ORDER OF approving provisions

supplementing and amending the safety regulations

to counter the outbreak of fire and panic in establishments open to the public
(Particular requirements)

Having regard to European Parliament and Council Directive 98/34/EC of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and of rules on information society services, and, in particular, Notification No […];

Having regard to the Construction and Housing Code, and, in particular, Article R 123-12 thereof;

Having regard to the Order of 25 June 1980, amended, approving general provisions for safety regulations to counter the outbreak of fire and panic in establishments open to the public;

Having regard to the opinion of the standing sub-committee of the Central Committee on Safety;

Orders:

Article 1: The amendments and additions made to the provisions of the safety regulations to counter the outbreak of fire and panic in establishments open to the public appended to this Order are approved.

Article 2: The provisions of this Order shall be applicable three months following the date of its publication.

Article 3: This Order shall be published in the Official Gazette of the French Republic.

ANNEX TO THE ORDER OF [date]

The provisions of Title II of Book II of the safety regulations to counter the outbreak of fire and panic in establishments open to the public shall be amended as follows:

Article L 3

The following provisions shall be added to this Article:

e) multimedia centres:

- as declared by the client, with a minimum of one person per 2 m² of the total surface area of the room.

Regulations on use

1. Heating and ventilation systems installed in accordance with the provisions of Articles CH 1 to CH 43 inclusive shall be authorised.

2. Premises may be heated by electrical apparatus for the production and emission of heat. Such apparatus must be installed in accordance with the provisions of Articles CH 44 and CH 45.

However, electric heating units and electric heating panels, the surface temperature of which is in excess of 100° C, shall not be permitted.

If combustion heaters are required in rooms and apartments, the use of electrical apparatus with minimal resistance, and whose power is less than 3.5 kW, shall be permitted.

3. Apparatus for the production and emission of heat using a fuel in liquid, solid or gas form shall be prohibited.

However, one single chimney with a closed or inset grate, burning only wood, shall be permitted subject to the conditions defined by Article CH 55. It must be installed in a room complying with the provisions of Article CO 24.

4. Gas-operated apparatus for the production of sanitary hot water shall not be permitted in rooms and apartments.

5. Over and above the requirements of GZ 16 and GZ 17, gas pipes must not either serve or traverse rooms or apartments.

Article J 36

Paragraph 1 of this Article shall read as follows:

1. A fire safety system in category A, as defined in Article MS 53, must be installed in all establishments.

Automatic fire detectors appropriate to the risks involved must be installed throughout the establishment, except in staircases and sanitary areas.

Detectors located within rooms or apartments must include an action indicator situated in a visible position in the areas frequented by the public.

The provisions of Book IV of the safety regulations to counter the outbreak of fire and panic in establishments open to the public shall be amended as follows:

Modifications - Extensions

1. The conformance of permanent and significant modifications (partial or complete modification or alteration to the load-bearing structure, alteration to the whole of the roof or of the surrounds, etc.) must be certified subject to the same conditions as apply to new establishments.

2. If, the structure being of modular construction, it is planned to increase its capacity, this shall be authorised on condition that the work be carried out using the same components as the basic unit and that assembly shall be under the same conditions.

In this case, the procedure provided for in Article CTS 3 shall not be recommenced. The proprietor must, however, inform the board of control, and the details of these extensions must be entered in the safety records.

3. The procedure provided for in Article CTS 3 shall be applicable to a set of small tents if the following conditions are met:

  • the tents shall all be identical and erected independently of one another;
  • the surface area of any one tent must not exceed 50 square metres;
  • the tents must, in technical terms, be capable of being juxtaposedto form a continuous whole of variable dimensions;
  • the certificate of conformance must include information relating both to one single tent and to all of the tents (the planned activities, capacity, description, etc.).

If increases in capacity are planned, they shall be authorised subject to the condition that they shall be carried out using components identical to those of the basic unit. In this case, the procedure provided for by Article CTS 3 shall not be recommenced. The proprietor must, however, inform the board of control and details of these extensions must be entered in the safety records as well as in extracts therefrom.
