PROVIDE A DETAILED OUTLINE OF WHAT HAS BEEN DONE TOWARD COMPLETION OR FOR COMPLETION OF THE APPROPRIATION AND APPLICATION OF WATER TO A BENEFICIAL USE AS CONDITIONALLY DECREED, INCLUDING EXPENDITURES, AND IF APPLICABLE, PROVIDE INFORMATION ABOUT AREA(S) OF IRRIGATION: In the past six years, Applicant installed a windmill in Redtail Pond No. 1 at a cost of approximately $1,300.00, has continued its efforts to clean out the pond in order to restore its original 2.0 acre-feet capacity; consulted with a fisheries and water quality management specialist regarding the water flow and water quality of the Applicant’s spring and pond system to enhance its piscatorial and recreational uses, and stocked the pond with fish at a cost of $2,169.00, for a total cost of approximately $3,469.00. Additionally, Applicant has incurred attorney fees and filing fees in the approximate amount of $650.00 to maintain the conditional rights, including the preparation and filing of this Application for Sexennial Finding of Due Diligence. 5. You are hereby notified that you will have until the last day of JUNE, 2012 to file with the Water Court a Verified Statement of Opposition, setting forth facts as to why a certain Application should not be granted or why it should be granted only in part or on certain conditions. A copy of such Statement of Opposition must be served on the Applicant or the Applicant’s Attorney, with an affidavit or certificate of such service being filed with the Water Court, as prescribed by Rule 5, C.R.C.P. The filing fee for the Statement of Opposition is $158.00, and should be sent to the Clerk of the Water Court, Division 6, P.O. Box 773117, Steamboat Springs, CO 80477.
