REPORT TO SEEK APPROVAL FOR DISPOSAL OF A COUNCIL ASSET

1. PURPOSE OF REPORT
1.1 To seek approval for the disposal of the freehold interest of 29.25 sq m
to an adjoining owner at 4 Salterns Road. Plan attached showing the land in question outlined in red.
2. RECOMMENDATIONS
2.1 The Portfolio Holder is asked to agree:
(a) to the disposal of the freehold interest in 29.25 sq m of land on terms to be agreed by the Assets and Strategy Manager.
(b) that the prospective purchaser is required to pay all of the Borough of Poole's reasonable legal and professional charges necessarily incurred in the transaction.
3. BACKGROUND
3.1 The aforementioned land was licensed as garden land to Mr and Mrs
Jacob of 4 Salterns Road from 16th September 1982 for a peppercorn (nil) rent per annum.
3.2 The property now known as 4 Salterns Road was a plot previously
owned by Dorset County Council and was sold at auction on the 5th August 1982.
3.3 Dorset County Council retained the strip for potential highway
improvements, but it has always been garden land. The ownership of the land transferred to the Borough of Poole in the 1997 Local Government Reorganisation.
3.4 Transportation has confirmed that it is no longer required for Highways
purposes. The land does not generate any annual income from the garden licence and there is no development potential attached to the land.
3.5 The aim of this disposal is to tidy up the Borough of Poole's estate and
secure a capital receipt for the Borough of Poole in so doing.
3.6 This disposal process is in accordance with the Borough of Poole's
Standing Orders (SO 13c), which states:
"All land and buildings must be disposed of through public advertisements, except in the following case: 13 (c) a disposal of land to a person or body owning or occupying land adjoining the land which is to be disposed of'
3.7 The Poole local Plan (adopted March 2004) has not designated the
land for a specific use.

2. Request
2.1 It is recommended that the freehold of the subject land be sold to the adjoining owner of 4 Salterns Road for the sum of £1 000. Note that this is a fair offer to the Borough of Poole as garden land is currently valued at £25 - £30 per sq m.
2.2 In addition the purchaser has agreed to underwrite the Council's reasonable legal and professional fees.
