (DMC registration No. 6602). The same is to be incorporated in the final Order.

The Order of the Disciplinary Committee stands modified to this extent and the modified Order is confirmed.

(e)The Order of the Disciplinary Committee in complaint No. 1134 - A reference from S.P.O., P.N.D.T., Directorate of Family Welfare, Govt. of NCT of Delhi, allegedly professional misconduct on the part of Dr, Anoop Gupta of IVF & Fertility Clinic, 23, Todar Mal Lane, Bengali Market, New Delhi, came up for confirmation before the Delhi Medical Council.

Whist confirming the Order of the Disciplinary Committee, the Council observes that the decision of the Delhi Medical Council holding Dr. Anoop Gupta (DMC registration No. 8312) guilty of professional misconduct is final. However, the Order directing the removal of name from the State Medical Register of Delhi Medical Council shall come into effect after 30 days from the date of the Order. The same is to be incorporated in the final Order.

The Order of the Disciplinary Committee stands modified to this extent and the modified Order is confirmed.

(f)The Order of the Disciplinary Committee in complaint No. 914 of Shri Navin Kochhar r/o. B-35, Arya Nagar Apartments, 91, IP Extension, Delhi – 110092, alleging professional misconduct on the part of Dr. Aparna Jha Ahuja, MD, Super Religare Lab Ltd., GP-26, Maruti Industrial Estate, Udyog Vihar, Sector-18, Gurgaon,came up for confirmation before the Delhi Medical Council.

The Council confirmed the Order and punishment of warning awarded to Dr. Aparna Ahuja nee Aparna Jha (DMC registration No. 30060) by the Disciplinary Committee.

(g)The Order of the Executive Committee in complaint No. 1219 of Shri Sanjiv Aggarwal, Under Secretary, Ministry of External Affairs, Govt. of India, alleging medical negligence on the part of doctors of Rajiv Gandhi Cancer Institute and Research Centre, in the treatment administered to complainant’s wife Preety Aggarwal at Rajiv Gandhi Cancer Institute and Research Centre, was confirmed.

(h)The Order of the Executive Committee in complaint No. 1252of Shri Sanjiv Aggarwal, Under Secretary, Ministry of External Affairs, Govt. of India, alleging medical negligence on the part of doctors of Sri Balaji Action Medical Institute, in the treatment administered to complainant’s wife Preety Aggarwal at Sri Balaji Action Medical Institute, was confirmed.

(i)The Order of the Executive Committee in complaint No. 1099of Shri Naveen Kumar r/o. WZ-625, Raj Nagar – I, Palam Colony, Delhi – 110077, forwarded by Medical Council of India, alleging professional misconduct on the part of Dr. Sanjay Mahindru of Mahindru Hospital, in the treatment administered to complainant’s wife Smt. Versha Verma at Mahindru Hosital, E-1, Kiran Garden, Main Najafgarh Road, Uttam Nagar, New Delhi – 110059, was confirmed.

(j)The Order of the Executive Committee in complaint No. 1074 of Smt. Sunita w/o. late Shri Radhe Shyam r/o. Village-Samaspur Khalsa, PO-Ujwa, New Delhi – 110073, alleging medical negligence on the part of Dr. Hari Om Gupta, Dr. Dhruv Chaturvedi, Orchid Hospital and Batra Hospital & Medical Research Centre, in the treatment administered to complainant’s husband late Radhe Shyam at Orchid Hospital, C-3/91-92, Janakpuri, New Delhi –110058; subsequently the patient received treatment at Batra Hospital, and thereafter expired on 4.8.2012, was confirmed.

(k)The Order of the Executive Committee in complaint No. 1085of Shri Manoj Jain r/o. T-290, Gali No. 6, Gautam Puri, Delhi – 110053, forwarded by Directorate of Health Services, alleging professional misconduct on the part of doctors of Jain Charitable Hospital, in the treatment administered to complainant’s wife Smt. Nidhi Jain at Jain Hospital, Street No. 5, Raghubar Pura No. 2, Gandhi Nagar, Delhi – 110031, was confirmed.

(l)The Order of the Executive Committee in complaint No. 1124of Ms. Jyoti r/o. G-165, Dr. Ambedkar Nagar, Sector-5, New Delhi – 110062, forwarded by Directorate of Health Services, alleging medical negligence on the part of Dr. Parvez Khan of Batra Hospital, in the treatment administered to complainant’s mother Ms. Anjala Hans at Batra Hospital, was confirmed.

(m)The Order of the Executive Committee in complaint No. 1231from Lt. Col. Y.S. Reddy. JDMS (Legal Assistance) for DGMS (Army), Army Hospital, Delhi Cantt against Dr. Vipin Kakar of Swar Clinic Pvt. Ltd., UU-182, Pitampura, New Delhi – 110088, was confirmed.

(n)The Order of the Executive Committee in complaint No. 1194 of Dr. Anuj Kumar Singh of Kiran Eye Care Centre, B-50, Derawal Nagar, Delhi – 110009 against Narang Eye Institute, B-8, Derawal Nagar, Near Double Petrol Pump & Model Town Metro Station, Delhi – 110009, was confirmed.

(o)The Order of the Executive Committee in complaint No. 1193of Ms. Nikhat Jahan r/o. C-1/34, Sector-17, Rohini, Delhi – 110089, forwarded by the Public Grievances Commission, Govt. of NCT of Delhi, alleging professional misconduct on the part of Dr. Prachi Arora, was confirmed.

(p)The Order of the Executive Committee in complaint No. 1127of Ms. Chetna Arora w/o. Shri Mahinder Arora, r/o. House No. 357, Hakikat Nagar, Mall Road, Delhi, forwarded by Delhi Dispute Resolution Society, Govt. of NCT of Delhi, alleging medical negligence on the part of doctors of Sunderal Jain Hospital, in the treatment administered to the complainant’s husband Shri Mahinder Arora at Sunderlal Jain Hospital, Ashok Vihar, Phase – III, Delhi, was confirmed.

(q)The Order of the Executive Committee in complaint No. 1097 of Shri Akhilesh Kumar r/o. H. No. 11, 3rd Floor, Pocket-B7, Sector–4, Rohini, Delhi – 110085, forwarded by Directorate of Health Services, Govt. of NCT of Delhi, alleging medical negligence on the part of Dr. Nisha Jain and Saroj Hospital, in the treatment administered to complainant’s wife Ms. Jyoti at Saroj Hospital, Plot No. 2, Institutional Area, Sector-14 Extension, Near Madhuban Chowk, Rohini, New Delhi – 110085, was confirmed.

  1. To discuss about the minutes of the Anti Quackery Committee.

1)Minutes of the Anti Quackery Committee meeting held on 24th and 25th February, 2014, which were circulated to the Council members present (appended herewith as annexure ‘A’ & ‘B’), were confirmed.

2)Dr. Anil Bansal, Chairman, Anti Quackery brought to the notice of the Council an Advertisement titled “Beware of Quacks” published by Directorate of Health Services on 6th March, 2014 in The Hindustan Times wherein under the modern scientific system of medicine, allopathy has been clubbed with other system of medicine viz. Homeopathic or Ayurvedic or Unani or Dental Science and Physiotherapy and Occupational Therapy. The Council observed that this statement was highly objectionable as the same was wrong and misleading. This observation of the Council be bought to the attention of the Director Health Services, Govt. of NCT of Delhi with a request that immediate corrigendum be issued in this regard, rectifying the mistake.

3)The Council resolved that a recommendation be sent to Medical Council of India requesting amendment in Section 15(3) of Indian Medical Council Act, 1956, by enhancing the punishment therein from one year to three years and fine from One thousand rupees to one lakh rupees so that the punishment act as a deterent to violation of provisions of Section 15(2) of the Indian Medical Council Act, 1956. In this regard, the Council also suggested that Medical Council of India should constitute an Anti Quackery Cell.

4)Chairman, Anti Quackery Committee briefed the members about the discussions, being held under the aegis of Additional Solicitor General of India, to formulate a concrete mechanism to deal with menace of quackery, in terms of the directions / observations of High Court of Delhi in a matter titled “Crl. Appeal 577/2013 Riyazudin Vs. State of NCT of Delhi.” It was informed that in accordance with the discussions, it has been agreed that Delhi Medical Council shall nominate certain names of doctors,district-wise who will assist Directorate of Health Services and Police and other agencies in inspection / verification of quacks. In this regard, the name of the members, reflected in list ‘A’ as appended herewith, was approved to be part of inspection team on behalf of Delhi Medical Council.

Minutes of the Finance Committee meeting held on 17th February, 2014, which were circulated to the members, were confirmed. The same are appended herewith as annexure ‘A’.
