STATEMENT OFBASIS,STATUTORYAUTHORITY,ANDPURPOSE

Pursuant to Section 24-33.5-1616, C.R.S., theDivision of HomelandSecurityandEmergencyManagementshallpromulgaterulesandregulationsconcerningtheadministration,criteriaandtimeframesforapplyingforanddistributingfundsassociatedwith the grant program.

TheGeneralAssembly declaredthatthisactisnecessarytobetterservelocalgovernmentandlocallawenforcementagenciesinthestatebyasharedreservepeaceofficerauxiliarygroupthatservesmultiplejurisdictionsandhaspeaceofficertrainingandcertificationprovided bythepeaceofficersstandardandtrainingboard.Theabsenceofimplementingrulestocarryoutthepurposeofthestatutewouldbecontrarytothisdeclaration. For these reasons, it is imperativelynecessarythat theproposed rules beadopted.

ReservePeaceOfficerAcademyGrantProgram

1.Authority

Thisregulationisadoptedpursuanttotheauthorityinsection24-33.5-1616,C.R.S.andisintendedtobeconsistentwiththerequirementsoftheStateAdministrativeProceduresAct,section24-4-101etseq.(the“APA”).

2.ScopeandPurpose

Thisregulationshallgoverntheimplementationofthereservepeaceofficeracademygrantprogram,whichincludesthetimeframesforapplyingforthesegrants,theform ofthegrantprogram application,andthetimeframesfordistributinggrantfunds.

3.Applicability

Theprovisionsoftheserulesshallbeapplicabletoalleligibleapplicantsandrecipientsofgrantfundsasprovidedbylaw.

4.Definitions

“EligibleApplicant”meansapoliticalsubdivisionofthestatethatiscomprisedofmultiplejurisdictionsforthepurposeofcreatingareservepeaceofficertrainingacademythat willtrainandcertifyareservepeaceofficerauxiliarygroup.

“Recipient”meansaneligibleapplicantreceivinganaward.

“Award”meansfinancialassistancegrantthatprovidessupporttoaccomplishapublicpurposegivenbythestatetoaneligiblerecipient.

“PeriodofPerformance”meanstheperiodoftimeduringwhichtherecipientisrequiredtocompletethegrantactivitiesandtoreceiveandexpendapprovedfunds.

“Pre-awardCosts”meanscostsincurredbyarecipientbeforethegrant wasawarded.

5.ProgramRequirements

5.1Eligibility

A.Applicant must be a political subdivision of the state that is comprised of multiple jurisdictions and that is formed for the purpose of funding a reserve peace officer academy in order to apply.

B.EligibleApplicantsmustobtain a minimum of reserve training academy certification from thePeaceOfficersStandardsandTraining(POST)Boardduring the performance period of the award or the grant funds will be subject to return to the State.

C.EligibleApplicantsmustcompletetheApplicationdevelopedbytheDivisionofHomelandSecurityandEmergencyManagementOfficeofPreparednessinconformancewiththeApplicationandthetermsoftheGrantGuidancedescribedbelow.

D.The grant funds may only be used for training and certification related activities and not for capital expenditure.

E.The grant agreement between the State and the recipient(s) of the grant program will specify additional requirements, including, but not limited to: performance measures, reporting requirements, and monitoring of recipient’s activities and expenditures.

F.Any intergovernmental agreement that defines an applicant’s status as a political subdivision of the state must be approved by the Director of the Division of Homeland Security and Emergency Management prior to receiving a grant award.

G.Additionally,thefollowingcriteriawillbeevaluatedinawardinganygrant:

1.Existingaccesstostart-upcapital;

2.Costs incurred prior to receiving a grant award; and

3.Thecapacitytoservecommunitiesstatewide;and

4.Theabilitytoassistlawenforcementagenciesintimesofneed.

B.Restrictions

1.ApplicationsthatarenotsubmittedbythestatedApplicationSubmissionDeadlinewillnotbereviewedorconsideredforfunding.

2.PreAwardCostsareNOTallowedunderthisprogram.

5.4ApplicationSubmissions

A.ApplicantscansubmittheirsignedapplicationviaU.S.mailorviaemailaslistedviatheGrantGuidance.

5.5GrantGuidance

TheDHSEMOfficeofPreparednessisresponsiblefortheimplementationofthisgrantprogramandwilldevelopandpublishanApplicationandGrantGuidanceinaccordancewithsection24-33.5-1616C.R.S.

5.6Repeal of Rules

These rules will be repealed at the same time as section 24-33.5-1616, C.R.S., as amended, is repealed.
